The Leader of the Opposition has said that the High Level Committee on Union State Relations, headed by the retired Supreme Court judge Justice Kurian Joseph, is being prevented from functioning, and has asked that it be allowed to work without interruption.
The specific claim is a shortage of staff. Researchers and research scholars who were working on the Committee's second report on State autonomy were reported to be unable to continue, so the work stopped without any order being passed against the Committee.
The Committee was constituted during the previous M.K. Stalin led government and continues under the present Tamilaga Vettri Kazhagam led government, which is why its staffing has become a political question rather than an administrative one.
A committee of this kind cannot amend the Constitution and cannot compel the Union to do anything. What it can do is put a State's case on the record in a form that the Union, the Finance Commission and any future commission must answer, which is how a demand survives a change of government.
Its practical weakness is that it has no permanent cadre of its own. It borrows researchers and officers from the State government, so a decision about deputation, taken at the level of a file, can halt a constitutional study without anyone deciding to halt it.
Tamil Nadu's Older Demand: The Rajamannar Committee
Tamil Nadu did this once before, and first. In 1969 the State government appointed a committee on Centre State relations under Dr. P.V. Rajamannar, a former Chief Justice of the Madras High Court. It was the first committee of its kind appointed by any State in India.
Its other members were A. Lakshmanaswami Mudaliar and P. Chandra Reddy. The committee submitted its report in 1971.
Its central recommendations were that an Inter State Council be constituted at once, that Articles 356, 357 and 365 be deleted from the Constitution, and that certain subjects be moved from the Union List and the Concurrent List to the State List.
It also asked that residuary powers be vested in the States rather than in Parliament, that the Finance Commission be made a permanent body instead of one appointed every five years, and that the All India Services be abolished so that a State controlled its own administrative machinery.
The Tamil Nadu Legislative Assembly passed a resolution in 1974 accepting the report. The Union government did not act on it, and none of the constitutional amendments the report asked for was made.
The timing explains the content. The party that appointed the committee had come to power in 1967, after the anti Hindi agitation of 1965, on a platform in which State autonomy sat beside language, so the committee was the legal form of a political demand already in circulation.
What the Union Level Commissions Said
The Union's own examination came later. The Sarkaria Commission was appointed in June 1983 under Justice R.S. Sarkaria and submitted its report in 1988.
It did not favour a rewriting of the scheme. It treated the Constitution's federalism as workable and asked for better practice: that Article 356 be used only as a last resort and only after a warning, and that a Governor be a detached person from outside the State who has not been in active politics in the recent past.
Its largest structural recommendation was that an Inter State Council be constituted under Article 263. That is the one major recommendation that was acted on: the Council was established in 1990.
The Punchhi Commission was appointed in 2007 under Justice M.M. Punchhi and reported in 2010. It went further on the Governor's office, recommending a fixed term and removal only through a defined procedure rather than at pleasure, and it asked that President's rule be confined to the affected area and to the shortest necessary period.
The difference between those bodies and a State committee is the terms of reference. A Union appointed commission works to a brief the Union writes; a State that appoints its own committee writes the brief itself, which is the point of the exercise and also the reason its findings carry no binding force.
Where the Friction Actually Sits
The division of subjects is in the Seventh Schedule, read with Article 246: the Union List, the State List and the Concurrent List. Most disputes are not about the lists themselves but about what happens at their edges.
Article 248 places residuary powers with Parliament. Anything the Constitution did not foresee therefore belongs to the Union by default, which is the opposite of the American and Australian arrangement and is what the Rajamannar report wanted reversed.
Article 254 governs repugnancy. A State law on a Concurrent List subject that conflicts with a Union law is void to the extent of the conflict, unless the State law was reserved for and received the assent of the President, under Article 254(2).
Articles 200 and 201 are where much of the recent friction sits. A Governor may assent to a Bill, withhold assent, return it, or reserve it for the President, and the text of these Articles fixes no time limit for any of those choices.
Personnel and consultation are covered by Article 312, under which Parliament may create an All India Service if the Rajya Sabha so resolves, and by Article 263, under which the President may establish an Inter State Council to inquire into disputes and discuss common subjects.
Money is the other half of autonomy. The Finance Commission under Article 280 recommends the share of central taxes that goes to the States, and in the GST Council under Article 279A the Union holds one third of the weighted votes and the States together two thirds, while a decision needs three fourths of the votes cast.

தமிழ்நாட்டின் பழைய கோரிக்கை: ராஜமன்னார் குழு
தமிழ்நாடு இதை முன்பே செய்துள்ளது, முதலில் செய்ததும் அதுவே. 1969ல், சென்னை உயர் நீதிமன்றத்தின் முன்னாள் தலைமை நீதிபதி டாக்டர் பி.வி. ராஜமன்னார் தலைமையில் மத்திய மாநில உறவுகள் குறித்த குழுவை மாநில அரசு நியமித்தது. இந்தியாவில் எந்த மாநிலமும் நியமித்த இவ்வகையான முதல் குழு அதுவே.
