Removing a Chief Election Commissioner: Article 324(5) and the Two-Thirds Majority

Why the Question Has Come Up

  • Rahul Gandhi, the Leader of the Opposition in the Lok Sabha, demanded on Thursday that Chief Election Commissioner Gyanesh Kumar resign, after a newspaper investigation into the rupture inside the Election Commission of India.
  • Congress sources said the Opposition would shortly move a motion in both Houses of Parliament to remove the Chief Election Commissioner, that the motion was being drafted with legal experts, and that notices would be submitted in both Houses on behalf of the joint Opposition.
  • The investigation had brought out the criticisms that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi made internally, over the last few months, against the decisions and the processes of the Commission.
  • The Commission works as a body of three. The Chief Election Commissioner is first among equals and not the seniormost member, and decisions are to be taken unanimously by all three so far as that is possible.

Who Appoints the Commission, and on What Terms

  • Two instruments govern the appointment, the tenure and the removal: Article 324 of the Constitution, and the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023. The Commission itself carries the responsibility of conducting free and fair elections in the country.
  • The President appoints the Chief Election Commissioner and the Election Commissioners on the recommendation of a three member selection committee: the Prime Minister, the Leader of the Opposition and one member of the Union Cabinet.
  • The 2023 Act sets the qualification. An appointee must have held a secretary level post in the Government, and must be a person of integrity with knowledge of and experience in the management and conduct of elections.
  • The term is six years or until the age of 65, whichever comes first. The Chief Election Commissioner draws the same service conditions and monetary benefits as a justice of the Supreme Court.

The Removal Route: the Same Bar as a Supreme Court Judge

  • Article 324(5) says the Chief Election Commissioner may be removed from office only in like manner and on the like grounds as a Judge of the Supreme Court. The same formula is written again into Section 11(2) of the 2023 Act.
  • The bar is set high on purpose, so that the Commission is shielded from political pressure. Borrowing the judge's protection is how the Constitution gives an election authority security of tenure.
  • The process borrowed is the one in Article 124(4), under which a Supreme Court judge may be removed only on the ground of proved misbehaviour or incapacity.
  • Misbehaviour can take in any corrupt practice or abuse of office, and the courts have read it over the years to cover acts incompatible with the office and a failure to discharge official duties. Incapacity is the narrower idea of an officer being unable to perform the duties of the office.
  • The steps come from the Judges (Inquiry) Act, 1968. Members of both Houses must bring a notice of motion that explicitly alleges misbehaviour or incapacity; to be admitted it must be signed by at least 100 members in the Lok Sabha and 50 in the Rajya Sabha.
  • The presiding officer may consult persons and material before admitting or refusing the motion. Once a motion is admitted, an enquiry tests the validity of the charges, which means constituting a committee to investigate the evidence of misbehaviour or incapacity. The same process is extended to the removal of the Chief Election Commissioner.
  • The motion must then be carried in both Houses by a majority of two thirds of the members present and voting. Once it is, the President orders the removal, and no discretion is left at that stage, because the President acts here on the advice of Parliament.

The Other Commissioners, and the Attempt That Failed in April

  • The others are protected differently. Article 324(5) also says that any other Election Commissioner or a Regional Commissioner shall not be removed from office except on the recommendation of the Chief Election Commissioner, which makes their security of tenure depend on the head of their own body rather than on Parliament.
  • No Chief Election Commissioner has been removed. In April the Rajya Sabha Chairman and the Lok Sabha Speaker rejected the impeachment motions the Opposition had submitted in both Houses against Chief Election Commissioner Kumar. Neither presiding officer assigned any reason, and Opposition leaders criticised that.
  • Those motions had gone in on 12 March, with the Trinamool Congress leading the Opposition. 130 members signed the Lok Sabha motion and 63 the Rajya Sabha one.
  • Both motions rested on the Commission's ongoing Special Intensive Revision of the electoral rolls, alleging partisan and discriminatory conduct by the Chief Election Commissioner and obstruction of the investigation into electoral fraud and the revision. The investigation also found that the two Election Commissioners had raised concerns about the processes linked to that revision.

