The First Division Bench of the Madras High Court, made up of Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan, dismissed a writ petition against an amended resolution of the Tamil Nadu Legislative Assembly. The Chief Justice authored the verdict.
The petition was filed by Agri S.S. Krishnamurthy, the AIADMK whip in the Assembly. He did not attack what the resolution said; he attacked the way the amendment to it came to be adopted.
The holding in one line: legislators who either vote Aye or stay silent without raising any objection during the proceedings of a House cannot, weeks later, ask a court to treat their own silence as a nullity.
The Bench put the underlying principle in general terms. A person who stands by, watches an act take place and permits it to occur without protest cannot afterwards be heard to complain of it, and that principle applies with as much force on the floor of a legislature as in any other public proceeding.
The Court drew a sharp line between an outsider and an insider. This was not the case of a citizen who was shut out of the process or misled about it; it was the case of a Member, and of the party he belongs to, who was present in the House when the amendment was proposed, read out and voted upon.
A challenge of that kind, the Bench said, cannot succeed unless prejudice is ex facie apparent, meaning apparent on the face of the record without any further inquiry.
Three facts showed the Court that no such prejudice existed: the petitioner's continued presence through the debate, his silence at the vote, and his party's later unsuccessful attempt to reopen the issue within the House itself.
The Mekedatu Resolution and How the Amendment Arose
The resolution was passed by the Assembly on 19 June. The amendment under challenge urged the Centre to constitute a tribunal to resolve the dispute between Tamil Nadu and Karnataka over the proposed construction of a dam at Mekedatu.
The petitioner's grievance was that the plea for a tribunal was not in the draft resolution circulated to the MLAs. It was added on the day of voting, after Chief Minister C. Joseph Vijay accepted a request made by Leader of the Opposition Udhayanidhi Stalin.
Advocate General Vijay Narayan answered that what was actually put to a vote in the House was the amended resolution, which already included the plea for a tribunal, and that no MLA, the writ petitioner included, raised any objection to the amendment before it was declared to have been passed unanimously. The judges agreed with him.
The Court found nothing wrong with the procedure the House adopted. It said this is not an unusual way for a resolution to acquire its final shape on the floor of a House.
Legislatures routinely accept oral suggestions or modifications during a Minister's reply. Unless a rule in absolute terms forecloses that course, the presiding officer's acceptance of such a modification, unopposed by the House, is not something a court can second guess.
Article 212, Article 226 and Rule 286
Article 212 of the Constitution forecloses judicial examination of the validity of proceedings in a legislature on the ground of an irregularity of procedure. The Court treated it as a constitutional bar, not as a matter of judicial preference.
Article 226 is the power of a High Court to issue writs. The Bench said that courts exercising jurisdiction under Article 226 are not obliged to entertain a challenge founded on an irregularity that the petitioner himself was in a position to object to at the time, and chose not to.
That sentence carries a wider lesson about writ jurisdiction. Relief under Article 226 is discretionary, and the conduct of the person asking for it is part of what the court weighs.
On the authority of the presiding officer, the Court said the Speaker of a House does not merely record motions. The Speaker also regulates the conduct of business and controls its procedure.
Rule 286 of the Tamil Nadu Legislative Assembly Rules vests the Speaker with the power to decide all questions of procedure arising in the House. The House and its presiding officer, the Bench said, are the best judges of the propriety of their own proceedings.
The Court read the petitioner's own affidavit against him. It disclaimed any challenge to the substance of the Assembly's opposition to the Mekedatu project and confined itself to process, which is exactly the kind of grievance Article 212 was designed to keep outside the doors of the Court.
Points to Carry from the Judgment
The working test is substance against procedure. A complaint about how business was conducted inside a House falls on the wrong side of Article 212; a challenge to what the House actually decided stands on different ground and is not covered by this bar.
Article 212 protects the autonomy of the legislature over its own internal working. It sits alongside the Speaker's rule making and procedural authority rather than replacing it, so a procedural grievance has a forum, and that forum is the House.
The petitioner's party did use that forum and failed there. The Court treated that failed attempt inside the House as further proof that nothing had been denied to him.
