Section 17A of the Prevention of Corruption Act, 1988: Who Is the Competent Authority to Approve

What Section 17A Requires Before an Investigation Can Begin

  • Section 17A was inserted into the Prevention of Corruption Act, 1988 by the amendment of 2018. It bars a police officer from conducting any enquiry, inquiry or investigation into an offence under the Act without previous approval.
  • The bar is narrower than it first appears. It applies where the alleged offence relates to a recommendation made or a decision taken by a public servant in the discharge of official functions or duties, and not to everything a public servant does.
  • The purpose is to protect the decision, not the person. An officer who takes a lawful but unpopular decision should not be exposed to investigation merely because of the decision, and the approval is the filter placed before that stage.
  • There is an express exception. No approval is needed where a person is arrested on the spot on a charge of accepting or attempting to accept an undue advantage, which keeps a trap case outside the requirement.
  • The provision also sets a clock. The authority is to convey its decision within three months, extendable by a further one month for reasons recorded in writing, so that a request for approval cannot simply be left unanswered.
  • Read together with Section 19, which requires sanction before a court takes cognisance, the Act now has two gates: one before the investigation begins and one before the prosecution can be tried.

Who the Competent Authority Is

  • Section 17A names the authority by reference to who can remove the public servant. For a person employed in connection with the affairs of the Union and removable by or with the sanction of the Central Government, that Government approves.
  • For a person employed in connection with the affairs of a State and removable by or with the sanction of the State Government, that Government approves; and in any other case, the authority competent to remove the public servant from office.
  • That last clause is what makes the question live for a Minister. A Minister of a State is appointed by the Governor under Article 164 and holds office during the pleasure of the Governor, so the removing authority is not the State government.
  • The counter position is that a Minister is appointed on the advice of the Chief Minister and that the Governor acts on the aid and advice of the Council of Ministers under Article 163, which is why the identity of the competent authority is argued rather than obvious.
  • The consequence of getting it wrong is not a technicality. An approval given by an authority that is not competent is treated as non est, that is, as never having existed in law, and everything built on it is open to challenge.

The Case Before the Madras High Court

  • Former Tamil Nadu School Education Minister Anbil Mahesh Poyyamozhi has moved to quash a first information report registered against him by the Central Crime Branch police in Chennai in the fraud case involving over Rs. 100 crore.
  • His contention is that the approval under Section 17A came from the Public department by way of a government letter dated 23 June 2026, and that only the Governor was competent to give it, so the approval is non est and cannot sustain the report or the investigation that followed.
  • Justice V. Lakshminarayanan allowed an application to dispense with production of the original copy of the report, so that the Registry could number the main quash petition, which rests on several grounds including sanction. The petition was filed through counsel Richardson Wilson.
  • The corruption provisions came into the case later. The police filed an FIR alteration report before a metropolitan magistrate's court at Egmore on 9 September 2026, adding the provisions of the 1988 Act to a report that had not carried them.
  • That alteration report claimed that material collected during the investigation disclosed the petitioner's role in relation to certain demands, which is the material the approval question now attaches to.

The Other Grounds, and What a Quash Plea Actually Tests

  • A petition to quash a first information report does not decide guilt. The High Court exercises its inherent power and asks a narrower question: taking the report at its highest, does it disclose an offence, and is the process being used for its proper purpose.
  • The first ground raised is that the report discloses no specific act of dishonest or fraudulent conduct attributable to the petitioner personally, and is vague. Vagueness matters because a person cannot answer a charge that names no act.
  • The second is delay, of over four years from the date of the original complaint, described as inordinate and unexplained. Delay is a recognised ground because it can point to a purpose other than investigation.
  • The third is that the alteration report does not state that any illegal gratification was paid to him by any private school management for upgrading schools or obtaining permanent recognition, and speaks of no overt act by him.
  • His reading of the witness statements is that some persons allegedly collected money using his name, which, if that is all the material shows, goes to whether the offence is made out against him at all.
  • The fourth ground is mala fides, that the haste in registering the report after a change of government shows a biased investigation. An allegation of mala fides is a recognised ground for quashing, and it has to be established from the record rather than asserted.

