What Preventive Detention Is, and Where It Comes From

  • Preventive detention holds a person to stop an act the state fears they will commit. It is not a punishment for anything already done, so there is no charge, no trial and no conviction behind it.
  • The Constitution deals with it in Article 22. Clauses (1) and (2), which give an arrested person the right to be told the grounds, to consult a lawyer of choice and to be produced before a magistrate within 24 hours, are expressly withheld from a person held under a preventive detention law.
  • What replaces them is a separate set of safeguards. Under Article 22(4) no such detention may go beyond three months unless an Advisory Board of persons qualified to be High Court judges reports that there is sufficient cause for it.
  • Article 22(5) carries the two rights that decided this case: the authority must communicate the grounds of detention to the person as soon as may be, and must afford them the earliest opportunity of making a representation against the order.
  • Article 22(6) allows the authority to withhold facts it considers against the public interest to disclose, and Article 22(7) lets Parliament prescribe the circumstances in which a person may be detained beyond three months without an Advisory Board.
  • The Tamil Nadu statute is the Prevention of Dangerous Activities of Bootleggers, Drug Offenders, Goondas, Immoral Traffic Offenders and Slum-Grabbers Act, 1982, known in practice as the Goondas Act. Its title is also its scope: it names the classes of person against whom it may be used.

Public Order, and Why It Is Not the Same as Law and Order

  • The Act can be invoked only where the activity is prejudicial to the maintenance of public order. That phrase is a legal threshold, not a description, and it is the point on which most detentions are challenged.
  • The settled way to picture it is three concentric circles. Law and order is the widest, covering every breach of the peace; public order is a smaller circle within it; the security of the State is the smallest.
  • The test is not how serious the act was but how far its effect travelled. An act that disturbs only the persons immediately involved is a law and order matter; the same act becomes one of public order when it disturbs the even tempo of the life of the community.
  • That is why an ordinary offence, however grave, does not by itself justify preventive detention. The remedy for it is prosecution, and the detaining authority has to show separately why prosecution would not prevent the feared activity.
  • The order in this case was passed by the Greater Chennai Commissioner of Police on 11 July 2026, a detaining authority acting under the Act rather than a court passing a sentence.

The Case: A Complaint, an Arrest and Then a Detention

  • The detainee, B.T. Arasakumar, aged 59, was president of an unregistered body called the Tamil Nadu Private Schools Association, and was accused of collecting over Rs. 100 crore from private schools.
  • The complaint was lodged on 23 June with the Commissioner of Police by C. Elangovan, secretary of the Tamil Nadu Private Schools Federation, a different body representing private schools in the State.
  • According to the complaint the money was collected by promising services: obtaining approval for upgrading schools, gaining permanent recognition, securing building plan approval and the like, using proximity with the then ruling dispensation.
  • He was also accused of threatening the schools with dire consequences if they disclosed the transactions in public, which is the allegation that carried the complaint beyond a money dispute.
  • The sequence that followed is the one the courts examine. The police registered a first information report, arrested him, subjected him to custodial interrogation, and only then invoked the Goondas Act as well.
  • His wife's petition answered the association charge on the record: he had long tried to get the association registered and could not, because another association of the same name already existed.

Why the Order Fell: a Representation and a Writ

  • The detainee made a representation on 23 July asking for the detention order to be revoked. The order was quashed because that representation was not considered without delay.
  • The Bench of Justices N. Sathish Kumar and K. Rajasekar accepted the submission of senior counsel P. Wilson that such a representation must be considered without delay where an individual's personal liberty has been curtailed.
  • The principle behind that is simple. Since the detention rests on no trial, the representation is the detainee's only chance to be heard, so an unexplained delay in deciding it takes away the substance of the right in Article 22(5) even if the order itself was otherwise valid.
  • The remedy used was a writ of habeas corpus, filed by the detainee's wife. It is the writ by which a court requires the state to produce a person and justify the legality of holding them, and it may be moved by anyone on the detainee's behalf.
  • Her second ground went to the threshold itself: that none of the alleged acts had caused any threat to public order, and that the complaint arose from a civil dispute between office bearers of rival associations, which alone cannot support the Act.
  • The petition also placed the personal circumstances on record: that he had cooperated continuously with the investigation, suffers from severe neck and knee pain, diabetes and hypertension, and had already been in custody for a considerable period.
  • The wider point for an answer is what a quashing decides and what it does not. Setting aside a detention order says nothing about whether the allegations are true; the criminal case proceeds on its own, and only the detention without trial falls away.

