A Government Order dated 21 September 2026 exempted the Public (Law and Order) Department of Tamil Nadu from the ambit of the Right to Information Act, 2005, on the ground that it was an intelligence and security organisation.
The order was issued by the Human Resources Management Department under Section 24(4) of the Act and was then notified in the Government Gazette, which is the step the section itself requires.
The government decided on Sunday to withdraw the order after severe criticism, and the Minister for Energy Resources and Law, C.T.R. Nirmal Kumar, announced the withdrawal.
Earlier the same day, speaking in Madurai, the Minister had defended the order, saying that only certain matters, including the details of communal clashes, had been kept out of the Act's ambit given the sensitivity of the information.
The objection pressed against it was that the entire law and order section of a general administrative department could not be lifted out of the Act's reach in one stroke.
What Section 24 Actually Permits
Section 24 is the Act's institutional exemption. Unlike the exemptions in Section 8, which keep out particular kinds of information, Section 24 keeps out a named organisation as a whole, which is why it is the harder power to use.
Section 24(1) covers the Union. The Act does not apply to the intelligence and security organisations specified in the Second Schedule, nor to the information those bodies furnish to the government.
Section 24(4) is the counterpart for a State. It lets a State government exempt an intelligence or security organisation established by that government, and only by a notification in the Official Gazette.
The words limit the power. The body exempted has to be an intelligence or a security organisation, so the section does not offer a State a general route to place an ordinary department beyond the Act.
The exemption is not absolute even where it applies. The first proviso says information on allegations of corruption and human rights violation is not excluded, so those two categories survive the exemption.
The second proviso adds a procedure for the second category. Information sought on an allegation of a human rights violation is to be provided only after the approval of the State Information Commission, and within 45 days of the request.
An exemption under Section 24 therefore removes the ordinary route of a request under Section 6 and its disposal under Section 7, while leaving the corruption and human rights window open.
What the Public (Law and Order) Department Holds
The Department deals with communal and caste clashes, which is the subject the Minister named while defending the order.
It handles the appointment of Commissions of Inquiry into law and order matters and the follow up action taken on their recommendations.
It holds all matters relating to detentions under COFEPOSA, the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, and under the National Security Act, which are preventive detention laws under which a person is detained without trial.
That includes the representations made by detenus and the habeas corpus petitions filed by them or on their behalf in the High Court and the Supreme Court, the writ by which a court tests the legality of a detention.
It conducts the monthly law and order review meetings and the special law and order meetings held under the instructions of the Chief Secretary.
It examines the inquiry reports into the opening of fire by the police, and the inquiry reports into deaths in police custody, police torture and the deaths of remand prisoners.
It also deals with the sanction of prosecution for defamatory articles, news items and speeches, the permission without which such a prosecution cannot be launched.
Why the Exemption Was Contested
The overlap with the provisos is the heart of the objection. Deaths in custody, police torture and police firing are precisely the subjects that fall under allegations of human rights violation, which Section 24 expressly refuses to exclude.
An institutional exemption also sweeps in what a case by case exemption would not. Under Section 8 an authority has to justify withholding a particular file; under Section 24 it withholds everything and justifies nothing.
The classification itself was the weaker ground. A department that runs review meetings, appoints Commissions of Inquiry and sanctions prosecutions is performing general administration, which is not the same thing as an intelligence or a security organisation.
Preventive detention is the other reason the file matters. A person held under COFEPOSA or the National Security Act has not been convicted, and the record of the detention is often the only material from which its legality can be questioned.
There is a recent precedent for a withdrawal of this kind. A circular on collegiate education, issued after a law and order meeting chaired by Chief Secretary M. Sai Kumar, was withdrawn after the minutes of that meeting became public and drew opposition.
With the order rescinded, the Department returns to the ordinary position: a request under Section 6, a decision under Section 7, and refusal only where a specific clause of Section 8 applies to the specific information sought.

அச்சட்டத்தின் பிரிவு 24(4) இன் கீழ் மனிதவள மேலாண்மைத் துறை அந்த ஆணையைப் பிறப்பித்தது; பின்னர் அது அரசிதழில் அறிவிக்கப்பட்டது, அப்பிரிவே கோரும் நடைமுறை இதுவே.
கடும் விமர்சனத்துக்குப் பிறகு ஞாயிற்றுக்கிழமை அந்த ஆணையைத் திரும்பப் பெற அரசு முடிவு செய்தது; மின்சார வளம், சட்டத் துறை அமைச்சர் சி.டி.ஆர். நிர்மல் குமார் அதை அறிவித்தார்.