A student should hold three provisions together here: Article 212 as the bar on procedural challenges, Article 226 as the writ power that the bar limits, and Rule 286 as the source of the Speaker's power to settle procedural questions.
The doctrine the Bench applied is the familiar rule that a person who stands by and lets something happen cannot later complain of it. Its novelty here is the setting, since the Court applied it to a Member on the floor of a House rather than to a private party in an ordinary dispute.
The threshold the Court set for any such challenge is high. Nothing short of prejudice apparent on the face of the record will move a writ court to look inside the proceedings of a legislature.
சென்னை உயர் நீதிமன்றம் கூறியது என்ன
தலைமை நீதிபதி சுஷ்ருத் அரவிந்த் தர்மாதிகாரி, நீதிபதி ஜி. அருள் முருகன் ஆகியோர் அடங்கிய சென்னை உயர் நீதிமன்றத்தின் முதலாவது பிரிவு அமர்வு, தமிழ்நாடு சட்டப்பேரவையின் திருத்தப்பட்ட தீர்மானத்துக்கு எதிரான ரிட் மனுவைத் தள்ளுபடி செய்தது. தீர்ப்பை எழுதியவர் தலைமை நீதிபதி.
மனுவைத் தாக்கல் செய்தவர் பேரவையில் அதிமுக கொறடாவாக உள்ள அக்ரி எஸ்.எஸ். கிருஷ்ணமூர்த்தி. தீர்மானத்தில் இடம்பெற்ற கருத்தை அவர் எதிர்க்கவில்லை; அதற்கான திருத்தம் ஏற்கப்பட்ட முறையை மட்டுமே எதிர்த்தார்.
தீர்ப்பின் மையக் கருத்து ஒரே வரியில்: அவை நடவடிக்கைகளின்போது ஆம் என வாக்களித்தவர்களோ, எந்த ஆட்சேபனையும் எழுப்பாமல் மௌனமாக இருந்தவர்களோ, வாரங்கள் கழித்து தங்கள் மௌனத்தையே செல்லாததாகக் கருதுமாறு நீதிமன்றத்தைக் கேட்க முடியாது.
இதன் அடிப்படைக் கொள்கையை அமர்வு பொதுவாக வைத்தது. ஒரு செயல் நடப்பதைப் பார்த்துக்கொண்டு அருகில் நின்று, எதிர்ப்பின்றி அதை நடக்க விடுபவர், பின்னர் அதைக் குறித்து முறையிட உரிமை இழக்கிறார்; வேறு எந்தப் பொது நடவடிக்கைக்கும் பொருந்துவது போலவே இக்கொள்கை சட்டப்பேரவைத் தளத்துக்கும் முழுமையாகப் பொருந்தும்.
வெளியாள், உள்ளாள் என்ற வேறுபாட்டைத் தெளிவாக நீதிமன்றம் வரைந்தது. இது நடைமுறையிலிருந்து ஒதுக்கப்பட்ட அல்லது தவறாக வழிநடத்தப்பட்ட ஒரு குடிமகனின் வழக்கு அல்ல; திருத்தம் முன்மொழியப்பட்டு, வாசிக்கப்பட்டு, வாக்கெடுப்புக்கு வந்தபோது அவையில் இருந்த ஓர் உறுப்பினரின், அவர் சார்ந்த கட்சியின் வழக்கு.
இத்தகைய சவால், மேலதிக விசாரணை இல்லாமலேயே ஆவணத்தின் மேற்பரப்பில் தெரியும் அளவுக்குப் பாதிப்பு வெளிப்படையாக இருந்தால் மட்டுமே வெல்ல முடியும் என்று அமர்வு கூறியது.
அத்தகைய பாதிப்பு இல்லை என்பதை மூன்று செய்திகள் காட்டின: விவாதம் முழுவதும் மனுதாரர் அவையில் இருந்தது, வாக்கெடுப்பின்போது அவர் மௌனமாக இருந்தது, பின்னர் அவைக்குள்ளேயே பிரச்சினையை மீண்டும் எழுப்ப அவரது கட்சி நடத்திய தோல்வியுற்ற முயற்சி.
