Mines and Minerals Amendment Act, 2026: Section 9D and the States' Power to Tax Minerals

What the 2026 Amendment Does

  • The Mines and Minerals (Development and Regulation) Amendment Act, 2026 has inserted Section 9D, which restricts State governments from imposing taxes, cesses or other levies on mineral rights or on mineral bearing land, except in accordance with conditions prescribed by the Central government.
  • The parent law is the Mines and Minerals (Development and Regulation) Act, 1957, which governs the grant of mineral concessions and the regulation of mines and mineral development. The 2026 statute amends that Act rather than replacing it.
  • The Centre's stated reason for the section is to create a predictable tax environment, to prevent excessive levies, and to encourage long term investment in mining.
  • There is an understandable economic argument behind that objective. A mining project involves enormous investment and operates over decades, so an investor needs to know that the financial rules will not change unpredictably from one year to the next.
  • The section does not disturb what a State earns today. The Centre says 90 per cent of mining sector revenue accrues to the States and that this will continue, so the royalty, the auction premium and the other existing revenues are not taken away.
  • What changes is what a State may be prevented from earning tomorrow. Any future State levy connected with minerals now depends on a framework controlled by the Centre, which is why the objection is about freedom of action rather than about present receipts.

Where a State's Power to Tax Minerals Comes From

  • Entry 50 of the State List lets a State tax mineral rights, subject to any limitations imposed by Parliament by law relating to mineral development. The power is a State power, but it carries that condition inside the entry itself.
  • Entry 49 of the State List is a separate power altogether. It lets a State tax lands and buildings, and it carries no similar condition tied to mineral development.
  • Entry 54 of the Union List lets Parliament take the regulation of mines and mineral development under Union control to the extent declared by law to be expedient in the public interest. The Act of 1957 is such a declaration, which is how a central mining law came to occupy the field.
  • A royalty is what the holder of a mining lease pays the owner of the mineral for the mineral removed, at a rate fixed under the mining law. It moves with extraction and is tied to the grant of the lease.
  • A tax is a compulsory payment imposed by the authority of law for which the payer receives no matching return, and a cess is a tax collected for an earmarked purpose. Whether a levy is a royalty, a tax or a cess decides which entry in which List it has to be traced to.
  • That is why the whole argument turns on classification. A State's ability to raise money from the minerals under its soil depends on whether a particular levy is placed under Entry 50, under Entry 49, or outside both.

The 2024 Nine Judge Ruling, and What the Amendment Does to It

  • In 2024 a nine judge Bench of the Supreme Court decided Mineral Area Development Authority vs. Steel Authority of India, a case about the nature of the payments made on minerals.
  • The Bench held, among other things, that the royalty payable on minerals is not a tax. That mattered because a payment classified as a tax would have to be traced to a taxing entry, while a royalty need not be.
  • The Bench recognised the States' legislative power to tax mineral rights, and held that mineral bearing land can fall within a State's taxation power over land.
  • The criticism made of the new section is that the 2026 Amendment risks rendering the impact of that judgment nugatory, that is, leaving the ruling standing on paper while removing its practical effect.
  • The sharpest part of that criticism is a distinction. Entry 50 does permit Parliament to place limitations upon State taxation on mineral rights, but Section 9D goes further by extending its restriction to taxes or levies on mineral bearing lands, which is the subject of Entry 49. How far a central law dealing with mineral development may restrict a State's separate power to tax land is the question the section opens, and it is larger than mining policy alone.

Why a Mineral Rich State Objects

  • India's mineral wealth is not evenly spread. States such as Odisha, Jharkhand, Chhattisgarh and Karnataka hold enormous reserves of coal, iron ore and other minerals that feed industries across the country.
  • Mining brings investment and employment, but the host State is left to deal with the resettlement of displaced groups, environmental damage, pressure on public infrastructure, and the long term consequences of extracting minerals that can never be replaced.
  • A mineral rich State therefore has a natural economic advantage, and ordinarily one would expect it to have some ability to use that advantage to raise resources for its own development.
  • The revenue is not marginal. NITI Aayog's Fiscal Health Index has highlighted the strong performance of Odisha and Chhattisgarh in mobilising revenue and has specifically recognised the role played by mining receipts. In Odisha, mining has accounted for a large proportion of the State's non tax revenue.
  • Mineral producing districts often require greater public expenditure precisely because they bear the costs of mining, so the money has to be raised in the same place where the cost lands.
  • The federal point is the one the critics end on. A federal system cannot function effectively if States carry responsibilities without the financial capacity to meet them. Uniformity may make taxation more predictable, but predictability should not come at the cost of narrowing the fiscal choices available to States. The minerals beneath a State's soil may serve the entire country, while the costs of extracting them are felt most directly by the people who live above them.

  • இந்தியாவின் கனிம வளம் சமமாகப் பரவியிருக்கவில்லை. ஒடிசா, ஜார்க்கண்ட், சத்தீஸ்கர், கர்நாடகம் போன்ற மாநிலங்களில் நாடு முழுவதும் உள்ள தொழில்களுக்கு உணவளிக்கும் நிலக்கரி, இரும்புத் தாது, பிற கனிமங்களின் மகத்தான இருப்புகள் உள்ளன.
