The Union Ministry of Home Affairs has proposed an elected body for the Union Territory of Ladakh by introducing a new constitutional provision under Article 371, in a proposed Chapter K.
The proposal was described by civil society members who attended a meeting with Ministry officials in Delhi. They were shown a PowerPoint presentation mentioning Chapter K, but have not yet received a detailed draft proposal.
According to the statement they released, the Ministry said the intended Union Territory level body would be elected by direct election. Direct election means the voters themselves choose the members, rather than an electoral college or a nominating authority choosing them.
The body would carry legislative powers over land, culture and language, forest, environment, natural resources, and any other subject reserved for the Union Territory under Article 240.
Article 240 empowers the President to make regulations for the peace, progress and good government of certain Union Territories. A subject reserved for the territory under that Article is therefore one on which regulation making power already sits with the Union, and the proposal would move it to an elected local body.
The Chief Secretary of Ladakh, Ashish Kundra, who attended the meeting, described the discussion as covering the broad contours of a sui generis model of governance under Article 371, and said the goal is deepening democracy. Sui generis means of its own kind, that is a model built for this one case rather than copied from an existing arrangement.
Where Article 371 Sits in the Constitution
Article 371 deals with Temporary, Transitional and Special Provisions and sits in Part XXI of the Constitution.
Its chapters currently run from A to J. A new Chapter K would therefore be the next in that sequence.
It applies at present in 12 States: Nagaland, Assam, Manipur, Mizoram, Maharashtra, Gujarat, Andhra Pradesh, Telangana, Arunachal Pradesh, Goa, Sikkim and Karnataka.
The significance for Ladakh is that every existing chapter under Article 371 protects a State. Extending the Article to a Union Territory would be a departure from that pattern, which is what the phrase sui generis in the Chief Secretary's account points to.
A chapter under Article 371 is not the same as Statehood. It assigns protected subjects to a body without altering the constitutional status of the territory, so the demand for Statehood would remain unmet by such a chapter.
How Ladakh Reached This Point
Ladakh had held special status as part of the erstwhile State of Jammu and Kashmir under Article 370 of the Constitution.
When that status was withdrawn, Ladakh was turned into a Union Territory without a legislative assembly in 2019. A Union Territory of that kind is administered by the Centre through a Lieutenant Governor, and has no elected house of its own to legislate.
Since then the Leh Apex Body and the Kargil Democratic Alliance have demanded Statehood and tribal status for Ladakh, and a larger role for local residents in decisions on land and infrastructure projects.
Violence broke out in Leh city on 24 September 2025 during a protest called to demand constitutional safeguards, and four people were killed in police firing.
The current round of talks is not the first. Cherring Dorjay Lakruk of the Leh Apex Body said the meeting was a reiteration of an earlier meeting held on 22 May, and that the delegation was disappointed because no draft proposal followed.
The climate activist Sonam Wangchuk, part of the same delegation, said the meeting could not be called a complete success, because the assurance of protection under Article 371 was discussed but the draft proposal the delegation had hoped for was not provided.
What the Ladakh Bodies Are Asking For
Representatives of the Leh Apex Body and the Kargil Democratic Alliance asked that the Lieutenant Governor take no major decision on the administration, the bureaucracy or land until the proposed constitutional safeguards are actually in place.
They pressed for the legislation to be passed in the coming Winter Session of Parliament, rather than being left as a proposal.
They sought compensation for the families of those killed in the Leh firing.
They also sought the withdrawal of criminal cases against 80 people, citing the protection extended to those who took part in a protest at Jantar Mantar in Delhi in July as the precedent.
The bodies have repeatedly staged protests over the years seeking Statehood, and the demand for an elected body with power over land and resources runs through all of them.
The Follow-up of 11 September: A Sui Generis Body
The Chief Secretary of Ladakh has clarified that neither Statehood nor a Union Territory with a legislature is on offer. What is being crafted is a sui generis model, a body of its own kind with no parallel anywhere else in the country.
The body is to carry legislative, executive and financial powers. Its name has not been settled, which is one reason the discussions are continuing.
The members agreed on direct election through constituencies. A list of eight to nine questions has been put to them on how the new body would relate to the existing hill councils and how powers would be divided between them.
A safeguard of this kind needs a constitutional amendment, and an amendment needs broad political consensus, consultation and consideration by Parliament. The next round of talks is expected in October.
The Ladakh bodies called the meeting disappointing, saying the Union Home Ministry and the territory's administration were not on the same page, and that the agenda should have been shared in advance.
Update, October 14: Twenty Eight Names on the Map, and China's Objection
The Survey of India, the country's national survey and mapping organisation founded in 1767, has standardised the names of 28 features in the Union Territory of Ladakh.
The break up is 11 peaks, 5 mountains, 6 land areas, 2 glaciers, 2 passes, 1 valley, 1 river, 1 lake and 1 other waterbody. Some lie near Patrolling Point 15, along the Line of Actual Control.
The Line of Actual Control is not a settled boundary but the line up to which each side holds ground. The Galwan clash of June 2020 and the disengagement of September 2022 both took place along it.
The Chinese Foreign Ministry called the naming illegal and void and said it has never recognised the Union Territory of Ladakh. India's External Affairs Ministry rejected that, saying the Union Territory is an integral and inalienable part of India and that identifying the places formally is aimed at accurate recognition and public awareness.
The Union Territory itself was created on 5 August 2019, the day Article 370 was diluted and the State of Jammu and Kashmir was reorganised.