அதன் பிற உறுப்பினர்கள் ஏ. லட்சுமணசாமி முதலியாரும்பி. சந்திர ரெட்டியும். குழு தன் அறிக்கையை 1971ல் சமர்ப்பித்தது.
மாநிலங்களுக்கு இடையிலான கவுன்சில் உடனடியாக அமைக்கப்பட வேண்டும், 356, 357, 365 பிரிவுகள் அரசமைப்பிலிருந்து நீக்கப்பட வேண்டும், ஒன்றியப் பட்டியலிலிருந்தும் பொதுப் பட்டியலிலிருந்தும் சில பொருள்கள் மாநிலப் பட்டியலுக்கு மாற்றப்பட வேண்டும் என்பனவே அதன் மையப் பரிந்துரைகள்.
நாடாளுமன்றத்திடம் அல்லாமல் மாநிலங்களிடம் எஞ்சிய அதிகாரங்கள் ஒப்படைக்கப்பட வேண்டும், ஐந்தாண்டுக்கு ஒருமுறை நியமிக்கப்படுவதற்குப் பதிலாக நிதி ஆணையம் நிரந்தர அமைப்பாக ஆக்கப்பட வேண்டும், ஒரு மாநிலம் தன் நிர்வாக அமைப்பைத் தானே கட்டுப்படுத்தும் வகையில் அகில இந்தியப் பணிகள் ஒழிக்கப்பட வேண்டும் எனவும் அது கோரியது.
அறிக்கையை ஏற்று 1974ல் தமிழ்நாடு சட்டப்பேரவை ஒரு தீர்மானத்தை நிறைவேற்றியது. ஒன்றிய அரசு அதன்மீது நடவடிக்கை எடுக்கவில்லை; அறிக்கை கோரிய அரசமைப்புத் திருத்தங்கள் எதுவும் செய்யப்படவில்லை.
காலமே உள்ளடக்கத்தை விளக்குகிறது. குழுவை நியமித்த கட்சி, 1965 இந்தி எதிர்ப்புப் போராட்டத்துக்குப் பிறகு 1967ல் ஆட்சிக்கு வந்தது; அதன் கொள்கைத் திட்டத்தில் மொழிக்கு அருகிலேயே மாநில சுயாட்சியும் இருந்தது. எனவே ஏற்கெனவே புழக்கத்தில் இருந்த ஓர் அரசியல் கோரிக்கையின் சட்ட வடிவமே அக்குழு.
ஒன்றிய அளவிலான ஆணையங்கள் சொன்னது
ஒன்றியத்தின் சொந்த ஆய்வு பின்னரே வந்தது. 1983 ஜூனில்நீதியரசர் ஆர்.எஸ். சர்க்காரியா தலைமையில் சர்க்காரியா ஆணையம் நியமிக்கப்பட்டு, 1988ல் அறிக்கையைச் சமர்ப்பித்தது.
திட்டத்தை மீண்டும் எழுதுவதை அது ஆதரிக்கவில்லை. அரசமைப்பின் கூட்டாட்சியைச் செயல்படக்கூடியதாகவே கருதி, சிறந்த நடைமுறையையே கோரியது: எச்சரிக்கைக்குப் பிறகு, இறுதி வழியாக மட்டுமே 356வது பிரிவு பயன்படுத்தப்பட வேண்டும்; மாநிலத்துக்கு வெளியிலிருந்து வரும், அண்மைக் காலத்தில் செயலூக்க அரசியலில் இல்லாத ஒரு நடுநிலையாளரே ஆளுநராக இருக்க வேண்டும்.
அதன் மிகப்பெரிய கட்டமைப்புப் பரிந்துரை, 263வது பிரிவின் கீழ் மாநிலங்களுக்கு இடையிலான கவுன்சில் அமைக்கப்பட வேண்டும் என்பதே. நடவடிக்கை எடுக்கப்பட்ட ஒரே முதன்மைப் பரிந்துரை அதுவே: 1990ல் அக்கவுன்சில் அமைக்கப்பட்டது.
