Syllabus: Prelims Unit IV - Indian Polity

Basic Human Needs and Rights

  • Fundamental needs: Food, clothing, shelter
  • Additional essentials for dignified living: Freedom, equality, justice, self-respect
  • Human rights violation: Denial of these rights unlawfully

Universal Declaration of Human Rights

  • Issued by United Nations on 10.12.1948
  • Many countries subsequently enacted laws prioritizing human rights

Human Rights Protection Act in India

  • Enacted by Indian Parliament on 28.9.1993
  • Established National Human Rights Commission in Delhi
  • State Human Rights Commissions set up in various states

Functioning of Human Rights Commissions

  • Investigate complaints on human rights violations
  • Complaints can be filed by affected individuals or on their behalf
  • Sometimes investigate based on media reports
  • Have powers similar to civil courts during investigations
  • Can summon involved parties, obtain necessary documents, appoint witnesses
  • Can intervene in ongoing court cases with permission
  • Can recommend interim relief to victims

Supreme Court Guidelines and Police Conduct

  • 11 guidelines issued for police conduct during arrests
  • Must be displayed in all police stations in public view
  • Often not properly displayed or placed in inaccessible locations
  • Unauthorized beating of ordinary citizens
  • Public silence on violations contributes to their continuation

Structure and Powers of Human Rights Commissions

  • Have independent investigation units
  • Headed by officers of DGP rank
  • National commission headed by retired Supreme Court judge
  • Can dismiss vague or trivial complaints
  • Cannot handle property rights, contractual obligations, labor disputes
  • Cases already under court consideration are outside their purview

NHRC Guidelines for Police

  • Report custodial deaths and rapes within 24 hours
  • Video record post-mortem of custodial deaths
  • Human Rights Cell in police to monitor and prevent violations
  • CCTV cameras installed in police stations

Criticisms and Suggestions

  • Political interference in appointments of chairpersons and members
  • Lack of independence in functioning