  • கடந்த சில மாதங்களாக ஆணையத்தின் முடிவுகள் மீதும் நடைமுறைகள் மீதும் தேர்தல் ஆணையர்கள் சுக்பீர் சிங் சாண்டு, விவேக் ஜோஷி அமைப்புக்குள்ளேயே எழுப்பிய குற்றச்சாட்டுக்களை அந்த ஆய்வு வெளிக்கொண்டு வந்தது.
  • ஆணையம் மூவர் கொண்ட அமைப்பாகச் செயல்படுகிறது. தலைமைத் தேர்தல் ஆணையர் சமமானவர்களில் முதன்மையானவர், மூத்த உறுப்பினர் அல்ல; முடிந்தவரை மூவரும் ஒருமனதாக முடிவெடுப்பதே வழக்கம்.

ஆணையத்தை நியமிப்பவர் யார், எந்த விதிகளில்

  • நியமனம், பதவிக்காலம், நீக்கம் ஆகியவற்றை இரண்டு ஆவணங்கள் தீர்மானிக்கின்றன: அரசியலமைப்பின் பிரிவு 324, மற்றும் தலைமைத் தேர்தல் ஆணையர் மற்றும் பிற தேர்தல் ஆணையர்கள் (நியமனம், பணி நிபந்தனைகள், பதவிக் காலம்) சட்டம், 2023. நாட்டில் சுதந்திரமான, நேர்மையான தேர்தல்களை நடத்தும் பொறுப்பு ஆணையத்தின் மீது உள்ளது.

  • தகுதியை 2023 சட்டம் வரையறுக்கிறது. நியமிக்கப்படுபவர் அரசில் செயலாளர் நிலைப் பணியிடத்தில் இருந்திருக்க வேண்டும்; தேர்தல் மேலாண்மையிலும் நடத்தும் முறையிலும் அறிவும் அனுபவமும் கொண்ட நேர்மையானவராக இருக்க வேண்டும்.
  • பதவிக் காலம் ஆறு ஆண்டுகள் அல்லது 65 வயது வரை, எது முதலில் வருகிறதோ அது. உச்ச நீதிமன்ற நீதிபதிக்கு உள்ள அதே பணி நிபந்தனைகளும் ஊதிய சலுகைகளும் தலைமைத் தேர்தல் ஆணையருக்கும் உண்டு.

நீக்கும் வழி: உச்ச நீதிமன்ற நீதிபதிக்கான அதே தடை

  • பிரிவு 324(5) படி, உச்ச நீதிமன்ற நீதிபதியை நீக்கும் அதே முறையில், அதே காரணங்களின் அடிப்படையில் மட்டுமே தலைமைத் தேர்தல் ஆணையரைப் பதவியிலிருந்து நீக்க முடியும். இதே வாக்கியம் 2023 சட்டத்தின் பிரிவு 11(2) இல் மீண்டும் எழுதப்பட்டுள்ளது.
  • ஆணையம் அரசியல் அழுத்தங்களிலிருந்து பாதுகாக்கப்பட வேண்டும் என்பதால் தடை வேண்டுமென்றே உயர்த்தி வைக்கப்பட்டுள்ளது. நீதிபதிக்குரிய அதே பாதுகாப்பை அளிப்பதன் வழியே தேர்தல் அதிகாரத்துக்கு பதவி பாதுகாப்பை அரசியலமைப்பு தருகிறது.
  • இங்கு பயன்படுத்தப்படும் நடைமுறை பிரிவு 124(4) இல் உள்ளது; அதன்படி உச்ச நீதிமன்ற நீதிபதியை நிரூபிக்கப்பட்ட தவறான நடத்தை அல்லது இயலாமை என்ற காரணத்தில் மட்டுமே நீக்க முடியும்.
  • தவறான நடத்தை என்பதில் ஊழல் நடவடிக்கைகளும் பதவி துஷ்பிரயோகமும் அடங்கும்; பதவிக்கு மாறான செயல்களையும் அலுவல் கடமைகளைச் செய்யத் தவறுவதையும் அதற்குள் அடக்கி ஆண்டுகளாக நீதிமன்றங்கள் விளக்கியுள்ளன. இயலாமை என்பது, பதவியின் கடமைகளைச் செய்ய இயலாத நிலை.
  • நடைமுறை நீதிபதிகள் (விசாரணை) சட்டம், 1968 இல் இருந்து வருகிறது. தவறான நடத்தை அல்லது இயலாமையைத் தெளிவாகச் சுட்டிக் காட்டும் தீர்மான அறிவிப்பை இரு அவை உறுப்பினர்களும் கொண்டுவர வேண்டும்; அது ஏற்கப்பட மக்களவையில் குறைந்தது 100 உறுப்பினர்கள் கையெழுத்தும், மாநிலங்களவையில் 50 பேர் கையெழுத்தும் தேவை.
  • தீர்மானத்தை ஏற்பதா, மறுப்பதா என்பதற்கு முன் அவைத் தலைவர் நபர்களையும் ஆவணங்களையும் கலந்தாலோசிக்கலாம். தீர்மானம் ஏற்கப்பட்டால், குற்றச்சாட்டுக்களின் செல்லுபடித்தன்மையைச் சோதிக்க விசாரணை நடக்கிறது; அதற்குச் சான்றுகளை ஆராய ஒரு குழு அமைக்கப்படுகிறது. இதே நடைமுறைதான் தலைமைத் தேர்தல் ஆணையரை நீக்குவதற்கும் நீட்டிக்கப்படுகிறது.
  • பிறகு அந்தத் தீர்மானம் இரு அவைகளிலும், வாக்களிக்கும் உறுப்பினர்களில் மூன்றில் இரண்டு பங்கு பெரும்பான்மையுடன் நிறைவேற வேண்டும். நிறைவேறியதும் குடியரசுத் தலைவர் நீக்க ஆணையிடுகிறார்; அந்தக் கட்டத்தில் அவருக்குச் சுயாதிகாரம் இல்லை, ஏனெனில் இங்கே நாடாளுமன்றத்தின் அறிவுறைப்படியே அவர் செயல்படுகிறார்.

