  • States/UTs may designate any Sessions Court as a special fast-track court hearing cases daily, with appeals going to a two-judge High Court Bench to be resolved within 3 months. The Bill has passed only the Lok Sabha so far; Rajya Sabha passage is still pending.

Update, July 31: Rajya Sabha Clears the Bill, Completing its Passage Through Parliament

  • The Rajya Sabha passed the Public Examinations (Prevention of Unfair Means) Amendment Bill, 2026, completing its passage through Parliament after the Lok Sabha had already passed it on 29 July.
  • The Bill now goes for Presidential assent before coming into force, carrying the confirmed provisions already reported: a 2-month investigation deadline (Special Task Forces within 60 days), a 3-month trial deadline from the chargesheet through State-designated Special Fast Track Courts, and a debarment period for errant service providers doubled from 4 to 8 years.

Update, August 2: The Bill Becomes Law as President Murmu Gives Assent

The Original 2024 Act

Why the Amendment Was Needed

  • The NTA, the central body conducting most large public examinations, has run 270 examinations for over 6.6 crore students since 2018, yet a Rajya Sabha reply revealed it has only 24 employees, all on deputation, with 15 of its 39 sanctioned posts vacant, relying on 73 contract officials and 124 outsourced personnel to manage this scale.
  • Amid recurring paper-leak controversies, the Delhi High Court notified a designated special court at the Rouse Avenue Court Complex for criminal cases arising from paper leaks and unfair means in public examinations, underlining the need for dedicated judicial infrastructure that this Bill now formalises nationwide.

Institutional Architecture

  • The amendment layers three institutional pieces onto the 2024 Act's framework: Special Task Forces for time-bound investigation, State-designated Special Fast Track Courts for time-bound trial, and Special Public Prosecutors appointed under the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, to prosecute these cases.
