The Right to Vote: Statutory, Constitutional or Fundamental, and Why Article 326 Matters

How India Arrived at Universal Adult Suffrage

  • Article 326 of the Constitution granted the right to vote to every adult citizen, regardless of gender, caste, religion, education or property. India began with universal adult suffrage instead of arriving at it in stages.
  • The contrast with the older democracies is the point of the provision. Reflecting the belief, argued by thinkers such as J.S. Mill, that the vote should be reserved for the enlightened, the United Kingdom first restricted the franchise to male property owners.
  • Universal male suffrage came to Britain only in 1918, and women were given the vote a decade later in 1928.
  • In the United States the 15th Amendment extended the vote to African Americans in 1870 and the 19th Amendment to women in 1920, yet poll taxes and literacy tests continued to keep many away for decades afterwards.
  • India's choice of immediate and universal inclusion secured democratic equality from the outset and bypassed the long and often violent struggles fought elsewhere for the same thing.
  • That commitment was reinforced by the courts. Kesavananda Bharati v. State of Kerala (1973) established democracy as part of the basic structure doctrine, so a democratic republic is not something an amendment can bargain away.
  • The promise was made to work through two statutes. The Representation of the People Act, 1950 governs the preparation and revision of electoral rolls, while the 1951 Act regulates the conduct of elections, candidature and electoral offences.
  • Administration had to catch up with the principle. The first Chief Election Commissioner, Sukumar Sen, faced with enrolling 173 million largely illiterate voters, introduced election symbols, turning a logistical obstacle into the device that made the vote usable.

Statutory, Constitutional or Fundamental: What the Courts Have Held

  • The classification is not a label. Whether the right to vote is statutory, constitutional or fundamental decides how easily it can be changed, how it is enforced and the level of legal protection it carries.
  • B.R. Ambedkar and K.T. Shah proposed placing it among the fundamental rights. The Constituent Assembly's Advisory Committee rejected the proposal, so the vote sits outside Part III of the Constitution.
  • A Constitution Bench of the Supreme Court in Kuldip Nayar v. Union of India (2006) held that the right to elect is a statutory right under Section 62 of the Representation of the People Act, 1951, and not a fundamental or a constitutional right.
  • A two judge Bench in Rajbala v. State of Haryana (2015) described the right to vote as a constitutional right, but the ruling of the larger Bench prevails, so that description does not displace Kuldip Nayar.
  • In Anoop Baranwal v. Union of India (2023) the Court declined to pronounce on the question at all, noting that the five judge Bench in Kuldip Nayar had already settled it.
  • In his dissent in that case Justice Ajay Rastogi held that the right to vote is an expression of Article 19(1)(a) and reflects the essence of Article 21. It remains a minority opinion, so the right to elect continues to be recognised as statutory.
  • Even so, the courts treat the vote as inseparable from democracy, reasoning that it is what lets a citizen shape governance, which makes it a democratic imperative rather than an ordinary statutory entitlement.

Why the Accuracy of the Roll Is the Real Test

  • Free and fair elections rest on an accurate roll prepared under the 1950 Act. Mass omissions, ineligible inclusions, duplicates and incorrect entries all undermine the principle of one person, one vote.
  • The damage takes three forms: impersonation where a name should not be there, disenfranchisement where a name is missing, and dilution of the value of a vote. Each of them distorts the mandate.
  • Section 21 of the 1950 Act empowers the Election Commission to prepare and revise the rolls, which is the statutory source of every revision exercise.
  • Section 19 sets who is entitled to be on the roll: a citizen aged 18 or above, ordinarily resident in the constituency and not otherwise disqualified.
  • The phrase ordinarily resident carries weight of its own. It implies a genuine and continuous presence, not a temporary stay, so the test is where a person actually lives rather than which address they hold.
  • Courts have consistently held that only substantial and systemic errors which demonstrably materially affected the outcome can compromise the sanctity of a roll. Minor mistakes or an isolated case of exclusion are not enough.
  • The Commission draws its authority from Article 324, which gives it the superintendence, direction and control of elections, and preparing an accurate roll is the first duty under that power.
  • How the Commission itself must work is set by the 2023 Act on the appointment, conditions of service and term of office of the Chief Election Commissioner and the other Election Commissioners. Section 17 requires its business to be conducted in accordance with the Act.
  • Section 18 provides that its procedure and allocation of business may be regulated by unanimous decision, that business is to be transacted unanimously as far as possible, and that where the Chief Election Commissioner and the others differ the matter is decided by majority.
  • The right to seek inclusion in or to object to a roll is conferred on the individual and not on any organisation. In Lakshmi Charan Sen v. A.K.M. Hassan Uzzaman (1985) the Court observed that in a largely illiterate and politically unaware electorate, others should help ensure that the eligible are included and the ineligible removed.