  • 2018 ஆம் ஆண்டுத் திருத்தத்தால் ஊழல் தடுப்புச் சட்டம், 1988 இல் பிரிவு 17A சேர்க்கப்பட்டது. முன் ஒப்புதல் இன்றி, இச்சட்டத்தின் கீழான குற்றம் குறித்த எந்த ஆய்வையும் விசாரணையையும் நடத்துவதிலிருந்து காவல் அதிகாரியை அது தடுக்கிறது.
  • இத்தடை முதல் பார்வையில் தோன்றுவதைவிடக் குறுகியது. ஓர் அரசு ஊழியர் பணிக் கடமைகளைச் செய்யும்போது அளித்த பரிந்துரை அல்லது எடுத்த முடிவு தொடர்பான குற்றத்துக்கே இது பொருந்தும்; அரசு ஊழியர் செய்யும் எல்லாவற்றுக்கும் அல்ல.
  • நோக்கம் முடிவைப் பாதுகாப்பது, நபரை அல்ல. சட்டப்படியான ஆனால் விரும்பத்தகாத முடிவை எடுக்கும் அலுவலர், அம்முடிவுக்காக மட்டும் விசாரணைக்கு உள்ளாக்கப்படக் கூடாது; அந்தக் கட்டத்துக்கு முன் வைக்கப்பட்ட வடிகட்டியே இந்த ஒப்புதல்.
  • வெளிப்படையான விதிவிலக்கு ஒன்று உண்டு. முறையற்ற ஆதாயத்தைப் பெறும், அல்லது பெற முயலும் குற்றச்சாட்டில் ஒருவர் சம்பவ இடத்திலேயே கைது செய்யப்பட்டால் ஒப்புதல் தேவையில்லை; பொறி வழக்கை இது இக்கோரிக்கைக்கு வெளியே வைக்கிறது.
  • இப்பிரிவு ஒரு காலக்கெடுவையும் நிர்ணயிக்கிறது. அதிகாரி தன் முடிவை மூன்று மாதங்களுக்குள் தெரிவிக்க வேண்டும்; எழுத்தில் பதிவு செய்யப்பட்ட காரணங்களுக்காக மேலும் ஒரு மாதம் நீட்டிக்கலாம். ஒப்புதல் கோரிக்கையை பதிலின்றி விட்டுவிட முடியாது என்பதற்காக இது.
  • நீதிமன்றம் வழக்கை ஏற்பதற்கு முன் அனுமதி கோரும் பிரிவு 19 உடன் சேர்த்துப் படித்தால், இச்சட்டத்தில் இப்போது இரு வாயில்கள் உள்ளன: விசாரணை தொடங்கும் முன் ஒன்று, வழக்கு விசாரிக்கப்படும் முன் ஒன்று.

தகுதியான அதிகாரி யார்

  • அரசு ஊழியரை யார் பதவி நீக்க முடியும் என்பதைக் கொண்டே பிரிவு 17A அதிகாரியைப் பெயரிடுகிறது. ஒன்றியத்தின் விவகாரங்கள் தொடர்பாகப் பணியில் இருந்து, ஒன்றிய அரசால் அல்லது அதன் அனுமதியுடன் பதவி நீக்கப்படக்கூடியவருக்கு, அந்த அரசே ஒப்புதல் தரும்.
  • ஒரு மாநிலத்தின் விவகாரங்கள் தொடர்பாகப் பணியில் இருந்து, மாநில அரசால் அல்லது அதன் அனுமதியுடன் பதவி நீக்கப்படக்கூடியவருக்கு அந்த அரசு ஒப்புதல் தரும்; வேறு எந்த நிலையிலும், அவ்வூழியரைப் பதவி நீக்கத் தகுதியுள்ள அதிகாரி தருவார்.
  • ஓர் அமைச்சருக்கு இக்கேள்வியை உயிர்ப்புள்ளதாக்குவது அந்தக் கடைசி உட்பிரிவே. மாநில அமைச்சர் பிரிவு 164 இன் கீழ் ஆளுநரால் நியமிக்கப்படுகிறார்; ஆளுநரின் விருப்பம் உள்ளவரை பதவியில் இருக்கிறார். எனவே பதவி நீக்கும் அதிகாரி மாநில அரசு அல்ல.
  • எதிர் நிலைப்பாடு இதுவே: அமைச்சர் முதலமைச்சரின் ஆலோசனைப்படி நியமிக்கப்படுகிறார்; பிரிவு 163 இன் கீழ் அமைச்சரவையின் உதவியும் ஆலோசனையும் பெற்றே ஆளுநர் செயல்படுகிறார். தகுதியான அதிகாரி யார் என்பது தெளிவானதாக அல்லாமல் வாதத்துக்குரியதாக இருப்பதற்குக் காரணம் இதுவே.
  • இதைத் தவறாகச் செய்வதன் விளைவு வெறும் நடைமுறைக் குறை அல்ல. தகுதியற்ற அதிகாரி தந்த ஒப்புதல் செல்லாதது எனக் கருதப்படுகிறது, அதாவது சட்டப்படி ஒருபோதும் இருந்ததில்லை; அதன் மீது கட்டப்பட்ட அனைத்தும் எதிர்க்கத்தக்கவை ஆகின்றன.

