The Foreign Contribution (Regulation) Amendment Bill, 2026 sets up a statutory framework for the vesting, supervision, management and disposal of foreign contributions and of the assets created from them.
The framework works through a Designated Authority, an authority the Central government may appoint for the purpose.
The trigger is the end of an organisation's FCRA certificate. The Bill covers cancellation, surrender, and cessation of registration, including cessation that follows simply from non-renewal.
Once that happens, the foreign contribution and the assets created from it may vest provisionally in the Designated Authority.
Through that authority the government may take possession of and manage the assets created from foreign contributions.
Where it considers the step necessary or expedient in the public interest, the government may go further and undertake the management of the organisation's activities themselves, not merely of its property.
The measure is framed as an accountability mechanism, intended to prevent the diversion or abuse of properties built out of foreign funds.
Opposition members of Parliament protested in New Delhi on April 1, demanding that the Bill be withdrawn.
What Is New, and What the Act Already Had
The parent Act has always empowered the state to scrutinise foreign funding. Registrations can be withdrawn where there are violations, cancellation can follow continuing non-compliance, and penalties can attach to the diversion or misappropriation of foreign contributions.
The existing law also already contains a provision for vesting assets created from foreign funds upon cancellation. Vesting in itself is therefore not the innovation.
What is new is the detailed statutory framework that runs the whole distance: provisional vesting, possession, management, restoration, and ultimately permanent vesting and disposal.
The Bill provides for the restoration of assets where the organisation obtains, renews or gets its registration restored within the prescribed period.
It also provides mechanisms for revision and for judicial appeal.
The authors read this as a significant expansion of the statutory consequences that can follow the loss of registration, and not merely a change in administrative policy.
Over the past decade, thousands of FCRA registrations have ceased to operate, for reasons ranging from non-renewal to alleged statutory violations. The expanded consequences would therefore reach a very large field.
What was earlier confined largely to the loss of eligibility to receive foreign funds could now extend to provisional management and, if registration is not restored in time, to permanent vesting and disposal of the assets.
Ownership Versus Control
A defence of the framework rests on a dichotomy between ownership and custody. The organisation may keep formal ownership while the Designated Authority holds possession and manages.
The authors accept that this distinction may have some legal relevance, but argue that its practical consequences do not follow it.
An entity whose success depends on the continuity of management places far greater weight on control than on ownership.
Ownership may remain formally undisturbed, yet a change in management control fundamentally alters the relationship between the institution and the state.
A hospital, a school or a laboratory is not made effective by ownership alone. It depends on its independence to administer, for charitable ends, what it owns.
Proportionality and the Constitutional Question
The test the authors apply is the doctrine of constitutional proportionality.
The Supreme Court has repeatedly held that even where the state pursues a legitimate objective, the means it adopts must bear a reasonable connection to that objective.
The means must also maintain an appropriate balance between the public purpose and the burden imposed on rights.
Measured against that standard, a transfer of institutional management to a government-appointed authority calls for safeguards that are correspondingly robust.
The Bill therefore invites scrutiny of three things: the extent of the discretion delegated to the executive, the safeguards governing its exercise, and the standards applicable to decisions on possession, management and permanent vesting.
The open question is whether the safeguards the Bill does contain are sufficiently clear, timely and effective.
The argument is not that the government lacks the authority to strengthen financial oversight or to ensure that funds from abroad are used for lawful and proper ends.
It is that in a constitutional order, any regime reaching into the institutional infrastructure of civil society must operate within clear legislative standards.
The fundamental issue is not a contest between civil society and national security. It is where the state crosses the line from regulating foreign contributions to exercising undue executive control over the institutions that receive them.
Put at its narrowest, the constitutional question is not whether foreign contributions should be regulated, but how far the state may go in regulating institutions and their assets.
The analysis was written by Thajaswini C.B., an advocate practising before the Supreme Court and the Madras and Delhi High Courts, and Siddharth Dev Prasad, a fourth year law student at Gujarat National Law University.
Update, September 12: The Joint Parliamentary Committee Meets on 18 September
The Joint Parliamentary Committee constituted to examine the Bill will hold its first meeting on 18 September, according to a notice circulated by the Lok Sabha Secretariat.
