Article 345, Article 347 and the Eighth Schedule: Which One Decides What

Three Provisions That Answer Three Different Questions

  • Students merge these three because all of them mention languages. They do not overlap at all. Each answers a separate question, and each puts the decision in a different pair of hands.
  • Article 345 asks what a State uses in its own offices. It lets the legislature of a State adopt, by law, any one or more of the languages in use in that State, or Hindi, as the language for all or any of the official purposes of that State. The words are "in use in the State", so a language actually spoken there qualifies whether or not any list carries it.
  • Article 346 asks what one government writes to another in. For communication between one State and another, or between a State and the Union, the language is the one authorised for use in the Union. Two or more States may agree between themselves to use Hindi instead.
  • Article 347 asks what happens when a part of a State speaks something else. On a demand being made, and if satisfied that a substantial proportion of a State's population desires it, the President may direct that such a language be officially recognised throughout that State or in any part of it, for such purpose as the President specifies.
  • The contrast worth memorising is the actor. Under Article 345 a State acts on itself, by its own law. Under Article 347 the Union acts on a State, through the President, on a demand from below, and it can be confined to a district rather than applied to the whole State.
  • All three sit in Part XVII of the Constitution, in the chapter on regional languages, and Article 345 itself opens by saying it is subject to Articles 346 and 347.

What the Eighth Schedule Actually Does

  • The Eighth Schedule is often described as a list of India's official languages. It is not. It does not make any language official anywhere, and a State's choice under Article 345 does not depend on it.
  • Constitutionally it does exactly two things. Under Article 344(1) the Commission on official language that the President constitutes must have members representing the languages in the Schedule. Under Article 351, Hindi is to be developed by drawing its vocabulary primarily on Sanskrit and secondarily on the other languages of the Schedule.
  • Everything else attached to the Schedule is practice rather than constitutional command. Being listed is what lets a candidate write certain public examinations in that language, and it carries recognition, institutional support and funding for development.
  • The list has grown from 14 languages at the commencement of the Constitution to 22 today, and every addition needed a constitutional amendment: Sindhi in 1967, Konkani, Manipuri and Nepali in 1992, and Bodo, Dogri, Maithili and Santhali in 2003.
  • A language outside the Schedule is called a non scheduled language. The Census counts its speakers separately and it may be taught, published in and used in administration. Tulu has been treated by the Census as an independent language since the office was established, and it is not in the Schedule.

How a State Actually Changes Its Official Language

  • A cabinet decision is not the change. Article 345 says the legislature may adopt a language by law, so the operative instrument is a State Act, and a decision of the executive is only the intention to move one.
  • Karnataka's cabinet decided at Mangaluru on 18 September to give Tulu additional official status for administrative matters in Dakshina Kannada and Udupi districts, with about Rs. 82 lakh a year for translation, training and use of the language.
  • To take effect it must amend the Karnataka Official Language Act, 1963, whose section 2 makes Kannada the State's official language. The amendment goes to the Governor, and the government then issues a notification, after which the decision is in force.
  • That is the same route Andhra Pradesh and Telangana followed for Urdu as a second official language, which is why a Karnataka committee visited Andhra Pradesh to study the procedure before reporting.
  • What the status will mean in practice is administrative and local: members may speak in Tulu at gram panchayat, taluk panchayat and zilla panchayat meetings and in urban local body councils, circulars and orders in those districts are to carry Tulu, and a person may write to a government department in Tulu.
  • Tulu is already taught as a third optional language from Class 6 to Class 10 in those two districts, introduced for Class 6 in 2010-11, which shows that school recognition, official status and inclusion in the Eighth Schedule are three separate things a language can have in any combination.

Tamil Nadu, and the Provisions Around the Edges

  • Tamil is the official language of Tamil Nadu under a State Act of 1956, passed under Article 345. Tamil is also in the Eighth Schedule, and was recognised as a classical language in 2004, which is a decision of the Union government and not a constitutional category at all.
  • The language of a High Court is a separate provision again. Article 348 keeps proceedings in the Supreme Court and every High Court in English until Parliament provides otherwise, and a Governor may authorise another language in a High Court only with the previous consent of the President, which is the route Tamil Nadu's Assembly has repeatedly asked to be opened for Tamil in the Madras High Court.
  • Article 350 lets any person submit a representation for redress of a grievance to any authority of the Union or a State in any language used in the Union or in that State. This is a right of the individual and needs no official status for the language at all.
  • Article 350A directs every State and local authority to provide adequate facilities for instruction in the mother tongue at the primary stage to children of linguistic minority groups. Article 350B provides for a Special Officer for Linguistic Minorities, appointed by the President, to investigate safeguards and report.
  • Read together, the scheme is layered. Article 29 protects a group's right to conserve its language; Article 350 protects an individual's right to be heard in it; Article 350A protects a child's schooling in it; Article 345 lets a State make it official; Article 347 lets the Union direct recognition where a State has not; and the Eighth Schedule decides none of these.

