What the Act Does, and the Two Tests It Applies

  • The Lindsey O. Graham Sanctioning Russia and Iran Act, 2026 has been signed into law by the President of the United States. It was proposed by the late Senator after whom it is named, and its original purpose was to cut off the financing of Russia's war with Ukraine.
  • The Act sanctions Russia's top leadership, its energy and defence sectors, and the shadow fleet of tankers used to move oil around Western sanctions. It also reaches Russia's biggest energy customers, which is the part that concerns India.
  • The words and Iran were added to the title later, and the text was amended so that sanctions on Iran run for a further five years, until 2031.
  • Thirty days after enactment, the Act allows a tariff of up to 100 per cent on goods originating in a country that meets either of two tests.
  • The first test is the one India is likely to meet. It covers a country that was among the five largest importers by total volume of crude oil or natural gas from Russia in the twelve months before the Act was passed, and that keeps importing after the thirty day window. China and India are the top two importers of Russian crude.
  • The second test covers a country among the top five facilitating evasion of sanctions on Russian oil in the same twelve months. India runs a much lower risk here, its oil marketing companies having repeatedly said that every purchase was made without violating sanctions.
  • The clock does not stop after the first imposition. Within 180 days of it, the United States Trade Representative, consulting the Secretary of State and the Secretary of Energy, must review afresh which five countries are the largest importers over the most recent twelve months.

Why the Tariff Stacks: Section 301 and Section 232

  • The Act says in terms that a tariff imposed under it shall be in addition to any other duty on the same good. That single clause is what turns a large number into a prohibitive one.
  • Section 301 of the Trade Act of 1974 lets the United States Trade Representative investigate a foreign trade practice said to harm American commerce and retaliate against it. Used to examine whether partners had done enough to stop the import of goods made with forced labour, it produced a tariff of 10 per cent on Indian goods.
  • Section 232 of the Trade Expansion Act of 1962 lets the President restrict imports or impose tariffs where an investigation finds that foreign goods threaten national security. It was widened to cover steel, aluminium and copper and their derivatives, at a rate of 50 per cent.
  • The Section 232 rate applies to every country alike, so it left India on a level playing field with its competitors. A tariff aimed at India alone does not, and that is the difference between a cost and a disadvantage.
  • A student should be able to separate the three instruments. Section 301 answers an unfair practice, Section 232 answers a security risk, and the new Act answers a third country's purchase from a sanctioned seller. Only the third is a secondary sanction.

Ten Years of Sanctions Read Through India's Import Basket

  • The pattern is consistent: when the United States applies pressure India reduces the purchase, and when the pressure eases India returns to it. The share of each seller in India's oil imports is therefore a political number as much as a commercial one.
  • Venezuela stood at 6.7 per cent of India's oil imports in 2017-18. After sanctions were widened to its oil sector in January 2019 the share fell to 1.1 per cent by 2020-21 and to zero by 2021-22. Once sanctions were partly lifted in March 2026 it returned to 4.8 per cent between April and July 2026.
  • Iran supplied about one tenth of India's oil before sanctions were reimposed in November 2018. The share fell to nil by 2020-21 and India bought no Iranian oil for six years. After limited sales were allowed again in March 2026 it reached 1.1 per cent in four months.
  • Russia held between 30 and 40 per cent of India's oil imports from July 2024 to July 2025. When a penal tariff took the rate from 25 per cent to 50 per cent in August 2025, the share fell to 19.3 per cent by February 2026.
  • In February 2026 the United States Supreme Court struck down that tariff regime and the penal tariff fell with it. India's purchases climbed again, and Russia's share passed 51 per cent in July 2026.
  • The climb coincided with the closure of the Strait of Hormuz and a sharp rise in global prices, which is the part of the story a bare tariff number leaves out.

The Two Eventualities, and the Two Ways Out

  • If India keeps buying and bears the tariff, the recent past is the guide. Merchandise exports to the United States grew nearly 18 per cent in April to August 2025, partly because exporters front loaded shipments in anticipation.
  • Over the longer April 2025 to February 2026 period, when the 50 per cent tariff was in force, the same exports grew only 3.8 per cent. Exporters had been sharing the cost of the tariff with their American customers to keep them, and at 100 per cent that sharing is not possible.
  • If India cuts back on Russian oil, the cost moves from the exporter to the consumer. With the Strait of Hormuz constrained and prices above 100 dollars a barrel, replacing that volume would be expensive, and a fuel price rise is politically difficult with State elections due next year.
  • The first way out is a waiver. The President may waive the tariff after submitting to Congress a written certification that the waiver is in the national interest of the United States, together with a report explaining the basis for it.
  • The second way out is not India's to take at all. The tariff falls away if Russia signs a peace agreement accepted by the Government of Ukraine and ends its military hostilities against it.
  • India's own position has been stated as strategic independence in sourcing energy: that energy sourcing is based on national interest, that India buys from diversified sources, and that the implications of the legislation for India's energy security and for the wider partnership have been conveyed at senior levels.

Update, September 21: Why This Tariff Is Heavier Than the Last One

  • The comparison worth holding on to is with the earlier escalation. The penal tariff that took the rate to 50 per cent in 2025 rested on an executive order, and what one order creates another order can rescind, which is in effect what happened when the court struck the regime down.
  • The new tariff rests on an Act of Congress. A legislature's word carries a higher order of legal permanence, undoing it needs the legislature again, and any waiver must be justified to Congress in writing. The same headline rate is therefore a heavier instrument.
  • The exposure is concentrated where the margin is thinnest. The United States takes about 20 per cent of India's goods exports, and the exporters who bore the last round by sharing the cost with American customers are largely micro, small and medium enterprises. Sharing a 100 per cent tariff is arithmetically out of reach for them.
  • Three courses are open, and only the third avoids a loss. India can cut Russian oil imports, or keep them and bear the tariff, or persuade the United States to use the phrase up to 100 per cent and set a low rate.
  • Replacement supply is the hard part of the first course. With the Strait of Hormuz constrained and prices above 100 dollars a barrel, India would have to press producers such as Oman to hasten alternative port capacity, and a fuel price rise at home is politically costly with State elections due.
  • The window is short. Thirty days must pass before the tariff can be levied, and the Union Commerce Minister's visit to the United States at the end of the month for the G-20 Trade Ministerial falls inside it.