2007ல் நீதியரசர் எம்.எம். புஞ்சி தலைமையில் புஞ்சி ஆணையம் நியமிக்கப்பட்டு 2010ல் அறிக்கை அளித்தது. ஆளுநர் பதவியில் அது மேலும் சென்றது: விருப்பப்படி நீக்குவதற்குப் பதிலாக நிலையான பதவிக்காலமும், வரையறுக்கப்பட்ட நடைமுறையின் வழியே மட்டுமே நீக்கமும் வேண்டும் எனப் பரிந்துரைத்தது; குடியரசுத் தலைவர் ஆட்சி பாதிக்கப்பட்ட பகுதிக்கும், தேவையான மிகக் குறைந்த காலத்துக்கும் மட்டுப்படுத்தப்பட வேண்டும் எனவும் கோரியது.
அவ்வமைப்புகளுக்கும் ஒரு மாநிலக் குழுவுக்கும் உள்ள வேறுபாடு, பணிக்கான விதிமுறைகளே. ஒன்றியம் நியமிக்கும் ஆணையம், ஒன்றியம் எழுதும் பணிக் குறிப்புக்கே உழைக்கிறது; தன் சொந்தக் குழுவை நியமிக்கும் மாநிலம் பணிக் குறிப்பைத் தானே எழுதுகிறது. அதுவே இப்பணியின் நோக்கம், அதன் கண்டறிதல்களுக்குக் கட்டுப்படுத்தும் ஆற்றல் இல்லாததற்கும் அதுவே காரணம்.
உராய்வு உண்மையில் அமைந்திருக்கும் இடம்
பொருள்களின் பிரிவினை ஏழாவது அட்டவணையில் உள்ளது, 246வது பிரிவுடன் சேர்த்து வாசிக்கப்படுகிறது: ஒன்றியப் பட்டியல், மாநிலப் பட்டியல், பொதுப் பட்டியல். பெரும்பாலான தகராறுகள் பட்டியல்களைக் குறித்தவை அல்ல, அவற்றின் ஓரங்களில் நிகழ்வதைக் குறித்தவையே.
248வது பிரிவுஎஞ்சிய அதிகாரங்களை நாடாளுமன்றத்திடம் வைக்கிறது. அரசமைப்பு முன்கூட்டி எதிர்பார்க்காத எதுவும் இயல்பாகவே ஒன்றியத்துக்கே உரியது; அமெரிக்க, ஆஸ்திரேலிய ஏற்பாட்டுக்கு இது நேர் எதிரானது, ராஜமன்னார் அறிக்கை மாற்றக் கோரியதும் இதையே.
முரண்பாட்டை 254வது பிரிவு ஆளுகிறது. பொதுப் பட்டியல் பொருள் ஒன்றில் ஒன்றியச் சட்டத்துடன் முரண்படும் மாநிலச் சட்டம், முரண்பாட்டின் அளவுக்குச் செல்லாததாகும்; 254(2) பிரிவின் கீழ் அம்மாநிலச் சட்டம் குடியரசுத் தலைவரின் ஒப்புதலுக்காக ஒதுக்கப்பட்டு ஒப்புதல் பெற்றிருந்தால் மட்டுமே விதிவிலக்கு.
அண்மைக்கால உராய்வில் பெரும்பகுதி 200, 201 பிரிவுகளிலேயே உள்ளது. ஓர் ஆளுநர் மசோதாவுக்கு ஒப்புதல் அளிக்கலாம், ஒப்புதலை மறுக்கலாம், திருப்பி அனுப்பலாம், குடியரசுத் தலைவருக்காக ஒதுக்கலாம்; இவற்றுள் எதற்கும் இப்பிரிவுகளின் உரை எந்தக் கால வரம்பையும் நிர்ணயிக்கவில்லை.
பணியாளர்களையும் கலந்தாலோசிப்பையும் 312வது பிரிவு உள்ளடக்குகிறது; மாநிலங்களவை தீர்மானித்தால் ஓர் அகில இந்தியப் பணியை நாடாளுமன்றம் உருவாக்கலாம். 263வது பிரிவின் கீழ், தகராறுகளை விசாரிக்கவும் பொதுப் பொருள்களை விவாதிக்கவும் மாநிலங்களுக்கு இடையிலான கவுன்சிலைக் குடியரசுத் தலைவர் அமைக்கலாம்.
சுயாட்சியின் மற்றொரு பாதி பணம். 280வது பிரிவின் கீழ் வரும் நிதி ஆணையம் மத்திய வரிகளில் மாநிலங்களுக்குச் செல்லும் பங்கைப் பரிந்துரைக்கிறது; 279ஏ பிரிவின் கீழ் வரும் ஜிஎஸ்டி கவுன்சிலில் எடையிடப்பட்ட வாக்குகளில் மூன்றில் ஒரு பங்கு ஒன்றியத்திடமும், மூன்றில் இரு பங்கு மாநிலங்களிடமும் உள்ளது; ஒரு முடிவுக்குப் பதிவான வாக்குகளில் நான்கில் மூன்று பங்கு தேவை.