எட்டாவது அட்டவணை உண்மையில் செய்வது என்ன

  • எட்டாவது அட்டவணை இந்தியாவின் அலுவல் மொழிகளின் பட்டியல் எனப் பெரும்பாலும் விவரிக்கப்படுகிறது. அது அல்ல. எந்த மொழியையும் எங்கும் அலுவல் மொழியாக அது ஆக்குவதில்லை; விதி 345 இன் கீழ் ஒரு மாநிலத்தின் தேர்வு அதைச் சார்ந்ததும் அல்ல.

  • அட்டவணையுடன் இணைந்த மற்ற அனைத்தும் அரசியலமைப்பு ஆணை அல்ல, நடைமுறையே. பட்டியலில் இருப்பதே ஒரு விண்ணப்பதாரர் அம்மொழியில் சில பொதுத் தேர்வுகளை எழுத வழிவகுக்கிறது; அங்கீகாரம், நிறுவன ஆதரவு, வளர்ச்சிக்கான நிதி ஆகியவற்றையும் அது சுமக்கிறது.

  • அவ்விரு மாவட்டங்களில் 6 ஆம் வகுப்பு முதல் 10 ஆம் வகுப்பு வரை மூன்றாம் விருப்பப் பாடமாகத் துளு ஏற்கெனவே கற்பிக்கப்படுகிறது; 2010-11 இல் 6 ஆம் வகுப்புக்கு அது அறிமுகமானது. பள்ளி அங்கீகாரம், அலுவல் நிலை, எட்டாவது அட்டவணையில் இடம் ஆகிய மூன்றும் தனித்தனியானவை; ஒரு மொழி இவற்றை எந்தச் சேர்க்கையிலும் பெற்றிருக்கலாம் என்பதை இது காட்டுகிறது.

தமிழ்நாடும், விளிம்புகளில் உள்ள விதிகளும்

  • விதி 345 இன் கீழ் இயற்றப்பட்ட 1956 ஆம் ஆண்டு மாநிலச் சட்டத்தின்படி தமிழே தமிழ்நாட்டின் அலுவல் மொழி. தமிழ் எட்டாவது அட்டவணையிலும் உள்ளது; 2004 இல் செம்மொழியாகவும் அங்கீகரிக்கப்பட்டது. அது ஒன்றிய அரசின் முடிவு, அரசியலமைப்பு வகை அல்லவே அல்ல.
  • உயர் நீதிமன்றத்தின் மொழி வேறொரு விதி. நாடாளுமன்றம் வேறுவிதமாக வகை செய்யும் வரை உச்ச நீதிமன்றத்திலும் ஒவ்வோர் உயர் நீதிமன்றத்திலும் நடவடிக்கைகள் ஆங்கிலத்திலேயே இருக்கும் என விதி 348 கூறுகிறது; குடியரசுத் தலைவரின் முன் ஒப்புதலுடன் மட்டுமே ஓர் உயர் நீதிமன்றத்தில் வேறு மொழியை ஆளுநர் அனுமதிக்க முடியும். சென்னை உயர் நீதிமன்றத்தில் தமிழுக்காகத் தமிழ்நாட்டுப் பேரவை மீண்டும் மீண்டும் திறக்கக் கோரியது இந்த வழியையே.
  • ஒன்றியத்திலோ ஒரு மாநிலத்திலோ பயன்படுத்தப்படும் எந்த மொழியிலும், குறை தீர்க்கக் கோரி ஒன்றியத்தின் அல்லது ஒரு மாநிலத்தின் எந்த அதிகாரியிடமும் மனு அளிக்க விதி 350 எவருக்கும் அனுமதி தருகிறது. இது தனிநபரின் உரிமை; அம்மொழிக்கு அலுவல் நிலை எதுவும் தேவையில்லை.
  • மொழிச் சிறுபான்மைக் குழுக்களின் குழந்தைகளுக்கு தொடக்கக் கல்வி நிலையில் தாய்மொழியில் கற்பிக்கப் போதிய வசதிகளை வழங்குமாறு ஒவ்வொரு மாநிலத்துக்கும் உள்ளாட்சிக்கும் விதி 350A அறிவுறுத்துகிறது. பாதுகாப்புகளை ஆய்ந்து அறிக்கை அளிக்க, குடியரசுத் தலைவரால் நியமிக்கப்படும் மொழிச் சிறுபான்மையினருக்கான சிறப்பு அலுவலரை விதி 350B வழங்குகிறது.
  • சேர்த்துப் படித்தால் இத்திட்டம் அடுக்கானது. ஒரு குழு தன் மொழியைப் பேணும் உரிமையை விதி 29 காக்கிறது; அம்மொழியில் கேட்கப்படும் தனிநபர் உரிமையை விதி 350 காக்கிறது; அதில் குழந்தையின் பள்ளிக் கல்வியை விதி 350A காக்கிறது; அதை அலுவல் மொழியாக்க விதி 345 ஒரு மாநிலத்துக்கு வழிவிடுகிறது; மாநிலம் செய்யாதவிடத்து அங்கீகாரத்தை அறிவுறுத்த விதி 347 ஒன்றியத்துக்கு வழிவிடுகிறது; இவற்றுள் எதையும் எட்டாவது அட்டவணை தீர்மானிப்பதில்லை.