சென்னை உயர்நீதிமன்றத்தில் உள்ள வழக்கு

  • முன்னாள் தமிழ்நாடு பள்ளிக் கல்வித் துறை அமைச்சர் அன்பில் மகேஷ் பொய்யாமொழி, ரூ. 100 கோடிக்கு மேலான மோசடி வழக்கில் சென்னை மத்தியக் குற்றப் பிரிவு காவல் துறை தமக்கு எதிராகப் பதிவு செய்த முதல் தகவல் அறிக்கையை ரத்து செய்யக் கோரியுள்ளார்.
  • பிரிவு 17A இன் கீழான ஒப்புதல், 2026 ஜூன் 23 தேதியிட்ட அரசுக் கடிதம் வழியாக பொதுத் துறையிடமிருந்து வந்தது என்பதும், அதைத் தர ஆளுநருக்கே தகுதி இருந்தது என்பதும் அவரது வாதம். எனவே அந்த ஒப்புதல் செல்லாதது, அறிக்கையையோ அதன் பின் நடந்த விசாரணையையோ அது தாங்காது என்கிறார்.
  • முதல் தகவல் அறிக்கையின் மூலப் படியை ஆஜர்படுத்தும் தேவையை விலக்கக் கோரிய மனுவை நீதிபதி வி. லட்சுமிநாராயணன் ஏற்றார்; அதன்மூலம் பதிவகம் முதன்மை ரத்து மனுவுக்கு எண் அளிக்க முடியும். ஒப்புதல் உள்பட பல காரணங்களை அம்மனு முன்வைக்கிறது; தாக்கல் செய்தவர் வழக்கறிஞர் ரிச்சர்ட்சன் வில்சன்.
  • ஊழல் தடுப்பு விதிகள் வழக்கில் பின்னரே சேர்ந்தன. 2026 செப்டம்பர் 9 அன்று எழும்பூர் பெருநகர நடுவர் நீதிமன்றத்தில் காவல் துறை அறிக்கைத் திருத்தப் பட்டியலைத் தாக்கல் செய்து, அவற்றைச் சுமக்காத அறிக்கையில் 1988 சட்ட விதிகளைச் சேர்த்தது.
  • விசாரணையின்போது சேகரிக்கப்பட்ட ஆதாரம், சில கோரிக்கைகள் தொடர்பாக மனுதாரரின் பங்கை வெளிப்படுத்துவதாக அந்தத் திருத்தப் பட்டியல் கூறியது; ஒப்புதல் குறித்த கேள்வி இப்போது இணைந்திருப்பது இந்த ஆதாரத்துடனே.

பிற காரணங்கள், ஒரு ரத்து மனு உண்மையில் சோதிப்பது

  • முதல் தகவல் அறிக்கையை ரத்து செய்யும் மனு குற்றத்தைத் தீர்மானிப்பதில்லை. உயர்நீதிமன்றம் தன் உள்ளார்ந்த அதிகாரத்தைப் பயன்படுத்தி ஒரு குறுகிய கேள்வியையே கேட்கிறது: அறிக்கையை அதன் உச்ச அளவில் எடுத்தாலும் அது ஒரு குற்றத்தை வெளிப்படுத்துகிறதா, இந்நடைமுறை அதன் உரிய நோக்கத்துக்கே பயன்படுத்தப்படுகிறதா.
  • முன்வைக்கப்பட்ட முதல் காரணம், மனுதாரர் மீது தனிப்பட்ட முறையில் சுமத்தக்கூடிய குறிப்பிட்ட செயல் எதையும் அறிக்கை வெளிப்படுத்தவில்லை, அது தெளிவற்றது என்பதே. தெளிவின்மை முக்கியம், ஏனெனில் எந்தச் செயலையும் பெயரிடாத குற்றச்சாட்டுக்கு ஒருவர் பதிலளிக்க முடியாது.
  • இரண்டாவது தாமதம்; மூல புகாரின் தேதியிலிருந்து நான்கு ஆண்டுகளுக்கு மேல், அளவுக்கு மீறியது, விளக்கமற்றது என்று விவரிக்கப்படுகிறது. விசாரணை அல்லாத வேறொரு நோக்கத்தை தாமதம் சுட்டக்கூடும் என்பதால் அது அங்கீகரிக்கப்பட்ட காரணம்.
  • மூன்றாவது, பள்ளிகளைத் தரம் உயர்த்தவோ நிரந்தர அங்கீகாரம் பெறவோ எந்தத் தனியார் பள்ளி நிர்வாகமும் அவருக்கு சட்டவிரோத ஆதாயம் தந்ததாகத் திருத்தப் பட்டியல் கூறவில்லை; அவரது வெளிப்படையான செயல் எதையும் அது பேசவில்லை.
  • சாட்சியங்களை அவர் படிக்கும் விதம் இது: சிலர் அவரது பெயரைப் பயன்படுத்திப் பணம் வசூலித்ததாகவே கூறப்படுகிறது. ஆதாரம் காட்டுவது அவ்வளவே எனில், அவருக்கு எதிராக அக்குற்றம் நிலைநாட்டப்படுகிறதா என்பதையே இது தொடுகிறது.
  • நான்காவது காரணம் தீய நோக்கம்; ஆட்சி மாற்றத்துக்குப் பின் அறிக்கையைப் பதிவு செய்த அவசரம் ஒரு சார்புள்ள விசாரணையைக் காட்டுகிறது என்பது. தீய நோக்கக் குற்றச்சாட்டு ரத்துக்கான அங்கீகரிக்கப்பட்ட காரணமே; ஆனால் அது வெறும் கூற்றாக அல்லாமல் பதிவுகளிலிருந்து நிறுவப்பட வேண்டும்.
