The Gram Sabha: Article 243A, the Four Meeting Days and What a Village Decides

What the Gram Sabha Is

  • A gram sabha is the assembly of every person whose name is on the electoral roll of a village panchayat. It is not a committee, not a council and not a group of nominees, but the voters of the village themselves, meeting in one place.
  • There is no election to the gram sabha. This is what separates it from the panchayat, which is the elected body, and it is why the gram sabha is described as the taproot of people's rule rather than one more tier of it.
  • The three tier rural local government is made of members who win elections to the village panchayat, the panchayat union and the district panchayat. The gram sabha sits apart from that structure and supervises the first tier.
  • The power and the responsibility to convene the gram sabha rest with the president of the village panchayat, so a failure to call the meeting is a failure of a named office holder and not of an anonymous department.
  • Its authority is constitutional, which means a State law can add to its functions but cannot wish the body away.

The Road to Article 243A

  • Village assemblies are older than the Constitution. Under the Mauryan empire villages functioned as self governing units, and Kautilya's Arthashastra discusses the spread of administration away from the centre.
  • Rule under the Cholas is treated as the high point of early local administration in the Tamil country. The Uthiramerur inscription records the kudavolai method, the pot and palm leaf ballot by which a village chose the members of its administrative committees.
  • In the colonial period, Lord Ripon introduced in 1882 the practice of choosing members of local bodies by election, which is why he is remembered as the father of modern local self government in India.
  • After Independence the Balwant Rai Mehta Committee of 1957 recommended a three tier system of rural local government. It was put into practice first in Rajasthan in 1959.
  • The Ashok Mehta Committee of 1977, and other committees after it, pressed the case that local bodies needed constitutional status rather than the goodwill of a State government of the day.
  • That came with the 73rd and 74th Constitutional Amendments of 1992, which gave rural and urban local bodies protection of their powers and a place in the Constitution itself.
  • Article 243A is the provision that creates the gram sabha in every village panchayat and leaves it to the legislature of a State to provide by law for the powers it will exercise.
  • In Tamil Nadu those powers are set out in the Tamil Nadu Panchayats Act, 1994, the State law written to carry the 73rd Amendment into effect.

What the Sabha Actually Decides

  • The first function is choosing beneficiaries. The names of those who will receive a house, a toilet, a pension or a loan under a local body scheme are settled in the open meeting rather than in an office.
  • The second is review. The sabha considers what schemes run by other departments have actually done at the village level and records its decision, which gives a village a say in work that is not its panchayat's own.
  • The third is the social audit. The sabha examines the works the local body has carried out and the money it has spent, so the audit happens in front of the people who watched the work being done.
  • Taken together these make the sabha an instrument of transparent and accountable administration, and the courts have affirmed that character in a series of judgments.
  • Its effectiveness is tied to the panchayat it supervises. Where the panchayat is weak, the sabha has little to audit, which is why capacity building, training and the use of technology in the panchayat are treated as part of strengthening the sabha.
  • Attendance is the other half. A sabha that meets without the villagers present can pass a resolution but cannot carry the authority the Constitution intends it to have.

The 2 October Meeting in Tamil Nadu

  • Under the State law the gram sabha meets on four fixed days each year: 26 January, 1 May, 15 August and 2 October. The October meeting falls on Gandhi Jayanti, the birth anniversary of the leader who held that every village should become a republic with full powers.
  • Chief Minister C. Joseph Vijay has appealed to people to attend in large numbers, saying the success of a scheme lies in its benefits actually reaching every eligible household in every village.
  • The meetings are being held in all village panchayats except those in Chengalpattu and Tiruppur districts, where byelections are under way.
  • The agenda the government has set out covers rural housing, roads, drinking water, sanitation, the rural employment guarantee, the economic activities of women's self help groups, livelihood development and the school breakfast scheme named after Perunthalaivar Kamarajar.
  • For a student the meeting is the clearest illustration of a constitutional idea at work: a body that nobody is elected to, that meets on fixed days, and that decides who gets what in the village.

  • கிராம ஊராட்சி, ஊராட்சி ஒன்றியம், மாவட்ட ஊராட்சி ஆகியவற்றுக்கான தேர்தல்களில் வெல்பவர்களைக் கொண்டே மூவடுக்கு ஊரக உள்ளாட்சி அமைகிறது. அந்த அமைப்புக்கு வெளியே நின்று முதல் அடுக்கை மேற்பார்வையிடுவது கிராம சபை.
  • கிராம சபையைக் கூட்டும் அதிகாரமும் பொறுப்பும் கிராம ஊராட்சித் தலைவரிடமே உள்ளன; எனவே கூட்டம் கூட்டப்படாவிட்டால் அது பெயர் தெரியாத துறையின் தவறு அல்ல, பெயர் தெரிந்த ஒரு பதவியாளரின் தவறு.
  • அதன் அதிகாரம் அரசமைப்பு சார்ந்தது; ஒரு மாநிலச் சட்டம் அதன் பணிகளைக் கூட்ட முடியும், ஆனால் அவ்வமைப்பையே இல்லாமல் ஆக்க முடியாது.