மேகேதாட்டு தீர்மானமும் திருத்தம் வந்த விதமும்
தீர்மானம் ஜூன் 19 அன்று பேரவையில் நிறைவேற்றப்பட்டது. மேகேதாட்டு அணை கட்டும் திட்டம் தொடர்பாக தமிழ்நாடு, கர்நாடகா இடையிலான பிரச்சினையைத் தீர்க்க நடுவர் மன்றம் ஒன்றை அமைக்குமாறு மத்திய அரசைக் கோரிய திருத்தமே சவாலுக்கு உள்ளானது.
நடுவர் மன்றம் கோரும் பகுதி உறுப்பினர்களுக்கு வழங்கப்பட்ட வரைவுத் தீர்மானத்தில் இல்லை என்பதே மனுதாரரின் குற்றச்சாட்டு. எதிர்க்கட்சித் தலைவர் உதயநிதி ஸ்டாலின் வைத்த கோரிக்கையை முதலமைச்சர் சி. ஜோசப் விஜய் ஏற்றதையடுத்து, வாக்கெடுப்பு நடந்த நாளிலேயே அது சேர்க்கப்பட்டது.
அவையில் வாக்கெடுப்புக்கு வைக்கப்பட்டது நடுவர் மன்றக் கோரிக்கையை உள்ளடக்கிய திருத்தப்பட்ட தீர்மானமே என்றும், அது ஒருமனதாக நிறைவேறியதாக அறிவிக்கப்படுவதற்கு முன்பு மனுதாரர் உட்பட எந்த உறுப்பினரும் ஆட்சேபனை எழுப்பவில்லை என்றும் அரசு தலைமை வழக்கறிஞர் விஜய் நாராயண் வாதிட்டார். நீதிபதிகள் அதை ஏற்றனர்.
அவை பின்பற்றிய நடைமுறையில் தவறு எதுவும் இல்லை என்று நீதிமன்றம் கண்டது. அவைத் தளத்தில் ஒரு தீர்மானம் தன் இறுதி வடிவைப் பெறுவதற்கு இது வழக்கத்துக்கு மாறான வழி அல்ல என்று அது கூறியது.
அமைச்சரின் பதிலுரையின்போது வாய்மொழிப் பரிந்துரைகளையும் திருத்தங்களையும் சட்டமன்றங்கள் வழக்கமாக ஏற்றுக்கொள்கின்றன. அவ்வழியை ஒரு விதி முற்றிலும் தடை செய்யாதவரை, அவையின் எதிர்ப்பின்றி அத்தகைய திருத்தத்தை அவைத் தலைவர் ஏற்பதை நீதிமன்றம் மறுஆய்வு செய்ய இயலாது.
பிரிவு 212, பிரிவு 226, பேரவை விதி 286
அரசியலமைப்பின் பிரிவு 212, நடைமுறைக் குறை என்ற அடிப்படையில் சட்டமன்ற நடவடிக்கைகளின் செல்லுபடியை நீதித்துறை ஆய்வு செய்வதைத் தடுக்கிறது. இது நீதிமன்றத்தின் விருப்பம் அல்ல, அரசியலமைப்புத் தடை என்று நீதிமன்றம் கருதியது.
பிரிவு 226 என்பது ஆணைகளை வழங்கும் உயர் நீதிமன்றத்தின் அதிகாரம். அன்றைய நேரத்தில் மனுதாரரே ஆட்சேபிக்கும் நிலையில் இருந்தும் ஆட்சேபிக்காமல் விட்ட ஒரு நடைமுறைக் குறையை அடிப்படையாகக் கொண்ட சவாலை, பிரிவு 226இன் கீழ் செயல்படும் நீதிமன்றங்கள் விசாரிக்கக் கடமைப்பட்டவை அல்ல என அமர்வு கூறியது.
ரிட் அதிகாரம் குறித்த பரந்த பாடம் இதில் உள்ளது. பிரிவு 226இன் கீழ் வழங்கப்படும் நிவாரணம் நீதிமன்றத்தின் தன்னிச்சை சார்ந்தது; அதைக் கோருபவரின் நடத்தையும் நீதிமன்றம் எடைபோடும் ஒன்றே.
