The practice of one candidate contesting from multiple constituencies (OCMC) has been a feature of Indian elections despite the 1996 amendment limiting it to two constituencies. This practice, while providing some advantages, presents significant challenges to our democratic system.
Imposes substantial financial burden on taxpayers - by-elections cost approximately ₹12.76 crore per seat according to 2024 estimates
Political parties spend around ₹250 crore per constituency during elections, with much funding from black money
By-elections within six months favour ruling parties, creating an uneven playing field against opposition
Forces defeated candidates to bear additional financial burden for contesting again
Violates citizens' right to freedom of speech and expression under Article 19(1)(a)
Decreases voter turnout in by-elections, as seen in Wayanad (64.24% in by-poll vs 72.92% in general election)
Ensures leadership continuity in leader-centric parties (example: Mamata Banerjee in West Bengal, 2021)
Amend Section 33(7) of RP Act to ban OCMC as recommended by ECI (2004) and Law Commission (2015)
Amend Section 151A to hold by-elections after one year instead of six months
While OCMC provides certain advantages, its disadvantages significantly outweigh the benefits. Implementing "One Candidate, One Constituency" would strengthen our democratic principles, reduce financial burden, and ensure fairer elections, just as "One Person, One Vote" remains a core democratic principle.