The Goa Deletions, and the Case for Elevating the Right

  • A published investigation reported that 97 eligible voters in Goa were dropped from the roll, not through fraud but because the architecture of the centralised ECINet software denied Electoral Registration Officers the authority to reverse an erroneous deletion.
  • What makes the episode serious is what followed. The officers reportedly flagged the anomalies to the Commission by email and the entries were still not restored, so this was a systemic failure written into the design, compounded by administrative inertia, and not the isolated clerical error the courts have historically forgiven.
  • The consequence reaches past the ballot. Several State schemes use the electoral roll to establish eligibility, among them the Goa Mediclaim Scheme, which is available only to voters of the State.
  • That scheme covers super speciality treatment not available in government hospitals, including dialysis, angioplasty, open heart surgery, transplants, chemotherapy and cochlear implants, so a deletion from the roll can also mean the loss of treatment.
  • The same investigation reported a rift inside the three member Commission, with two Election Commissioners recording 14 objections over 10 months against the Chief Election Commissioner over alleged unilateral changes to rules, voter additions and deletions and centralised data access without the full Commission's approval.
  • This is why the demand to raise the right to vote from a statutory guarantee to a fundamental one has fresh urgency. A statutory right is one that Parliament can dilute at will, which leaves the citizen with the Commission's own internal correction mechanism as the practical remedy.
  • Many scholars argue the right cannot be merely statutory because it flows from Article 326, so any law regulating it must conform to the parameters set by Articles 325 and 326, particularly since free and fair elections and democracy are basic features of the Constitution.
  • Justice Rastogi's dissent offers the doctrinal ground for a larger Bench to revisit the question the majority in Kuldip Nayar treated as settled.
  • Elevation would not take away the Commission's power to purify the rolls. It would subject that power to the heightened standard of judicial review reserved for fundamental rights, so that centralising electoral administration is weighed against the citizen's claim to be counted rather than allowed to override it.

  • கோவாவில் 97 தகுதியுள்ள வாக்காளர்கள் பட்டியலிலிருந்து நீக்கப்பட்டதாக ஒரு விசாரணை அறிக்கை தெரிவித்தது; மோசடியால் அல்ல, மையப்படுத்தப்பட்ட ஈசிஐநெட் மென்பொருளின் கட்டமைப்பே தவறான நீக்கத்தை மாற்றும் அதிகாரத்தை வாக்காளர் பதிவு அலுவலர்களுக்கு மறுத்ததால்.

  • வாக்குரிமையைச் சட்டப்பூர்வ உத்தரவாதத்திலிருந்து அடிப்படை உரிமையாக உயர்த்தக் கோரும் வாதத்துக்குப் புதிய அவசரம் வந்திருப்பது இதனாலேயே. சட்டப்பூர்வ உரிமையை நாடாளுமன்றம் விரும்பும்போது நீர்க்கச் செய்யலாம்; அப்போது குடிமகனுக்கு நடைமுறையில் மிஞ்சுவது ஆணையத்தின் உள்ளகத் திருத்த வழிமுறையே.
  • இவ்வுரிமை பிரிவு 326 இலிருந்து வருவதால் அது வெறும் சட்ட உரிமையாக இருக்க முடியாது என்று பல அறிஞர்கள் வாதிடுகின்றனர்; அதை ஒழுங்குபடுத்தும் எந்தச் சட்டமும் பிரிவுகள் 325, 326 வகுக்கும் அளவுகோல்களுக்கு இணங்க வேண்டும், குறிப்பாக சுதந்திரமான, நேர்மையான தேர்தலும் ஜனநாயகமும் அரசியலமைப்பின் அடிப்படை அம்சங்கள் என்பதால்.
  • குல்தீப் நய்யாரில் பெரும்பான்மை தீர்ந்துவிட்டதாகக் கருதிய கேள்வியை மறுபரிசீலனை செய்ய ஒரு பெரிய அமர்வுக்குக் கோட்பாட்டு அடிப்படையை ரஸ்தோகியின் மாறுபட்ட கருத்து தருகிறது.
  • உயர்த்துவது பட்டியலைத் தூய்மைப்படுத்தும் ஆணையத்தின் அதிகாரத்தைப் பறிக்காது. அடிப்படை உரிமைகளுக்கென ஒதுக்கப்பட்ட உயர்ந்த நீதிபரிசீலனைத் தரத்துக்கு அவ்வதிகாரத்தைக் கொண்டுவரும்; அப்போது தேர்தல் நிர்வாகத்தை மையப்படுத்தும் முயற்சி, எண்ணப்பட வேண்டும் என்ற குடிமகனின் உரிமையை மீறிச் செல்லாமல், அதற்கு எதிராக நிறுத்திச் சீர்தூக்கப்படும்.