அவைத் தலைவரின் அதிகாரம் குறித்து, சபாநாயகர் வெறுமனே தீர்மானங்களைப் பதிவு செய்பவர் மட்டும் அல்ல என்று நீதிமன்றம் கூறியது. அவைப் பணிகளின் நடத்தையை ஒழுங்குபடுத்துவதும், அதன் நடைமுறையைக் கட்டுப்படுத்துவதும் சபாநாயகரின் பணி.
தமிழ்நாடு சட்டப்பேரவை விதிகளின் விதி 286, அவையில் எழும் அனைத்து நடைமுறைக் கேள்விகளையும் தீர்மானிக்கும் அதிகாரத்தைச் சபாநாயகருக்கு அளிக்கிறது. தங்கள் சொந்த நடவடிக்கைகளின் முறைமையை மதிப்பிட அவையும் அதன் தலைவருமே சிறந்த நடுவர்கள் என்று அமர்வு கூறியது.
மனுதாரரின் சொந்த உறுதிமொழிப் பத்திரத்தையே நீதிமன்றம் அவருக்கு எதிராக வாசித்தது. மேகேதாட்டு திட்டத்துக்கு பேரவை தெரிவித்த எதிர்ப்பின் உள்ளடக்கத்தை அது சவாலுக்கு உட்படுத்தவில்லை, நடைமுறையுடன் மட்டுமே நின்றுவிட்டது; நீதிமன்றத்தின் வாசலுக்கு வெளியே வைக்கவே பிரிவு 212 வடிவமைக்கப்பட்ட வகை முறையீடு இதுதான்.
தீர்ப்பிலிருந்து எடுத்துச் செல்ல வேண்டியவை
செயல்படும் சோதனை உள்ளடக்கமா, நடைமுறையா என்பதே. அவைக்குள் பணி நடத்தப்பட்ட விதம் குறித்த முறையீடு பிரிவு 212இன் தவறான பக்கத்தில் விழுகிறது; அவை எதைத் தீர்மானித்தது என்பதற்கு எதிரான சவால் வேறு தளத்தில் நிற்கிறது, இத்தடைக்கு உட்படாது.
தன் உள்ளக நடப்புகள் மீதான சட்டமன்றத்தின் தன்னாட்சியைப் பிரிவு 212 காக்கிறது. சபாநாயகரின் விதி அமைக்கும், நடைமுறை சார்ந்த அதிகாரத்துக்குப் பதிலாக அல்ல, அதனுடன் இணைந்தே இது நிற்கிறது; எனவே நடைமுறை முறையீட்டுக்கு ஒரு களம் உண்டு, அக்களம் அவையே.

மூன்று விதிகளை ஒன்றாக வைத்துக் கற்க வேண்டும்: நடைமுறை சார்ந்த சவால்களுக்கான தடையாகப் பிரிவு 212, அத்தடை வரம்பிடும் ஆணை அதிகாரமாகப் பிரிவு 226, நடைமுறைக் கேள்விகளைத் தீர்க்கும் சபாநாயகரின் அதிகாரத்துக்கான மூலமாக விதி 286.
அமர்வு பயன்படுத்திய கோட்பாடு, அருகில் நின்று ஒன்று நடக்க அனுமதித்தவர் பின்னர் அதைக் குறித்து முறையிட முடியாது என்ற பழக்கமான விதியே. இங்கு புதுமை அதன் களம்; சாதாரண வழக்கில் உள்ள தனியாருக்கு அல்லாமல், அவைத் தளத்தில் இருந்த ஓர் உறுப்பினருக்கு அதை நீதிமன்றம் பொருத்தியது.
இத்தகைய சவாலுக்கு நீதிமன்றம் வைத்த அளவுகோல் மிக உயரமானது. ஆவணத்தின் மேற்பரப்பிலேயே தெரியும் பாதிப்பு இல்லாதவரை, சட்டமன்ற நடவடிக்கைகளுக்குள் எட்டிப்பார்க்க ஒரு ரிட் நீதிமன்றம் முன்வராது.