  • அவற்றுக்குப் பதிலாக வருவது தனி வரிசைப் பாதுகாப்புகள். பிரிவு 22(4) இன் கீழ், உயர்நீதிமன்ற நீதிபதியாகத் தகுதி பெற்றவர்கள் அடங்கிய ஆலோசனை வாரியம் போதிய காரணம் உள்ளது எனத் தெரிவிக்காத வரை, அத்தகைய காவல் மூன்று மாதங்களைத் தாண்ட முடியாது.
  • இவ்வழக்கைத் தீர்மானித்த இரு உரிமைகளைச் சுமப்பது பிரிவு 22(5): காவலுக்கான காரணங்களை முடிந்தவரை விரைவில் அந்நபருக்குத் தெரிவிக்க வேண்டும்; ஆணைக்கு எதிராக மனு அளிக்கும் ஆகக் கூடிய விரைவான வாய்ப்பையும் தர வேண்டும்.
  • பொது நலனுக்கு எதிரானது எனக் கருதும் தகவல்களை வெளியிடாமல் இருக்க பிரிவு 22(6) அனுமதிக்கிறது; ஆலோசனை வாரியம் இன்றி மூன்று மாதங்களுக்கு மேல் ஒருவரைக் காவலில் வைக்கக்கூடிய சூழல்களை வகுக்க பிரிவு 22(7) நாடாளுமன்றத்துக்கு வழி தருகிறது.
  • தமிழ்நாட்டின் சட்டம் கள்ளச்சாராயம் விற்போர், போதைப்பொருள் குற்றவாளிகள், ரவுடிகள், ஒழுக்கக்கேடான கடத்தல் குற்றவாளிகள், குடிசைப் பகுதி அபகரிப்போர் ஆகியோரின் ஆபத்தான செயல்களைத் தடுக்கும் சட்டம், 1982; நடைமுறையில் ரவுடிகள் சட்டம் எனப்படுகிறது. அதன் தலைப்பே அதன் எல்லையும் ஆகும்: யாருக்கு எதிராக இதைப் பயன்படுத்தலாம் என்பதை அது பெயரிட்டுக் கூறுகிறது.

பொது ஒழுங்கு, அது சட்டம் ஒழுங்கிலிருந்து வேறுபடும் விதம்

  • இதை உருவகிக்கும் நிலைத்த வழி மூன்று பொது மையவட்டங்கள். சட்டம் ஒழுங்கு மிகப் பரந்தது, அமைதிக்கு ஏற்படும் ஒவ்வொரு பங்கத்தையும் உள்ளடக்கியது; அதற்குள் இருக்கும் சிறிய வட்டம் பொது ஒழுங்கு; மிகச் சிறியது அரசின் பாதுகாப்பு.
  • சோதனை, செயல் எவ்வளவு கடுமையானது என்பதல்ல, அதன் விளைவு எவ்வளவு தூரம் பரவியது என்பதே. நேரடியாகத் தொடர்புடையவர்களை மட்டும் பாதிக்கும் செயல் சட்டம் ஒழுங்கு விஷயம்; அதே செயல், சமூக வாழ்வின் சீரான ஓட்டத்தைக் குலைக்கும்போது பொது ஒழுங்கு விஷயமாகிறது.
  • எனவேதான் ஒரு சாதாரணக் குற்றம், எவ்வளவு கடுமையானதாக இருந்தாலும், தானாகவே முன்தடுப்புக் காவலை நியாயப்படுத்தாது. அதற்கான வழி வழக்குத் தொடுப்பதே; அஞ்சப்படும் செயலை வழக்குத் தொடுப்பது ஏன் தடுக்காது என்பதைக் காவல் ஆணை பிறப்பிப்பவர் தனியாகக் காட்ட வேண்டும்.
  • இவ்வழக்கில் ஆணையைப் பிறப்பித்தவர் பெருநகர சென்னை காவல் ஆணையர், நாள் 2026 ஜூலை 11; தண்டனை விதிக்கும் நீதிமன்றம் அல்ல, சட்டத்தின் கீழ் செயல்படும் காவல் ஆணை அதிகாரி அவர்.

வழக்கு: ஒரு புகார், ஒரு கைது, பின் ஒரு காவல்

  • காவலில் வைக்கப்பட்ட பி.டி. அரசகுமார், வயது 59, பதிவு செய்யப்படாத தமிழ்நாடு தனியார் பள்ளிகள் சங்கம் என்ற அமைப்பின் தலைவர்; தனியார் பள்ளிகளிடமிருந்து ரூ. 100 கோடிக்கு மேல் வசூலித்ததாகக் குற்றம் சாட்டப்பட்டவர்.
  • புகார் ஜூன் 23 அன்று காவல் ஆணையரிடம் அளிக்கப்பட்டது; அளித்தவர் தமிழ்நாடு தனியார் பள்ளிகள் கூட்டமைப்பின் செயலாளர் சி. இளங்கோவன், மாநிலத்தின் தனியார் பள்ளிகளைப் பிரதிநிதித்துவப்படுத்தும் வேறோர் அமைப்பு அது.
  • புகாரின்படி, சேவைகளை வாக்குறுதியாகக் காட்டிப் பணம் வசூலிக்கப்பட்டது: பள்ளிகளை தரம் உயர்த்த ஒப்புதல் பெறுவது, நிரந்தர அங்கீகாரம் பெறுவது, கட்டிடத் திட்ட ஒப்புதல் பெறுவது போன்றவை; அன்றைய ஆளும் தரப்புடனான நெருக்கத்தைப் பயன்படுத்தி இது நடந்ததாகக் கூறப்படுகிறது.

