Introduction

The recent notice of impeachment motion by 107 Members of Parliament against Justice G.R. Swaminathan of the Madras High Court has brought renewed attention to India's judicial accountability framework. The motion, submitted to the Lok Sabha Speaker in December 2025, contained 13 charges including allegations of acting against secular constitutional principles. While the Constitution provides for removal of judges under Articles 124(4) and 124(5) for Supreme Court judges and Articles 217(1)(b) and 218 for High Court judges, the term impeachment is technically used only for Presidential removal under Article 61. The Judges Inquiry Act, 1968 together with the Judges Inquiry Rules governs the entire procedure, which was designed to be deliberately rigorous to protect judicial independence.

1. Constitutional and Statutory Framework for Judicial Removal

A judge of the Supreme Court or High Court can be removed from office only on grounds of proved misbehaviour or incapacity, with misbehaviour not specifically defined in the Constitution itself.

The Supreme Court in K. Veeraswami versus Union of India 1991 held that society's demand for honesty in a judge is exacting and absolute, and deviation from standards of honesty and impartiality betrays the trust reposed in judges.

In M. Krishna Swami versus Union of India 1992, the Court clarified that wilful abuse of judicial office, wilful misconduct, corruption, lack of integrity, or any offence involving moral turpitude would constitute misbehaviour requiring actuation of mens rea.

The constitutional requirement mandates an address passed by each House supported by majority of total membership and not less than two-thirds of members present and voting, sent to the President for removal.

The Judges Inquiry Act requires not less than 100 Lok Sabha members or 50 Rajya Sabha members to sign the notice of motion, which must be submitted to the Speaker or Chairman respectively.

2. Procedural Flaws and Concerns in the Current System

The Act introduces a preliminary procedure where the Speaker or Chairman may admit or disallow the motion, and if disallowed, no further action is taken and the motion simply lapses without recourse.

The Act does not mention specific conditions of admissibility, unlike other motions and resolutions under the Rules of Procedure of Parliament, leaving significant discretionary space for arbitrary decisions.

When admitting or disallowing the motion, the Speaker or Chairman acts as a statutory authority rather than as Presiding Officer, yet basic conditions of admissibility remain unspecified in the legislation.

Article 124(5) empowers Parliament to regulate procedure for presentation of address and investigation of charges but does not explicitly provide space for Speaker or Chairman to refuse admission of motion.

A motion signed by 100 Members of Parliament can be rejected at the threshold without assigned reasons, rendering the entire constitutional exercise for judicial accountability infructuous.

3. Need for Reforms to Balance Independence and Accountability

There is every reason to believe that an impeachment motion is most likely to be disallowed at the threshold if the government of the day does not want it to proceed, effectively weaponizing the procedure.

The provision giving Speaker or Chairman option to disallow the motion needs revisiting since proof of misbehaviour should be established through investigation by the high-level committee, not preliminary executive screening.

Under Article 61 for Presidential impeachment, there is mandatory provision for resolution to be moved without empowering Speaker or Chairman to refuse admission on any grounds whatsoever.

The high-level committee comprising a Supreme Court judge, High Court Chief Justice, and distinguished jurist conducts detailed investigation only after admission, making preliminary rejection procedurally questionable.

Reforms should specify clear admissibility criteria, mandate automatic admission upon meeting signature requirements, and ensure judicial review of any rejection to prevent executive interference in accountability mechanisms.

Conclusion

The judicial impeachment framework in India reflects the delicate constitutional balance between protecting judicial independence and ensuring accountability for judicial misconduct. However, the current procedure contains significant flaws, particularly the discretionary power of the Speaker or Chairman to disallow motions without specified criteria or reasons. This effectively allows executive interference in a constitutional accountability mechanism designed for Parliament. The operation of a serious constitutional provision for removing unworthy judges should not be thwarted by governmental whims. Reforms must ensure that motions meeting constitutional requirements proceed to investigation automatically, while maintaining safeguards against frivolous complaints through the high-level committee process.
