One Nation, One Election: The 2029 First Phase and the Constitutional Route

What Is Being Considered

  • The Union government is reported to be considering holding Assembly elections in 22 States and Union Territories governed by the ruling alliance at the Centre, together with the 2029 Lok Sabha election, as a first phase of simultaneous elections.
  • Earlier calculations had put full implementation at 2034, because of the constitutional amendments and procedural complications involved. The reported shift is to not wait until 2034 and instead begin in 2029.
  • Of the 22, 17 are directly under a BJP-led government and five under allied parties. About 11 of them face Assembly elections within the next two years; if the alliance returns to office in those, their Assemblies could be dissolved in 2029 to align with the general election.
  • The strategy under examination is to dissolve those Assemblies before their five-year terms expire and hold their elections along with the Lok Sabha poll.

The Constitutional Route and What It Requires

  • The mechanism relied on is Article 174(2)(b), under which the Governor may dissolve the Legislative Assembly on the recommendation of the State Cabinet. This is precisely why the plan is considered workable only in States the alliance itself governs, since the recommendation must come from that State's own Cabinet.
  • The 129th Constitutional Amendment Bill on simultaneous elections has been under examination by a Joint Parliamentary Committee since December 19, 2023. The committee has obtained Parliament's permission to table its final report by the last week of the coming Winter Session.
  • For a constitutional amendment Bill of this kind to pass, the government needs a two-thirds majority in Parliament, which it does not presently command on its own.
  • The committee has already held consultations and taken views in Maharashtra, Uttarakhand, Punjab, Himachal Pradesh, Haryana, Karnataka, Gujarat and Goa, and has decided that Uttar Pradesh is next.
  • At a sitting of the committee in Delhi on August 24, witnesses including a former Union Home Minister deposed and placed on record the objection that the Bill is constitutionally impermissible. The constitutionality of the proposal therefore remains contested before the committee itself.

India Has Done This Before: 1951 to 1967

  • Simultaneous elections are not a new idea in India. After the Constitution was adopted, elections to the Lok Sabha and all State Legislative Assemblies were held at the same time from 1951 to 1967.
  • The first general elections to the Lok Sabha and the State Assemblies were held together in 1951-52.
  • The practice continued through the next three general elections, in 1957, 1962 and 1967.
  • The cycle broke because some State Assemblies were dissolved before their terms expired. The synchronised pattern was disrupted in 1968 and 1969, and has not been restored since. That history is why any return to simultaneous polls needs a mechanism to keep terms aligned, not just a single reset.

The Election Calendar That Would Have to Be Aligned

  • 2027: Goa, Uttarakhand, Punjab, Manipur, Uttar Pradesh, Himachal Pradesh and Gujarat, seven in all.
  • 2028: Tripura, Meghalaya, Nagaland, Mizoram, Chhattisgarh, Madhya Pradesh, Karnataka, Rajasthan and Telangana, nine in all.
  • 2029: Arunachal Pradesh, Sikkim, Andhra Pradesh, Odisha, Jammu and Kashmir, Haryana, Jharkhand and Maharashtra, eight in all.
  • 2030: the Union Territory of Delhi and the State of Bihar.
  • 2031: Tamil Nadu, Kerala, West Bengal, Assam and the Union Territory of Puducherry. Tamil Nadu's own Assembly term therefore sits well outside the proposed 2029 first phase.