அதே நாளில் முன்னதாக மதுரையில் பேசிய அமைச்சர், தகவலின் நுட்பத்தன்மையைக் கருதி வகுப்பு மோதல்கள் குறித்த விவரங்கள் உள்ளிட்ட சில விஷயங்களே சட்டத்தின் எல்லையிலிருந்து விலக்கப்பட்டன என்று ஆணையை ஆதரித்திருந்தார்.
ஒரு பொது நிர்வாகத் துறையின் சட்டம் ஒழுங்குப் பிரிவு முழுவதையும் ஒரே அடியில் சட்டத்தின் எல்லைக்கு வெளியே கொண்டுசெல்ல முடியாது என்பதே அதற்கு எதிராக முன்வைக்கப்பட்ட ஆட்சேபனை.
பிரிவு 24 உண்மையில் அனுமதிப்பது என்ன
சட்டத்தின் நிறுவனம் சார்ந்த விலக்கு பிரிவு 24. குறிப்பிட்ட வகைத் தகவல்களை மட்டும் விலக்கும் பிரிவு 8 விலக்குகளைப் போலன்றி, பிரிவு 24 ஒரு முழு அமைப்பையே விலக்குகிறது; எனவே இதுவே கடினமான அதிகாரம்.
பிரிவு 24(1) ஒன்றியத்துக்கானது. இரண்டாவது அட்டவணையில் குறிப்பிடப்பட்ட உளவு, பாதுகாப்பு அமைப்புகளுக்கும், அவை அரசுக்கு அளிக்கும் தகவலுக்கும் இச்சட்டம் பொருந்தாது.
பிரிவு 24(4) மாநிலத்துக்கான இணையான விதி. அந்த அரசால் அமைக்கப்பட்ட உளவு அல்லது பாதுகாப்பு அமைப்பை மட்டும், அரசிதழில் வெளியிடும் அறிவிக்கை மூலம் மட்டுமே, மாநில அரசு விலக்க முடியும்.
இச்சொற்களே அதிகாரத்தை வரையறுக்கின்றன. விலக்கப்படும் அமைப்பு உளவு அல்லது பாதுகாப்பு அமைப்பாக இருக்க வேண்டும்; எனவே ஒரு சாதாரணத் துறையைச் சட்டத்துக்கு அப்பால் வைக்கும் பொது வழியை இப்பிரிவு மாநிலத்துக்குத் தரவில்லை.
பொருந்தும் இடத்திலும் அந்த விலக்கு முழுமையானது அல்ல. ஊழல், மனித உரிமை மீறல் குற்றச்சாட்டுகள் தொடர்பான தகவல் விலக்கப்படவில்லை என்று முதல் விதிவிலக்கு கூறுகிறது; அவ்விரு வகைகளும் விலக்கைத் தாண்டி நிற்கின்றன.
இரண்டாவது வகைக்கு ஒரு நடைமுறையை இரண்டாம் விதிவிலக்கு சேர்க்கிறது. மனித உரிமை மீறல் குற்றச்சாட்டு தொடர்பாகக் கோரப்படும் தகவல், மாநிலத் தகவல் ஆணையத்தின் ஒப்புதலுக்குப் பிறகே, கோரிக்கை வந்த 45 நாள்களுக்குள் வழங்கப்பட வேண்டும்.
எனவே பிரிவு 24 இன் கீழான விலக்கு, பிரிவு 6 இன் கீழ் கோரிக்கை வைத்து பிரிவு 7 இன் கீழ் அதைத் தீர்க்கும் வழக்கமான வழியை நீக்குகிறது; ஊழல், மனித உரிமைச் சாளரத்தை மட்டும் திறந்தே வைக்கிறது.
பொது (சட்டம் ஒழுங்கு) துறை வைத்திருப்பவை
வகுப்பு, சாதி மோதல்களை இத்துறை கையாள்கிறது; ஆணையை ஆதரிக்கும்போது அமைச்சர் குறிப்பிட்ட விஷயமும் இதுவே.
சட்டம் ஒழுங்கு விஷயங்களில் விசாரணை ஆணையங்களை நியமிப்பதையும், அவற்றின் பரிந்துரைகள் மீது எடுக்கப்படும் தொடர் நடவடிக்கையையும் இது கையாள்கிறது.
