Supreme Court Strikes Down Maharashtra's Methanol Rules: Proportionality and Article 19(1)(g)

What the Supreme Court Held

  • On 18 September 2026 the Supreme Court struck down rules of the Maharashtra government that required methanol to be denatured with a colourant and a bitterant before it could be sold to a manufacturer who does not make drugs.
  • The Bench, which included Justices J.B. Pardiwala and K. Vinod Chandran, allowed the writ petitions filed by manufacturers of methanol based products against the compulsory additives, which had come in through amendments to the Maharashtra Poisons Rules, 1972.
  • The Court held the measures disproportionate and lacking a sufficient connection with the problem they set out to solve. The impugned provisions were declared unconstitutional, and the connected civil appeal was disposed of.
  • The Court recorded its reasoning in plain terms: the framework, it said, does not prevent the misuse of methanol in liquor because that misuse takes place in the unregulated field, and even on full compliance the sub-rule cannot prevent the misuse it aims at. It addresses a mischief it does not in fact remedy, while placing a continuous burden on the industries.
  • The Court also observed that a policy which is irrational, or lacks rational justification, or violates any constitutional, statutory or other provision of law is liable to be struck down.

The 1991 Tragedy and the Rules It Produced

  • Methanol, or methyl alcohol, is highly toxic to human beings. It is at the same time a widely used industrial raw material, going into formaldehyde, paraformaldehyde, paints, resins and other chemicals, so a rule about methanol touches legitimate industry as much as it touches illicit liquor.
  • Maharashtra tightened its controls after a hooch tragedy in Mumbai in 1991, in which around 93 people died after drinking spurious liquor that contained methanol. A committee headed by the then Additional Director General of Police, P.R. Parthasarthy, was set up to examine the causes and suggest measures.
  • In 2011 the State amended its Poisons Rules and inserted Rule 18A and Rule 18B. Rule 18A restricts the purchase of methanol and makes the addition of a bitterant and a colourant compulsory before a sale to a non-drug manufacturer. Rule 18B makes possession of methanol without a licence in Form A liable to confiscation.
  • The companies told the Court that contamination by colour can make a product unacceptable to the paint and pharmaceutical industries, and that the additives can interfere with catalysts and with laboratory and pharmaceutical applications. The burden, in other words, falls on users who were never the problem.
  • The State defended the rules on the ground that methanol can be mixed into liquor and cause fatal poisoning, and that making the chemical identifiable by sight and bitter to the tongue would help prevent that misuse.

The Constitutional Test: Articles 14, 19(1)(g) and Proportionality

  • The Court was clear that the State does have the power to regulate a poison. The Poisons Act, 1919 allows State governments to make rules regulating the possession and sale of poisons, so the question was never whether Maharashtra could act, but whether these particular rules were arbitrary, disproportionate and unreasonable.
  • The central question was whether Rules 18A and 18B violated Article 14 and Article 19(1)(g) of the Constitution. The basic tenet of Article 14 is fairness in action and the absence of arbitrariness. Article 19(1)(g) protects the right to practise any profession or to carry on any occupation, trade or business.
  • The Court applied the proportionality framework laid down in K.S. Puttaswamy v. Union of India (2017). Under it a restriction on a fundamental right must pursue a legitimate aim, must be suitable for achieving that aim, and must be necessary in the sense that no gentler measure would do.
  • Preventing the loss of life from methanol adulterated liquor was accepted as a legitimate aim. The rules failed at the next steps: the Court held the restrictions were neither suitable nor necessary to achieve that objective, and therefore violative of Articles 14 and 19(1)(g).
  • This is the practical lesson of the case for a student of polity. A good motive does not save a bad means. The State must be able to show that the measure it chose actually bites on the harm it names, and that a lighter measure would not have done the same work.