Update, September 22: The Fine Print Is Still Being Read, While a Different Agreement Takes Effect

  • Asked about the United States legislation that imposes sanctions on countries buying Russian oil, the Commerce Minister said the fine print of the law was still being studied. No Indian response has been announced, and the refiners' purchase decisions have not been described as changed.
  • The wider answer India is giving is diversification of its trade rather than of its crude alone. The India-New Zealand free trade agreement has been ratified and takes effect on 20 October, and talks with Chile and Canada are being pushed, with the fifth round of the Canada negotiations set for 5 October.
  • A free trade agreement removes duty only between the two partners; it does not change what either charges the rest of the world. That is why a network of such agreements gives an exporter preferential access without answering a sanction aimed at a single import.
  • The Minister said global investors want to manufacture in India both for its own market and to export onward to the roughly two-thirds of the world economy with which India now has preferential market access.

Update, September 25: The Import Basket Turns Towards West Asia

  • India's crude oil imports from Russia averaged about 18 lakh barrels a day in September, against 28.2 lakh barrels a day in July and 20.8 lakh in August, according to data from a cargo tracking firm.
  • The shortfall has been made up from West Asia. Imports from Saudi Arabia, the United Arab Emirates and Iraq together rose over the same months, which is what a refiner does when one supplier becomes uncertain.
  • The trigger named is the American order imposing a duty of 100 per cent on countries importing Russian and Iranian crude. Analysts expect Russian volumes to fall further while that order is enforced.
  • The counterweight is price. If India cuts its Russian purchases sharply, competition among Asian and other refiners for alternative barrels rises, and that pushes the crude price up for every buyer including India.
  • Payments have not followed the oil. The rupee and the rouble now settle about 96 per cent of India-Russia bilateral trade, handled by 22 Russian banks and 17 Indian banks, a mechanism built precisely because sanctions work by cutting a country out of the messaging system banks use.

Update, October 10: Where the Tariff Power Sits, and a Potash Agreement With Belarus

  • A commentary in the day's paper sets out the constitutional objection to the tariff route. In the United States the power to levy taxes is given to Congress, and the Supreme Court there has held that the President cannot exercise that power without Congress's proper authorisation.
  • On that ground the "Liberation Day" tariffs announced on 2 April 2025, presented as protecting the American economy from foreign trade competition, were declared unlawful. The Act this article is about takes the other route, an Act of the legislature, which is why its tariff threat of up to 100 per cent does not face the same objection.
  • The measurable effect so far: even allowing for exemptions and policy changes, the average effective import tariff under the present administration has risen from about 2.4 per cent in 2024 to about 11 per cent.
  • The same commentary points to a transaction that sits oddly beside the sanctions. On 21 September 2026 the American President made a potash fertiliser agreement with Belarus, a close friend of Russia in eastern Europe. In the trade dispute with Canada, Canada's potash had so far been exempt from tariffs, and the Premier of Saskatchewan criticised the move.
  • Why potash matters to India: it is not oil or gas, but it supplies potassium, one of the three major plant nutrients alongside nitrogen and phosphorus, and it regulates water absorption, photosynthesis and enzyme activity in the plant. If large economies buy up the supply, the price rises hardest in countries that live by farming.
  • The trade backdrop the piece gives: India's goods exports rose 19 per cent and services exports 10 per cent; India and China traded 150 billion dollars worth in 2025-2026; and China is the largest trading partner of 151 countries against the United States' 57.

Update, October 11: A Diesel Deal That Runs Against the Act, and the Black Sea Cost to India

  • The American President announced that he had struck a deal with the Russian President, in a telephone call, for Russia to supply more than 300,000 tonnes of diesel immediately, a further 500,000 tonnes in November, one million tonnes immediately thereafter and an additional three million tonnes within a short period after that. The stated reason was high fuel prices ahead of the midterm elections.
  • The contradiction with this article's subject is direct. The sanctions law signed last month directs the administration to target countries that purchase Russian oil and gas, and the deal casts doubt on whether new sanctions on Russia will be imposed at all. The European Union's foreign policy chief said lifting sanctions on Russian diesel helps fuel the war on Ukraine; the Ukrainian President called it a weak decision by strong partners.
  • The Indian cost of the same war is being paid at sea. A government source said 32 merchant ships with Indian seafarers on board have been attacked in the Black Sea so far this year, carrying nearly 350 Indian seafarers; five have been killed, six injured and two are missing. The attacks now stretch from Sochi in the east to the Danube in the west, with drones straying into Romania and Moldova, and involve missiles, drones and unmanned surface vessels.
  • The two Indian stakes there are economic. Russia is now India's biggest source of crude oil, and Ukraine's sunflower oil processing and export capacity has been badly hit, from where India used to import more than three fourths of a billion dollars worth a year and is now replacing it with supply from other countries such as Russia. None of the 32 ships flew the Indian flag.
  • A Russia expert's reading is the one to carry: India had recently tried to mediate between Russia and Ukraine with a focus on getting both sides to stop attacking each other's shipping, but shipping has emerged as key leverage for belligerents across the world, so neither side is likely to stop.