  • தமிழகத்தின் ஆரம்பகால உள்ளாட்சி நிர்வாகத்தின் உச்சமாக சோழர் ஆட்சி கருதப்படுகிறது. ஓர் ஊர் தன் நிர்வாக வாரியங்களின் உறுப்பினர்களைத் தேர்ந்தெடுத்த குடமும் ஓலையும் கொண்ட வாக்கெடுப்பான குடவோலை முறையை உத்திரமேரூர் கல்வெட்டு பதிவு செய்கிறது.
  • காலனிய காலத்தில், உள்ளாட்சி அமைப்புகளின் உறுப்பினர்களைத் தேர்தல் மூலம் தேர்ந்தெடுக்கும் முறையை ரிப்பன் பிரபு 1882 இல் கொண்டுவந்தார்; இந்தியாவின் நவீன உள்ளாட்சி அமைப்புகளின் தந்தை என அவர் போற்றப்படுவதற்குக் காரணம் இதுவே.

  • தமிழ்நாட்டில் அந்த அதிகாரங்கள் தமிழ்நாடு ஊராட்சிகள் சட்டம், 1994 இல் வரையறுக்கப்பட்டுள்ளன; 73 ஆவது திருத்தத்தை நடைமுறைக்குக் கொண்டுவர இயற்றப்பட்ட மாநிலச் சட்டம் அது.

சபை உண்மையில் முடிவு செய்வது

  • முதல் பணி பயனாளிகளைத் தேர்வு செய்வது. உள்ளாட்சித் திட்டத்தின் கீழ் வீடு, கழிப்பிடம், ஓய்வூதியம், கடன் பெறுவோரின் பெயர்கள் அலுவலகத்தில் அல்ல, திறந்த கூட்டத்திலேயே முடிவாகின்றன.
  • இரண்டாவது மறுஆய்வு. பிற துறைகள் நடத்தும் திட்டங்கள் ஊர் அளவில் உண்மையில் என்ன செய்தன என்பதைச் சபை பரிசீலித்து முடிவைப் பதிவு செய்கிறது; தன் ஊராட்சியின் சொந்தப் பணி அல்லாத வேலையிலும் ஓர் ஊருக்குக் குரல் கிடைப்பது இதனால்தான்.
  • மூன்றாவது சமூகத் தணிக்கை. உள்ளாட்சி நிறைவேற்றிய பணிகளையும் செலவிட்ட பணத்தையும் சபை ஆய்வு செய்கிறது; பணி நடப்பதைப் பார்த்த மக்களின் முன்னிலையிலேயே தணிக்கை நடக்கிறது.
  • இவை அனைத்தும் சேர்ந்து, வெளிப்படையான, பொறுப்புள்ள நிர்வாகத்துக்கான கருவியாக சபையை ஆக்குகின்றன; அத்தன்மையைப் பல தீர்ப்புகளில் நீதிமன்றங்கள் உறுதிப்படுத்தியுள்ளன.
  • அதன் செயல்திறன், அது மேற்பார்வையிடும் ஊராட்சியுடன் பிணைந்தது. ஊராட்சி வலுவற்றதாக இருந்தால் சபைக்குத் தணிக்கை செய்ய ஏதும் இருக்காது; அதனாலேயே ஊராட்சியின் திறன் மேம்பாடு, பயிற்சி, தொழில்நுட்பப் பயன்பாடு ஆகியவை சபையை வலுப்படுத்தும் பணியின் பகுதியாகவே கருதப்படுகின்றன.

தமிழ்நாட்டில் அக்டோபர் 2 கூட்டம்

  • மாநிலச் சட்டத்தின்படி ஆண்டுக்கு நான்கு நிர்ணயித்த நாள்களில் கிராம சபை கூடுகிறது: ஜனவரி 26, மே 1, ஆகஸ்ட் 15, அக்டோபர் 2. ஒவ்வொரு கிராமமும் முழு அதிகாரங்களுடன் ஒரு குடியரசாக மாற வேண்டும் எனக் கருதிய தலைவரின் பிறந்த நாளான காந்தி ஜெயந்தியில் அக்டோபர் கூட்டம் வருகிறது.
  • திரளாகக் கலந்துகொள்ளுமாறு முதலமைச்சர் சி. ஜோசப் விஜய் மக்களைக் கேட்டுக்கொண்டுள்ளார்; ஒவ்வொரு கிராமத்திலும் தகுதியான ஒவ்வொரு குடும்பத்தையும் பயன்கள் உண்மையில் சென்றடைவதிலேயே ஒரு திட்டத்தின் வெற்றி உள்ளது என்பது அவரது கூற்று.
  • இடைத்தேர்தல் நடக்கும் செங்கல்பட்டு, திருப்பூர் மாவட்டங்கள் நீங்கலாக, அனைத்து கிராம ஊராட்சிகளிலும் கூட்டங்கள் நடைபெறுகின்றன.
  • ஊரக வீட்டுவசதி, சாலைகள், குடிநீர், தூய்மை, ஊரக வேலை உறுதி, மகளிர் சுய உதவிக் குழுக்களின் பொருளாதார நடவடிக்கைகள், வாழ்வாதார மேம்பாடு, பெருந்தலைவர் காமராஜர் பெயரிலான பள்ளிக் காலை உணவுத் திட்டம் ஆகியவற்றை அரசு வகுத்த நிகழ்ச்சி நிரல் உள்ளடக்குகிறது.
  • ஒரு மாணவருக்கு இக்கூட்டம், செயலில் உள்ள ஓர் அரசமைப்புக் கருத்தின் தெளிவான எடுத்துக்காட்டு: யாரும் தேர்ந்தெடுக்கப்படாத, நிர்ணயித்த நாள்களில் கூடும், ஊரில் யாருக்கு என்ன என்பதை முடிவு செய்யும் ஓர் அமைப்பு.
