More than 3,000 serving Central Armed Police Force (CAPF) Group A officers, including gallantry award winners and women officers, have moved the Supreme Court to challenge the Central Armed Police Force (General Administration) Act, 2026.
The petitioners say the Act will make it harder for CAPF cadre officers to be promoted through the ranks into leadership positions, since it allows a higher share of Indian Police Service (IPS) officers on deputation to fill those posts.
The Act was passed by Parliament on April 2, 2026 and notified on April 9, 2026.
The petitions ask the Supreme Court to declare Sections 3 and 4 of the Act "ultra vires" (beyond the powers) of the Constitution of India.
What the Act Changes
Section 3 covers the regulation of recruitment and conditions of service, and specifies, notwithstanding any judgment, decree or order of any court, the percentage of posts in each CAPF reserved for IPS officers on deputation.
Under the Act, in every CAPF: 50% of all Inspector General (IG) posts, at least 67% of Additional Director General (ADG) posts, and all posts of Special Director General and Director General must be filled by IPS officers on deputation.
Until now, such postings were made through executive orders rather than a standalone law; the earlier practice of reserving 50% of Deputy Inspector General (DIG) posts for CAPFs' own Group A officers finds no place in the new Act, opening the way for a higher share of IPS-deputed officers in those posts too.
Section 4 gives the Union government the power to amend the Act's First and Second Schedules through a notification whenever it considers such action necessary or expedient in the public interest, without needing fresh legislation.
The CAPFs comprise the Central Reserve Police Force (CRPF), Border Security Force (BSF), Indo-Tibetan Border Police (ITBP), Sashastra Seema Bal (SSB), and Central Industrial Security Force (CISF).
The Supreme Court Ruling the Act Was Meant to Override
The Act was enacted to effectively negate the Supreme Court's May 23, 2025 ruling in Sanjay Prakash v. Union of India, delivered after several retired CAPF officials filed a case seeking implementation of cadre officers' promotion rights.
That ruling held that Group A Executive Cadre officers of CAPFs are "Organised Group A Services" for all purposes, and directed the government to progressively reduce IPS deputation in CAPF leadership up to the level of Inspectors General over the following two years.
The court also ordered a time-bound review of cadre and service rules within six months, and sought a declaration that Higher Administrative Grade posts in all CAPFs be filled from among eligible executive cadre officers of the respective forces, rather than exclusively through IPS deputation.
The Union Ministry of Home Affairs challenged the judgment, but the Supreme Court dismissed the review petition on October 28, 2025, making the ruling final.
After retired CAPF officials filed a contempt petition over non-implementation, the Ministry of Home Affairs introduced a Bill in Parliament in March 2026 that effectively negated the 2025 judgment; that Bill became the CAPF (General Administration) Act, 2026, now under challenge.

சஞ்சய் பிரகாஷ் எதிர் இந்திய ஒன்றியம் வழக்கில் 2025 மே 23 அன்று உச்ச நீதிமன்றம் அளித்த தீர்ப்பை நடைமுறையில் மறுக்கவே இச்சட்டம் இயற்றப்பட்டது; பணியாளர்களின் பதவி உயர்வு உரிமைகளை அமல்படுத்தக் கோரி ஓய்வுபெற்ற பல CAPF அதிகாரிகள் வழக்குத் தொடர்ந்ததைத் தொடர்ந்து இத்தீர்ப்பு வழங்கப்பட்டது.
அத்தீர்ப்பு, CAPF-களின் Group A Executive Cadre அதிகாரிகள் அனைத்து நோக்கங்களுக்கும் "ஒழுங்கமைக்கப்பட்ட Group A சேவைகள்" என்று கூறியது; அடுத்த இரண்டு ஆண்டுகளில் CAPF தலைமைப் பொறுப்புகளில் Inspector General நிலை வரை நியமன IPS அதிகாரிகளின் எண்ணிக்கையைப் படிப்படியாகக் குறைக்குமாறு அரசுக்கு உத்தரவிட்டது.

இத்தீர்ப்பை மத்திய உள்துறை அமைச்சகம் எதிர்த்தது; ஆனால் 2025 அக்டோபர் 28 அன்று உச்ச நீதிமன்றம் மறுஆய்வு மனுவை தள்ளுபடி செய்தது, இதனால் தீர்ப்பு இறுதியானது.
தீர்ப்பு அமல்படுத்தப்படாததால் ஓய்வுபெற்ற CAPF அதிகாரிகள் அவமதிப்பு மனு தாக்கல் செய்த பின்னர், 2026 மார்ச் மாதம் உள்துறை அமைச்சகம் பாராளுமன்றத்தில் ஒரு மசோதாவை அறிமுகப்படுத்தியது; அது 2025 தீர்ப்பை நடைமுறையில் மறுத்தது; அந்த மசோதாவே தற்போது எதிர்க்கப்படும் மத்திய ஆயுதப் படை (பொது நிர்வாகம்) சட்டம், 2026 ஆனது.