Update, October 16: Fresh Drafts Exchanged in Leh, Talks Move to Delhi on October 22
A fresh round of talks between a Union Home Ministry team and Ladakh's civil society groups in Leh ended without consensus. Both sides exchanged fresh drafts, and the next round is set for 22 October in New Delhi.
The Ministry made a 15 page presentation; the Leh Apex Body and the Kargil Democratic Alliance, each an amalgam of social and religious organisations, submitted a draft of their own and called the Ministry's draft unsatisfactory. They have asked for a revised Ministry draft by 18 October.
The two demands have not moved: a legislature for Ladakh and inclusion in the Sixth Schedule, which gives autonomous district councils power over land, forests and local custom in certain tribal areas. The Leh Apex Body said its demand for special provisions under Article 371 would see no dilution.
The Centre's offer, made in July, is a sui generis model built on Article 371, the Article that carries special provisions for particular States, together with a legislature for the region.
Ladakh was carved out as a Union Territory without a legislature on 5 August 2019, and is administered through the Ladakh Autonomous Hill Development Councils of Leh and Kargil. Talks with the Centre have run for six years.
Separately, the Leh Apex Body condemned China's recent statement on Ladakh and said it looks to see Aksai Chin as part of India.
Update, October 17: The Bodies Reject the Draft and Call It a North-East Frontier Agency Model
The Leh Apex Body and the Kargil Democratic Alliance have categorically rejected in principle the fresh draft proposal the Home Ministry shared at the sub-committee meeting of 15 October.
In a joint statement the two bodies call the draft a significant departure from the assurances and commitments made at earlier meetings of the sub-committee, and ask the Ministry to accept instead the draft Memorandum of Understanding they had submitted, in its entirety.
Their specific objection is that the draft fails to address the demand for a legislative Assembly and for constitutional safeguards under Article 371, including a provision tailored to Ladakh's own circumstances.
What it proposes instead, they say, is a North-East Frontier Agency type arrangement. That is the pre-1972 model under which the region now called Arunachal Pradesh was administered by the Centre through the Governor of Assam as its agent, with no legislature of its own.
They say the framework is closer to a Territorial Council model, with substantial powers concentrated in the Lieutenant Governor's administration, rather than the legislative and executive safeguards sought.
The minimum they had understood as agreed, recorded in the Minutes of Meeting of 22 May 2026 and signed on 3 July, was a Union Territory with a legislature, from which a sui generis model could then be developed.
The draft roadmap shared in Leh ran to 15 pages. Another round of talks is expected in New Delhi on 22 October.
Update, October 18: The Chief Secretary Answers, and Points to Article 240
Ladakh Chief Secretary Ashish Kundra said the Union government remains committed to shaping a sui generis model, a model of its own kind, to meet the demands of the region, and called for dialogue and patience.
He expressed surprise that the 32-page proposal was dismissed within just two hours of being received, when officials had spent three to four weeks preparing it.
The route he set out is the two-stage approach: first a constitutional amendment, then a subsequent regulation under Article 240, the Article that lets the President make regulations for the peace, progress and good government of a Union Territory without a legislature.
He listed the institutional questions still open: the nomenclature and composition of the proposed body, the method of election, representation of women and under-represented communities, nominated and ex-officio members, the authority that would conduct elections, delimitation of constituencies, electoral rolls, tenure, and the body's relationship with the existing Ladakh Autonomous Hill Development Councils, panchayats and municipalities.
On the demand for Statehood with a legislature, he noted that Ladakh depends wholly on the Centre for salaries and pensions, where Jammu and Kashmir and Delhi have separate public accounts and must generate their own revenue.
On the Sixth Schedule demand he said such demands can be met only in a specific context, since the Schedule has its own geographical and historical setting, while clause (K) under Article 371 has enough flexibility to provide constitutional protection.
Update, October 19: A High Court Bench Opens at Leh
The Ladakh Bench of the Jammu and Kashmir High Court was inaugurated at Leh on Sunday, in the presence of the Lieutenant Governor and the Chief Justice of India. Until now litigants from Ladakh had to travel to the High Court’s seat for a hearing.
A High Court has one principal seat, and a bench may be established elsewhere so that a distant region has a court within reach. The seat and the benches of a High Court are fixed by the President.
Article 214 provides that there shall be a High Court for each State, and Article 231 allows Parliament by law to establish a common High Court for two or more States, or for a State and a Union Territory.
Jammu and Kashmir and Ladakh were separated into two Union Territories in 2019, one with a legislature and one without, and the two continue to share a single High Court. The bench at Leh is the first court of that level to sit inside Ladakh.
Update, October 22: Panchayat Polls Called, and the Kargil Council Dissolved
With talks with the Centre on Statehood and the Sixth Schedule under way, the Ladakh administration on 21 October announced panchayat elections on 21 November across all panchayat halqas, with nominations closing on 2 November and the Model Code of Conduct in force at once. The last panchayat and municipal polls were held in 2018, when Ladakh was still part of Jammu and Kashmir.
It also dissolved the Ladakh Autonomous Hill Development Council, Kargil, with immediate effect, following the reorganisation of districts. That council was elected in 2023 and would have completed five years in 2028.
Ladakh now has eight districts, Leh, Kargil, Sankoo, Changthang, Nubra, Sham, Zanskar and Drass, and 100 elected constituencies, which will also be the basis for constituting a hill council in each of the eight. Until now there were only two councils, for Leh and Kargil.
For the Article 371 question this matters directly: the hill councils are the only elected local government a Union Territory without a legislature has, and the proposal under discussion is precisely about what kind of elected body should sit above them.