Rule by Rule, and What the Court Ordered Instead

  • Rule 18A(1), which required a purchaser's Form A licence to be verified before methanol could be sold, was held to impose a disproportionate restriction on legitimate industrial users. Verifying a licence, the Court said, establishes nothing about how the purchaser will actually use the methanol.
  • Rule 18A(2), the colourant and bitterant requirement, was struck down for want of a reasonable and proximate nexus with preventing the misuse of methanol in illicit liquor. The State could not demonstrate that the additives would stop diversion or the manufacture of spurious liquor.
  • Rule 18B, which provided for confiscation of methanol possessed without a Form A licence, was found capable of conflicting with lawful possession under a Form B permit and of rendering that permit redundant. It too failed the proportionality test.
  • Having struck the rules down, the Court did not leave the field empty. It issued guidelines to prevent hooch tragedies, asking States to work through the prohibition, excise, police, transport, industries and health departments together with non-governmental organisations, to check State borders, stop illegal transport, identify places where illicit liquor is made or stored, and monitor industrial units that may illegally supply the chemicals used in spurious liquor.
  • On the rules themselves, the Court said methanol regulation across States and Union Territories should be strengthened, not abandoned. Licences should be granted only after proper verification and reviewed regularly; industrial users should return unused or excess methanol and maintain proper stock and consumption records, on pain of suspension or cancellation; and methanol should move in dedicated tankers under excise supervision, sealed against theft, diversion and tampering.
  • The Court also called for more de-addiction centres, support for affected families and local counselling centres, and added the caution that it can issue directions but effective implementation finally rests with the police and the enforcement machinery.

  • 2026 செப்டம்பர் 18 அன்று, மருந்து தயாரிக்காத உற்பத்தியாளருக்கு விற்கும் முன் மெத்தனாலுடன் நிறமூட்டியும் கசப்பூட்டியும் கலக்க வேண்டும் என்று கோரிய மகாராஷ்டிர அரசின் விதிகளை உச்ச நீதிமன்றம் ரத்து செய்தது.
  • நீதிபதிகள் ஜே.பி. பரிடிவாலா, கே. வினோத் சந்திரன் ஆகியோர் இடம்பெற்ற அமர்வு, கட்டாயச் சேர்க்கைகளை எதிர்த்து மெத்தனால் சார்ந்த பொருள்களை உற்பத்தி செய்யும் நிறுவனங்கள் தொடுத்த ரிட் மனுக்களை ஏற்றது. இச்சேர்க்கைகள் 1972 மகாராஷ்டிர நஞ்சுகள் விதிகளுக்குச் செய்யப்பட்ட திருத்தங்கள் வழியே வந்தவை.
  • இந்நடவடிக்கைகள் விகிதாசாரமற்றவை என்றும், தாம் தீர்க்க முனைந்த பிரச்சினையுடன் போதிய தொடர்பு இல்லாதவை என்றும் நீதிமன்றம் கூறியது. வழக்குக்குரிய விதிகள் அரசியலமைப்புக்கு முரணானவை என அறிவிக்கப்பட்டன; தொடர்புடைய சிவில் மேல்முறையீடும் முடிவுக்குக் கொண்டுவரப்பட்டது.
  • நீதிமன்றம் தன் காரணத்தைத் தெளிவாகப் பதிவு செய்தது: மதுவில் மெத்தனால் தவறாகப் பயன்படுத்தப்படுவது ஒழுங்குபடுத்தப்படாத களத்தில் நடப்பதால், இவ்விதி அமைப்பு அதைத் தடுப்பதில்லை; முழுமையாகக் கடைப்பிடிக்கப்பட்டாலும் கூட, தான் இலக்கு வைத்த தவறான பயன்பாட்டை அவ்விதி தடுக்க முடியாது. உண்மையில் தான் நிவர்த்திக்காத ஒரு தீங்கை அது கையாள்கிறது; அதே வேளையில் தொழில்களுக்குத் தொடர்ச்சியான சுமையைச் சுமத்துகிறது.
  • பகுத்தறிவற்ற, நியாயமான நியாயப்பாடு இல்லாத, அல்லது அரசியலமைப்பு, சட்டம் அல்லது பிற சட்ட விதிகளை மீறும் ஒரு கொள்கை ரத்துக்கு உரியது என்றும் நீதிமன்றம் குறிப்பிட்டது.

