What the Court Held

  • On 15 October 2026 the Supreme Court ruled that a person who moves out of a Hindu social order cannot carry a reservation claim across with them. A Hindu from a Backward order does not become entitled to what a Muslim Backward Class member receives merely by converting.
  • The provision at the centre of the case is Article 16(4). The Court held that a claim under it cannot rest on the social backwardness attached to a pre-conversion status.
  • Caste identity, the Bench said, is not an immutable personal attribute that survives untouched when a person's religious affiliation changes.
  • A reservation benefit cannot travel from the religion in which the backwardness arose into a religion whose basic theological structure does not rest on caste as its foundation.
  • The formulation the judgment turns on is that conversion severs the legal foundation of an entitlement conditioned on membership of a particular Hindu social order. The ruling names Islam, Christianity or any other non-Hindu social order.
  • Membership does not transfer in the other direction either: converting does not by itself make a person a member of a notified Backward Muslim community.
  • The Bench was headed by Justice Prashant Kumar Mishra, who wrote the judgment.

The State Order and the Case That Tested It

  • The appeal was brought by the Tamil Nadu government, which asked the Court to confirm its own order of March 2024.
  • That order extended reservation benefits to people from the Backward Classes, Most Backward Classes, De-notified communities and Scheduled Castes who had embraced Islam. The State's stated purpose was a level playing field, keeping affirmative action alive for a person after a change of religion.
  • The Court located the fundamental defect in the order's central assumption. It treated the historical disadvantage a person carried in one religion as sufficient proof of membership of a particular Backward Class in another.
  • The order never explained the step it took for granted: why a Hindu from a Backward Class, a Most Backward Class, a De-notified Community or a Scheduled Caste should, on conversion to Islam, become a member of one of the seven pre-existing Backward Muslim communities. The appeal was dismissed.
  • Behind the appeal was the petition of Sameer Ahamed, a resident of Thoothukudi born to Hindu parents, who changed his faith to Islam in 2015.
  • The Sunnath Jamath gave him a certificate of conversion. He then applied for a community certificate describing him as Muslim Lebbai, and the Tahsildar refused it.
  • The Madras High Court rejected his petition and the Supreme Court confirmed that denial. The identity of a Backward Class Muslim community, it explained, was constituted historically, by social membership, and a declaration of conversion is not proof of that membership.
  • A Jamath may certify that a person has embraced Islam. It cannot, by issuing a testimonial, conclusively settle a statutory Backward Class status.

Scheduled Caste Status, Article 341 and Paragraph 3

  • The Scheduled Caste question is decided by a different set of provisions, and the Court dealt with it separately. Scheduled Caste status can neither be altered nor recreated by an executive order of a State.
  • Article 341 governs that status, and it requires that only the President may notify a group as a Scheduled Caste.
  • Paragraph 3 of the Constitution (Scheduled Castes) Order, 1950, provides in express terms that a person professing a religion other than Hinduism, Sikhism or Buddhism shall not be deemed a member of a Scheduled Caste.
  • The consequence follows directly. On conversion to a religion outside those three, a person ceases to possess Scheduled Caste status and cannot continue to claim it by pointing back to the caste of origin.
  • Note the split that a question is likely to turn on. The Backward Class limb was decided on Article 16(4) and on how a community is constituted; the Scheduled Caste limb was decided by Article 341 read with a Presidential Order.

What Follows in Tamil Nadu

  • DMK president M.K. Stalin asked the State government to file a special leave petition in the Supreme Court to protect reservation for Backward Class members who had converted to Islam.
  • His argument was that social backwardness is not the work of a day or a generation but of a social system built over thousands of years, and that a change of religion does not erase it. He called the ruling contrary to the principle of social justice.
  • He recalled that the previous government had adopted a resolution seeking reservation for Adi Dravidars who had converted to Christianity, together with a call for an amendment to the Constitution, and said the present government should carry those efforts forward.
  • The route he points to is the one the judgment itself leaves open. Because the religion limit sits in a Presidential Order read with Article 341, and because the Court held that a State executive order cannot alter that status, any change has to come from the constitutional process rather than from a State notification.