மற்ற ஆணையர்கள், ஏப்ரலில் தோற்ற முயற்சி

  • மற்றவர்களின் பாதுகாப்பு வேறு வகை. மற்ற எந்தத் தேர்தல் ஆணையரையும் பிராந்திய ஆணையரையும் தலைமைத் தேர்தல் ஆணையரின் பரிந்துரையின் பேரில் அன்றி நீக்க முடியாது என்கிறது அதே பிரிவு; அவர்களது பதவிப் பாதுகாப்பு நாடாளுமன்றத்தின் கையில் அல்ல, தம் அமைப்பின் தலைவரின் கையில்.
  • இதுவரை எந்தத் தலைமைத் தேர்தல் ஆணையரும் நீக்கப்படவில்லை. கடந்த ஏப்ரலில், தலைமைத் தேர்தல் ஆணையர் குமாருக்கு எதிராக எதிர்க்கட்சிகள் இரு அவைகளிலும் தாக்கல் செய்த நீக்கத் தீர்மானங்களை மாநிலங்களவைத் தலைவரும் மக்களவைச் சபாநாயகரும் நிராகரித்தனர். இருவரும் எந்தக் காரணமும் கூறவில்லை என்பதை எதிர்க்கட்சித் தலைவர்கள் கண்டனித்தனர்.
  • அந்தத் தீர்மானங்கள் மார்ச் 12 அன்று தாக்கல் செய்யப்பட்டன; திரிணமூல் காங்கிரஸ் எதிர்க்கட்சிகளுக்குத் தலைமை தாங்கியது. மக்களவைத் தீர்மானத்தில் 130 உறுப்பினர்களும், மாநிலங்களவைத் தீர்மானத்தில் 63 பேரும் கையெழுத்திட்டனர்.
  • இரண்டு தீர்மானங்களும் ஆணையம் நடத்திவரும் வாக்காளர் பட்டியல்களின் சிறப்புத் தீவிர திருத்தத்தை முன்வைத்தன; தலைமைத் தேர்தல் ஆணையர் மீது ஒருதலைப்பட்ட, பாகுபாட்டான நடவடிக்கை என்றும், தேர்தல் மோசடி மற்றும் அந்தத் திருத்தம் குறித்த விசாரணைக்குத் தடை என்றும் குற்றம் சாட்டப்பட்டது. அந்தத் திருத்தம் சார்ந்த நடைமுறைகள் குறித்தே இரு தேர்தல் ஆணையர்களும் கவலை எழுப்பியதாகவும் அந்த ஆய்வு கண்டறிந்தது.