1991 சோகமும், அதிலிருந்து பிறந்த விதிகளும்

  • 2011இல் மாநிலம் தன் நஞ்சுகள் விதிகளைத் திருத்தி விதி 18A, விதி 18B ஆகியவற்றைச் சேர்த்தது. விதி 18A மெத்தனால் கொள்முதலைக் கட்டுப்படுத்துகிறது; மருந்து அல்லாத உற்பத்தியாளருக்கு விற்கும் முன் கசப்பூட்டியையும் நிறமூட்டியையும் கலப்பதைக் கட்டாயமாக்குகிறது. A படிவ உரிமம் இன்றி மெத்தனால் வைத்திருப்பது பறிமுதலுக்கு உரியது என்கிறது விதி 18B.
  • நிறத்தால் ஏற்படும் மாசு ஒரு பொருளை வண்ணப்பூச்சு, மருந்துத் தொழில்களுக்கு ஏற்கத்தகாததாக ஆக்கிவிடும் என்றும், இச்சேர்க்கைகள் வினையூக்கிகளையும் ஆய்வக, மருந்துப் பயன்பாடுகளையும் பாதிக்கும் என்றும் நிறுவனங்கள் நீதிமன்றத்தில் தெரிவித்தன. அஃதாவது, ஒருபோதும் பிரச்சினையாக இல்லாத பயனாளர்கள் மீதே சுமை விழுகிறது.
  • மெத்தனாலை மதுவுடன் கலக்க முடியும், அது உயிரைப் பறிக்கும் நச்சாகும்; பார்வைக்கு அடையாளம் காணக்கூடியதாகவும் நாவுக்குக் கசப்பாகவும் ஆக்கினால் அத்தவறான பயன்பாட்டைத் தடுக்க உதவும் என்ற அடிப்படையில் மாநிலம் விதிகளை நியாயப்படுத்தியது.

அரசியலமைப்புச் சோதனை: பிரிவு 14, பிரிவு 19(1)(g), விகிதாசாரம்

  • ஒரு நஞ்சை ஒழுங்குபடுத்தும் அதிகாரம் மாநிலத்துக்கு உண்டு என்பதில் நீதிமன்றம் தெளிவாக இருந்தது. நஞ்சுகளை வைத்திருப்பதையும் விற்பதையும் ஒழுங்குபடுத்தும் விதிகளை இயற்ற மாநில அரசுகளுக்கு 1919 நஞ்சுகள் சட்டம் அனுமதிக்கிறது. எனவே மகாராஷ்டிரம் நடவடிக்கை எடுக்கலாமா என்பது கேள்வியே அல்ல; இக்குறிப்பிட்ட விதிகள் தன்னிச்சையானவையா, விகிதாசாரமற்றவையா, நியாயமற்றவையா என்பதே கேள்வி.
  • விதி 18A, விதி 18B ஆகியவை அரசியலமைப்பின் பிரிவு 14, பிரிவு 19(1)(g) ஆகியவற்றை மீறுகின்றனவா என்பதே மையக் கேள்வி. செயல்பாட்டில் நியாயமும் தன்னிச்சையின்மையுமே பிரிவு 14இன் அடிப்படை. எத்தொழிலையும் மேற்கொள்ளும், வணிகம் நடத்தும் உரிமையைப் பிரிவு 19(1)(g) பாதுகாக்கிறது.
  • கே.எஸ். புட்டசுவாமி எதிர் இந்திய அரசு (2017) வழக்கில் வகுக்கப்பட்ட விகிதாசார கட்டமைப்பை நீதிமன்றம் பயன்படுத்தியது. அதன்படி, ஓர் அடிப்படை உரிமையின் மீதான கட்டுப்பாடு நியாயமான நோக்கத்தை நாடியதாகவும், அந்நோக்கத்தை அடைய ஏற்றதாகவும், மென்மையான வேறு வழி இல்லை என்ற பொருளில் தேவையானதாகவும் இருக்க வேண்டும்.
  • மெத்தனால் கலந்த மதுவால் உயிர் இழப்பதைத் தடுப்பது நியாயமான நோக்கமாக ஏற்கப்பட்டது. அடுத்த படிகளிலேயே விதிகள் தோற்றன: அந்நோக்கத்தை அடைய இக்கட்டுப்பாடுகள் ஏற்றவையும் அல்ல, தேவையானவையும் அல்ல என்று நீதிமன்றம் கூறி, அவை பிரிவு 14, பிரிவு 19(1)(g) ஆகியவற்றை மீறுவதாகத் தீர்ப்பளித்தது.
  • அரசியலமைப்பைப் படிக்கும் மாணவருக்கு இவ்வழக்கின் நடைமுறைப் பாடம் இதுவே. நல்ல நோக்கம் ஒரு கெட்ட வழிமுறையைக் காப்பாற்றாது. தான் தேர்ந்தெடுத்த நடவடிக்கை, தான் சொல்லும் தீங்கின் மீது உண்மையில் விழுகிறது என்பதையும், இலகுவான ஒரு நடவடிக்கையால் அதே பணியைச் செய்திருக்க முடியாது என்பதையும் மாநிலம் நிரூபிக்க வேண்டும்.

