What the Bill Proposes

  • The Constitution (130th Amendment) Bill, 2025 proposes the automatic removal from office of a Minister, Chief Minister or Prime Minister if arrested and held in custody for 30 continuous days on a serious criminal charge carrying a jail term of 5 years or more.
  • The Bill would apply this rule uniformly to Union and State executives alike, tying continuation in high constitutional office to the fact of sustained custodial detention on a grave charge, rather than to a conviction.

Where the Bill Stands

  • A Joint Parliamentary Committee (JPC), comprising members from both Houses of Parliament, is examining the Bill; it has been granted an extension of its deadline to submit its report, with papers on the extension laid before the Lok Sabha.
