Women in the Indian legal profession have made significant progress over the past century, yet their representation in the higher judiciary remains disproportionately low. From Cornelia Sorabji becoming the first woman lawyer in 1924 to increasing numbers of women in lower judiciary, the journey has been marked by advancement. However, a persistent glass ceiling continues to limit women's presence and influence in High Courts and the Supreme Court.
Women judges constitute only 14.27% (109 out of 764) in High Courts
Three High Courts (Uttarakhand, Meghalaya, Tripura) have no woman judge
Allahabad High Court has only 3 women judges (2%) out of 79 judges
Women are appointed at an older age (53 years) compared to men (51.8 years)
Since 2021, 28 judges appointed to Supreme Court with none being women
In 75 years, only one woman has been elevated directly from Bar to Supreme Court
Create application system for lawyers to express interest in judicial appointments
Implement gender diversity targets (at least one-third women) in higher judiciary
Consider gender diversity alongside existing considerations of state, caste, and religion
As India celebrates 75 years of the Supreme Court, transforming our courts to achieve true gender equality remains critical. Women's equal representation on the bench is essential not only for institutional legitimacy but also for delivering sound judgments that reflect diverse perspectives. The goal should be to normalize women's appointments to such an extent that they no longer seem extraordinary, creating a judiciary that genuinely represents the society it serves.
