Freedom of speech is vital for any democracy, and the usual suspects for attacks on this right are typically the executive or legislature. However, recent proceedings of the Supreme Court of India in Ranveer Allahbadia vs Union of India have raised concerns that potential risks to free speech could emerge from the judiciary itself. On November 27, 2025, the Court suggested that self-styled bodies are insufficient for online content regulation and proposed creating neutral autonomous bodies while asking the Government to publish draft regulatory guidelines. This judicial activism in demanding content regulation raises fundamental questions about constitutional propriety and separation of powers. When the Court takes on tasks of identifying content problems and deliberating on regulatory requirements, it ventures into the legislative domain, limited by inherent institutional barriers including lack of technical expertise in online media regulation. The thin line between legitimate regulation and unlawful restraint on speech demands careful examination through constitutional principles and comparative democratic practices.

1. Existing Legal Framework for Online Content Regulation

Section 67 of the Information Technology Act and Sections 294, 295, and 296 of the Bharatiya Nyaya Sanhita already penalise obscenity comprehensively.

Section 66 of the Information Technology Act prohibits computer-related offences such as hacking, while Section 66E prohibits publishing personal images without consent.

Section 66F of the Information Technology Act specifically penalises cyber terrorism, providing legal tools against serious online threats to national security.

The Information Technology Intermediary Guidelines and Digital Media Ethics Code Rules promulgated in 2021 establish oversight mechanisms, though criticised for overreaching interference.

These rules impose prior restraint requiring publishers to exercise due caution while dealing with activities, beliefs, practices, or views of racial or religious groups.

Despite comprehensive existing provisions, the Court's expansion of case scope to examine regulatory measures beyond the original subject matter raises procedural concerns.

In Common Cause vs Union of India 2008, the Court cautioned itself that many problems cannot be solved by courts despite their desire to help.

2. Constitutional Limitations on Restricting Free Speech