  • அதன் பிறகு நடந்த வரிசையையே நீதிமன்றங்கள் ஆராய்கின்றன. காவல் துறை முதல் தகவல் அறிக்கையைப் பதிவு செய்து, அவரைக் கைது செய்து, காவல் விசாரணைக்கு உட்படுத்தி, அதன் பிறகுதான் ரவுடிகள் சட்டத்தையும் பயன்படுத்தியது.
  • சங்கம் குறித்த குற்றச்சாட்டுக்கு அவரது மனைவியின் மனு பதிலளித்தது: சங்கத்தைப் பதிவு செய்ய அவர் நெடுங்காலம் முயன்றும் முடியவில்லை, ஏனெனில் அதே பெயரில் மற்றொரு சங்கம் ஏற்கெனவே இருந்தது.

ஆணை வீழ்ந்ததற்கான காரணம்: ஒரு மனுவும் ஓர் ஆணையும்

  • காவல் ஆணையை ரத்து செய்யக் கோரி ஜூலை 23 அன்று காவலில் இருந்தவர் ஒரு மனு அளித்தார். அந்த மனு தாமதமின்றிப் பரிசீலிக்கப்படாததாலேயே ஆணை ரத்து செய்யப்பட்டது.
  • ஒருவரின் தனிநபர் சுதந்திரம் தடைபட்டிருக்கும்போது அத்தகைய மனு தாமதமின்றிப் பரிசீலிக்கப்பட வேண்டும் என்ற மூத்த வழக்கறிஞர் பி. வில்சனின் வாதத்தை, நீதிபதிகள் என். சதீஷ் குமார், கே. ராஜசேகர் அடங்கிய அமர்வு ஏற்றது.
  • அதற்குப் பின்னால் உள்ள கொள்கை எளிமையானது. காவல் எந்த விசாரணையின் மீதும் நிற்காததால், தன் தரப்பைச் சொல்ல காவலில் உள்ளவருக்கு இருக்கும் ஒரே வாய்ப்பு அந்த மனுவே; எனவே அதை முடிவு செய்வதில் விளக்கமற்ற தாமதம், ஆணை வேறுவகையில் செல்லுபடியானதாக இருந்தாலும் பிரிவு 22(5) இல் உள்ள உரிமையின் சாரத்தையே பறித்துவிடுகிறது.
  • பயன்படுத்தப்பட்ட வழி ஆட்கொணர்வு ஆணை; அதைத் தாக்கல் செய்தவர் காவலில் இருந்தவரின் மனைவி. ஒருவரை முன்னிலைப்படுத்தி காவலின் சட்டப்பூர்வத் தன்மையை நியாயப்படுத்தும்படி அரசைக் கோரும் ஆணை இது; காவலில் உள்ளவர் சார்பாக யார் வேண்டுமானாலும் இதைத் தாக்கல் செய்யலாம்.
  • அவரது இரண்டாவது காரணம் வரம்பையே தொட்டது: கூறப்பட்ட செயல்கள் எதுவும் பொது ஒழுங்குக்கு எந்த அச்சுறுத்தலையும் தரவில்லை; புகார் போட்டி சங்கங்களின் பதவியாளர்களுக்கு இடையிலான சிவில் தகராறிலிருந்து எழுந்தது, அது மட்டும் இச்சட்டத்தைத் தாங்காது.
  • தனிப்பட்ட சூழல்களையும் மனு பதிவு செய்தது: அவர் விசாரணைக்குத் தொடர்ந்து ஒத்துழைத்து வந்தார்; கடுமையான கழுத்து, முழங்கால் வலி, நீரிழிவு, உயர் இரத்த அழுத்தம் ஆகியவற்றால் அவதிப்படுகிறார்; கணிசமான காலம் ஏற்கெனவே காவலில் இருந்துள்ளார்.
  • விடைக்கான பரந்த கருத்து, ஒரு ரத்து எதைத் தீர்மானிக்கிறது, எதைத் தீர்மானிக்கவில்லை என்பதே. காவல் ஆணையை ரத்து செய்வது, குற்றச்சாட்டுகள் உண்மையா என்பதைப் பற்றி எதுவும் சொல்வதில்லை; குற்றவியல் வழக்கு தனியே தொடரும், விசாரணை இன்றி வைக்கப்பட்ட காவல் மட்டுமே விலகுகிறது.