அயல் நாட்டு நாணயப் பாதுகாப்பு, கடத்தல் தடுப்புச் சட்டமான கோஃபெபோசா, தேசியப் பாதுகாப்புச் சட்டம் ஆகியவற்றின் கீழான காவல் தொடர்பான அனைத்து விஷயங்களும் இதனிடமே உள்ளன; இவை விசாரணையின்றி ஒருவரைக் காவலில் வைக்கும் முன்தடுப்புக் காவல் சட்டங்கள்.
காவலில் உள்ளோர் அளிக்கும் மனுக்களும், அவர்களாலோ அவர்கள் சார்பிலோ உயர்நீதிமன்றத்திலும் உச்ச நீதிமன்றத்திலும் தாக்கல் செய்யப்படும் ஆட்கொணர்வு மனுக்களும் இதில் அடங்கும்; காவலின் சட்டப்பூர்வத்தன்மையை நீதிமன்றம் சோதிக்கும் ஆணை இது.
தலைமைச் செயலாளரின் அறிவுறுத்தலின்படி நடத்தப்படும் மாதாந்திரச் சட்டம் ஒழுங்குப் பரிசீலனைக் கூட்டங்களையும், சிறப்புச் சட்டம் ஒழுங்குக் கூட்டங்களையும் இது நடத்துகிறது.
காவல் துறையின் துப்பாக்கிச் சூடு குறித்த விசாரணை அறிக்கைகளையும், காவலில் ஏற்படும் மரணங்கள், காவல் துறைச் சித்திரவதை, விசாரணைக் கைதிகளின் மரணங்கள் குறித்த விசாரணை அறிக்கைகளையும் இது பரிசீலிக்கிறது.
அவதூறுக் கட்டுரைகள், செய்திகள், உரைகளுக்காக வழக்குத் தொடர ஒப்புதல் அளிப்பதையும் இது கையாள்கிறது; அந்த ஒப்புதல் இன்றி அத்தகைய வழக்கைத் தொடங்க முடியாது.
விலக்கு ஏன் எதிர்க்கப்பட்டது
விதிவிலக்குகளுடனான ஒன்றுசேர்தலே ஆட்சேபனையின் மையம். காவலில் ஏற்படும் மரணங்கள், காவல் துறைச் சித்திரவதை, துப்பாக்கிச் சூடு ஆகியவை மனித உரிமை மீறல் குற்றச்சாட்டுகளின் கீழ் வரும் விஷயங்களே; அவற்றை விலக்க முடியாது என்று பிரிவு 24 வெளிப்படையாகவே மறுக்கிறது.
வழக்கு வாரியான விலக்கு பிடிக்காதவற்றையும் நிறுவன விலக்கு அள்ளிச் செல்கிறது. பிரிவு 8 இன் கீழ் ஒரு குறிப்பிட்ட கோப்பை மறுப்பதற்கு அதிகாரி காரணம் சொல்ல வேண்டும்; பிரிவு 24 இன் கீழ் அவர் அனைத்தையும் மறுக்கிறார், எதற்கும் காரணம் சொல்வதில்லை.
வகைப்பாடே பலவீனமான தளமாக இருந்தது. பரிசீலனைக் கூட்டங்களை நடத்தி, விசாரணை ஆணையங்களை நியமித்து, வழக்குத் தொடர ஒப்புதல் தரும் ஒரு துறை செய்வது பொது நிர்வாகம்; அது உளவு அல்லது பாதுகாப்பு அமைப்பு என்பதற்குச் சமமல்ல.
இக்கோப்புகள் முக்கியமாகக் காரணம் முன்தடுப்புக் காவல். கோஃபெபோசா அல்லது தேசியப் பாதுகாப்புச் சட்டத்தின் கீழ் காவலில் உள்ளவர் தண்டனை பெற்றவர் அல்ல; அக்காவலின் சட்டப்பூர்வத்தன்மையைக் கேள்வி கேட்கக்கூடிய ஒரே ஆவணமாகப் பெரும்பாலும் அப்பதிவே இருக்கிறது.

ஆணை ரத்து செய்யப்பட்டதால் துறை வழக்கமான நிலைக்கே திரும்புகிறது: பிரிவு 6 இன் கீழ் ஒரு கோரிக்கை, பிரிவு 7 இன் கீழ் ஒரு முடிவு, கோரப்பட்ட குறிப்பிட்ட தகவலுக்குப் பிரிவு 8 இன் ஒரு குறிப்பிட்ட உட்பிரிவு பொருந்தும்போது மட்டுமே மறுப்பு.
