As India celebrated 75 years of its Constitution on November 26, 2024, it is imperative to reflect on the fundamental vision of our constitutional framework - creating an egalitarian society. The Constitution makers, while accepting the liberal framework, envisioned a positive role for the state in reducing inequalities. This vision stands in stark contrast to the growing economic disparities witnessed in contemporary India, especially after the adoption of neoliberal economic reforms in the 1990s. The constitutional commitment to minimizing income inequality and eliminating social inequality faces significant challenges from the current economic order, which requires critical examination and corrective measures.
The Indian Constitution embraces egalitarian liberalism, reflecting John Rawls' principles of equal basic liberties, equal opportunities, and difference.
Article 38(2) of the Directive Principles of State Policy (DPSP) explicitly directs the state to minimize inequalities of income and eliminate disparities in status, facilities, and opportunities.
Article 39(c) emphasizes that economic systems should not lead to concentration of wealth and means of production to the common detriment.
The Supreme Court, in landmark judgments like D.S. Nakara vs Union of India (1982) and Air India Statutory Corporation vs United Labour Union (1996), has reinforced the constitutional commitment to establishing an egalitarian social order.
Justice V.R. Krishna Iyer's interpretation of Article 39(b) emphasized that both public and private resources fall within community resources, strengthening the state's power to redistribute resources for reducing inequality.
Post-1990s economic reforms shifted focus from welfare interventionism to market-driven growth, prioritizing private capital investment.
Research by Chancel and Piketty (2019, 2024) shows that the top 1% income earners' share decreased from 21% in the 1930s to 6% in the 1980s due to welfare state intervention, but has now increased to 22.6% after neoliberal reforms.
The "State of Inequality in India Report" (2022) highlights that only the top 10% earn average monthly wages of ₹25,000, while 90% earn less than this amount.
The World Inequality Lab (2024) report reveals that 90% of billionaire wealth is held by upper castes, with minimal representation from OBCs (10%) and SCs (2.6%), while STs have no representation.
The number of billionaires has increased from 9 in 2000 to 119 in 2023, while a minimum wage earner would take 941 years to earn what a top corporate executive earns in a year.
Strengthen progressive taxation systems to ensure equitable distribution of wealth and prevent concentration of economic power.
Enhance public expenditure on education, healthcare, and social security to create equal opportunities and facilities for all citizens.
Implement targeted affirmative action policies that address both social and economic inequalities.
Develop inclusive growth models that prioritize job creation, labor rights, and fair wages to reduce income disparities.
Strengthen institutions that can effectively regulate markets and prevent monopolistic practices that exacerbate inequality.
The widening economic disparities in India, exacerbated by the neoliberal economic order, stand in contradiction to the constitutional vision of an egalitarian society. The overlap of social inequality with economic inequality further compounds the challenge, giving certain sections disproportionate advantages and perpetuating historical injustices. As we reflect on our constitutional journey, it becomes crucial to realign our economic policies with the foundational principles enshrined in our Constitution. As Dr. B.R. Ambedkar cautioned, social and economic inequality will put political democracy in peril. Therefore, creating a more equitable society is not just a constitutional obligation but essential for sustaining India's democratic fabric and ensuring inclusive growth for all citizens.
