Constitutional Background and Current Scenario

The 84th Constitutional Amendment Act (2001) extended the freeze on the number of Lok Sabha seats from 2000 to 2026 as a motivational measure for population stabilisation.

The Amendment stated that seats shall remain unaltered till the first census taken after 2026, keeping in view progress of family planning programmes in different parts of the country.

The Census was delayed from 2021, with results now expected by October 2028, after which the Delimitation Commission will be constituted.

Most population increase since 1991 has happened in northern States such as Bihar, Uttar Pradesh, Jharkhand, Madhya Pradesh, Rajasthan, and Chhattisgarh.

Delimitation based purely on population would significantly reduce the political representation of southern States that achieved demographic transition.

The southern States legitimately complain that they contribute the most to Union revenues but receive less over time from each Finance Commission.

The Digressive Proportionality Principle

This principle is used for representation of 27 member States to the European Parliament, ensuring fair representation in legislative bodies.

It gives larger countries more seats but fewer per person and smaller countries fewer seats but more representation per person.

It balances population size with state equality to prevent total domination by large nations, serving as a compromise between pure population proportionality and equal representation.

Finance Commissions already use multiple criteria including income distance, population size using both 2011 and 1971 Census, demographic performance rewarding reduced fertility rates, and tax efforts.

If the Finance Commission, a constitutional body, uses methods to reward population control, the Delimitation Commission could adopt similar principles.

The southern States have no choice but to join hands around the Digressive Proportionality principle and build consensus before the Centre constitutes the Delimitation Commission.