விதி வாரியாக; நீதிமன்றம் அதற்குப் பதிலாக உத்தரவிட்டவை

  • மெத்தனாலை விற்கும் முன் வாங்குபவரின் A படிவ உரிமத்தைச் சரிபார்க்க வேண்டும் என்ற விதி 18A(1), சட்டப்படியான தொழில் பயனாளர்கள் மீது விகிதாசாரமற்ற கட்டுப்பாட்டைச் சுமத்துவதாகக் கருதப்பட்டது. உரிமத்தைச் சரிபார்ப்பது, வாங்குபவர் மெத்தனாலை உண்மையில் எவ்வாறு பயன்படுத்துவார் என்பதைப் பற்றி எதையும் நிறுவுவதில்லை என்று நீதிமன்றம் கூறியது.
  • நிறமூட்டி, கசப்பூட்டி கோரிக்கையான விதி 18A(2), கள்ளச்சாராயத்தில் மெத்தனால் தவறாகப் பயன்படுவதைத் தடுப்பதுடன் நியாயமான, நெருங்கிய தொடர்பு இல்லாததால் ரத்து செய்யப்பட்டது. இச்சேர்க்கைகள் திசைதிருப்பலையோ கள்ளச்சாராய உற்பத்தியையோ தடுக்கும் என்பதை மாநிலத்தால் நிரூபிக்க முடியவில்லை.
  • A படிவ உரிமம் இன்றி வைத்திருக்கும் மெத்தனாலைப் பறிமுதல் செய்ய வழிவகுத்த விதி 18B, B படிவ அனுமதியின் கீழ் சட்டப்படி வைத்திருப்பதோடு முரண்படக்கூடியது என்றும், அந்த அனுமதியையே பயனற்றதாக்கிவிடக்கூடியது என்றும் கண்டறியப்பட்டது. அதுவும் விகிதாசாரச் சோதனையில் தோற்றது.
  • விதிகளை ரத்து செய்துவிட்டு நீதிமன்றம் களத்தை வெறுமையாக விடவில்லை. கள்ளச்சாராயச் சோகங்களைத் தடுக்க வழிகாட்டுதல்களை அது வழங்கியது: மதுவிலக்கு, கலால், காவல், போக்குவரத்து, தொழில், சுகாதாரத் துறைகள் தன்னார்வ அமைப்புகளுடன் இணைந்து செயல்பட வேண்டும்; மாநில எல்லைகளைச் சோதிக்க வேண்டும்; சட்டவிரோதப் போக்குவரத்தை நிறுத்த வேண்டும்; கள்ளச்சாராயம் தயாரிக்கப்படும், சேமிக்கப்படும் இடங்களைக் கண்டறிய வேண்டும்; கள்ளச்சாராயத்துக்கான வேதிப்பொருள்களைச் சட்டவிரோதமாக வழங்கக்கூடிய தொழிற்சாலைகளைக் கண்காணிக்க வேண்டும்.
  • விதிகளைப் பொறுத்தவரை, மாநிலங்கள், யூனியன் பிரதேசங்கள் முழுவதும் மெத்தனால் ஒழுங்குமுறை கைவிடப்படாமல் வலுப்படுத்தப்பட வேண்டும் என்றது நீதிமன்றம். முறையான சரிபார்ப்புக்குப் பிறகே உரிமம் வழங்கப்பட வேண்டும், அது தவறாமல் மறுபரிசீலனை செய்யப்பட வேண்டும்; தொழில் பயனாளர்கள் பயன்படுத்தாத அல்லது உபரி மெத்தனாலைத் திருப்பி அளித்து, இருப்பு, நுகர்வுப் பதிவுகளைப் பேண வேண்டும், மீறினால் உரிமம் இடைநீக்கம் அல்லது ரத்து; மெத்தனால் கலால் மேற்பார்வையில் தனித் தொட்டி வண்டிகளில், திருட்டு, திசைதிருப்பல், சேதப்படுத்தல் தடுக்கும் வகையில் முத்திரையிட்டு கொண்டு செல்லப்பட வேண்டும்.
  • கூடுதல் போதைப் பழக்க நீக்க மையங்கள், பாதிக்கப்பட்ட குடும்பங்களுக்கு ஆதரவு, உள்ளூர் ஆலோசனை மையங்கள் ஆகியவற்றையும் நீதிமன்றம் கோரியது; தான் உத்தரவுகளை வழங்க முடியும், ஆனால் திறம்பட செயல்படுத்துவது இறுதியில் காவல்துறையையும் அமலாக்க இயந்திரத்தையும் சார்ந்தது என்ற எச்சரிக்கையையும் சேர்த்தது.