A Joint Parliamentary Committee is a temporary committee of members drawn from both Houses, set up for one specific Bill or inquiry and dissolved once it reports.
This committee has 31 members and was constituted on a motion moved in the Lok Sabha on 12 August, during the Monsoon Session, which has not yet been prorogued.
Prorogation ends a session but not the House, and a Bill pending before a committee does not lapse on prorogation, which is why the committee can sit between sessions.
At the first sitting, officials of the Home Ministry will brief members on the provisions of the Bill, the standard first step before a committee takes evidence from outside.
The Opposition had demanded that the Bill be withdrawn altogether, accusing the government of targeting minority-run institutions.
Update, September 19: The Joint Committee Holds Its First Sitting
The Joint Committee of Parliament on the Bill has held its first meeting, and members put a wide range of questions to the Home Ministry on the proposed changes.
The questions split along predictable lines. Members of the ruling side pressed mainly on the utilisation of foreign contributions, while Opposition members questioned the provisions dealing with assets once an organisation's registration ends.
The Opposition's objection is aimed squarely at the designated authority. Under the Bill, if a certificate is cancelled, surrendered or lapses automatically, the foreign contributions and every asset created from them vest in a government appointed authority without a prior hearing and without a judicial determination.
The Home Ministry's reply is that the idea is not new. The existing law already provides for a prescribed authority, which a notification of 2018 identifies as the Additional Chief Secretary or Principal Secretary for Home of the State or Union Territory concerned.
The Ministry's case for the change is that the present custodian is a passive one: there is no deadline for the custodianship, no standard procedure for taking possession, no requirement to maintain inventories or to separate foreign funded assets from domestically funded ones, and no power to take substantive decisions on the assets.
Officials also argued that prolonged custodianship leaves States carrying the budgetary and manpower burden of running vested institutions such as schools, hospitals and orphanages, and that the existing law says nothing about the final disposal of assets or the treatment of places of worship.
Update, September 21: What the Bill Gives Back, and the Scale It Operates On
The vesting the Bill proposes is not stated as permanent from the start. If registration is restored within the prescribed period, the assets and the unused foreign contribution return to the organisation; permanent vesting follows only if it is not restored within that period.
The Bill also provides a route of challenge: revision, and an appeal to the District Judge. That is the answer offered to the objection that assets vest without a judicial determination.
If no fresh certificate is obtained within the period, the assets may be sold or transferred to a government department, and the proceeds go to the Consolidated Fund of India, from which nothing can be drawn without an appropriation made by law.
The scale matters to the argument. Since 2015, the registrations of 22,496 organisations have been cancelled, leaving about 14,466 associations still eligible to receive foreign contributions, on Home Ministry data of September 2026.
Why foreign funding is valued is a separate point from how much of it there is. It is prized less for its size than for being flexible, tailored to an organisation's own plan rather than to a government scheme, which is also why a restriction on it changes what the sector can attempt.
Related: the domestic alternative is growing but is shifting its focus. Private philanthropy was projected at about Rs. 1.43 lakh crore in a recent year and corporate social responsibility spending by listed companies at Rs. 22,563 crore, but newer donors favour research and institution building over the school, clinic and welfare work that the affected organisations mostly do.
Update, October 8: A High Court Holds That Receiving Foreign Funds Is Not a Right
The Madurai Bench of the Madras High Court has dismissed a civil miscellaneous appeal by a charitable trust whose application for registration under the Act was rejected, holding that receiving foreign contribution is not a right and that an organisation engaged in conversion shall be denied registration.
The test the Bench applied is that only organisations whose activities do not affect the nation's secular fabric and social amity are entitled to registration.
The procedural point is about disclosure. Form FC-3A requires an applicant to state the nature of the organisation, and the court held that an applicant that is engaged in religious programmes but projects itself as non religious has made a misrepresentation that entails rejection of the application itself.
The Bench drew a line worth carrying into an answer: an entity that teaches Vedanta, the Bhagavad Gita, the Upanishads, Yoga and allied Indian Knowledge Systems through structured classes, residential courses, publications, research and the preservation of manuscripts is to be classified under education or culture and not as a religious institution.
The judgment is a reminder of what the parent Act does. Registration under it runs for 5 years and is renewable, the alternative route is prior permission for one donor and one purpose, and the administering ministry is the Ministry of Home Affairs.