அரசமைப்புச் சட்ட வழிமுறையும் அதற்குத் தேவையானதும்

  • பயன்படுத்தப்படும் வழிமுறை சட்டப்பிரிவு 174(2)(பி); இதன்படி மாநில அமைச்சரவையின் பரிந்துரையின் பேரில் ஆளுநர் சட்டப்பேரவையைக் கலைக்க முடியும். பரிந்துரை அந்த மாநிலத்தின் சொந்த அமைச்சரவையிலிருந்தே வர வேண்டும் என்பதால், கூட்டணியே ஆளும் மாநிலங்களில் மட்டுமே இத்திட்டம் சாத்தியம் எனக் கருதப்படுகிறது.
  • ஒரே நேரத் தேர்தல்கள் தொடர்பான 129-ஆவது அரசமைப்புச் சட்டத் திருத்த மசோதா டிசம்பர் 19, 2023 முதல் ஒரு நாடாளுமன்றக் கூட்டுக் குழுவால் ஆய்வு செய்யப்பட்டு வருகிறது. வரவிருக்கும் குளிர்கால கூட்டத்தொடரின் இறுதி வாரத்திற்குள் தனது இறுதி அறிக்கையைத் தாக்கல் செய்ய அக்குழு நாடாளுமன்ற அனுமதியைப் பெற்றுள்ளது.
  • இத்தகைய அரசமைப்புச் சட்டத் திருத்த மசோதா நிறைவேற, மத்திய அரசுக்கு நாடாளுமன்றத்தில் மூன்றில் இரண்டு பங்கு பெரும்பான்மை தேவை; தற்போது அது தானாகவே அந்த பலத்தைக் கொண்டிருக்கவில்லை.
  • அக்குழு ஏற்கெனவே மகாராஷ்டிரம், உத்தராகண்ட், பஞ்சாப், இமாசலப் பிரதேசம், ஹரியாணா, கர்நாடகம், குஜராத், கோவா ஆகிய மாநிலங்களில் ஆலோசனைகளை நடத்திக் கருத்துகளைப் பெற்றுள்ளது; அடுத்த கட்டமாக உத்தரப் பிரதேசத்தில் கருத்து கேட்க முடிவு செய்துள்ளது.
  • ஆகஸ்ட் 24 அன்று தில்லியில் நடந்த குழுக் கூட்டத்தில், முன்னாள் மத்திய உள்துறை அமைச்சர் உள்ளிட்டோர் ஆஜராகி, இம்மசோதா அரசமைப்புச் சட்டப்படி ஏற்புடையது அல்ல என்ற ஆட்சேபனையைப் பதிவு செய்தனர். எனவே இத்திட்டத்தின் அரசமைப்புச் சட்டச் செல்லுபடித்தன்மை குழுவின் முன்பே சர்ச்சைக்குரியதாக உள்ளது.

இந்தியா இதை ஏற்கெனவே செய்துள்ளது: 1951 முதல் 1967 வரை

  • ஒரே நேரத் தேர்தல் என்பது இந்தியாவுக்குப் புதிய கருத்து அல்ல. அரசமைப்புச் சட்டம் ஏற்கப்பட்ட பிறகு, 1951 முதல் 1967 வரை மக்களவைக்கும் அனைத்து மாநிலச் சட்டப்பேரவைகளுக்கும் ஒரே நேரத்தில் தேர்தல்கள் நடத்தப்பட்டன.
  • மக்களவைக்கும் மாநிலச் சட்டப்பேரவைகளுக்கும் முதல் பொதுத் தேர்தல்கள் 1951-52 இல் இணைந்தே நடத்தப்பட்டன.
  • இந்த நடைமுறை அடுத்த மூன்று பொதுத் தேர்தல்களிலும், அதாவது 1957, 1962, 1967 ஆகிய ஆண்டுகளிலும் தொடர்ந்தது.
  • சில மாநிலச் சட்டப்பேரவைகள் பதவிக் காலம் முடிவதற்கு முன்பே கலைக்கப்பட்டதால் இச்சுழற்சி உடைந்தது. ஒருங்கிணைந்த முறை 1968 மற்றும் 1969 இல் பாதிக்கப்பட்டது; அதன் பிறகு மீட்கப்படவில்லை. ஒரே நேரத் தேர்தலுக்குத் திரும்புவதற்கு ஒரு முறை மட்டும் சீரமைப்பது போதாது, பதவிக் காலங்களை இணைந்தே வைத்திருக்கும் வழிமுறை தேவை என்பதற்கு இந்த வரலாறே காரணம்.

இணைக்கப்பட வேண்டிய தேர்தல் அட்டவணை

  • 2027: கோவா, உத்தராகண்ட், பஞ்சாப், மணிப்பூர், உத்தரப் பிரதேசம், இமாசலப் பிரதேசம், குஜராத், மொத்தம் ஏழு.
  • 2028: திரிபுரா, மேகாலயா, நாகாலாந்து, மிசோரம், சத்தீஸ்கர், மத்தியப் பிரதேசம், கர்நாடகம், ராஜஸ்தான், தெலங்கானா, மொத்தம் ஒன்பது.
  • 2029: அருணாசலப் பிரதேசம், சிக்கிம், ஆந்திரப் பிரதேசம், ஒடிசா, ஜம்மு காஷ்மீர், ஹரியாணா, ஜார்க்கண்ட், மகாராஷ்டிரம், மொத்தம் எட்டு.
  • 2030: தில்லி யூனியன் பிரதேசமும் பிகார் மாநிலமும்.
  • 2031: தமிழ்நாடு, கேரளம், மேற்கு வங்கம், அஸ்ஸாம், புதுச்சேரி யூனியன் பிரதேசம். எனவே தமிழ்நாட்டின் சட்டப்பேரவைப் பதவிக் காலம் முன்மொழியப்பட்ட 2029 முதல் கட்டத்திற்கு வெளியேயே உள்ளது.
