The Tamil Nadu Private Universities (Amendment) Bill, 2026 was passed by the Legislative Assembly in the recent Budget session. It amends the parent law, the Tamil Nadu Private Universities Act, 2019.
The 2019 Act requires a minimum of 100 acres of contiguous land for the establishment of a private university anywhere in the State. The Bill replaces that single figure with three, graded by where the campus stands.
The new land requirement would be 12 acres inside the Greater Chennai Corporation area, 18 acres in other municipal corporations and municipal councils, and 25 acres in other areas.
The 2019 Act also requires the sponsoring body to establish a permanent endowment fund of at least Rs. 50 crore. The Bill proposes to reduce that to Rs. 25 crore.
Both changes lower the cost of entry. Nothing in the Bill changes what a private university must do once it exists; the amendment operates entirely at the door.
Why Entry Conditions Are the Regulation
A private university in India does not come into being by registration. It is created by a State Act, or in a few cases a Central Act, which means the legislature decides one by one who may open one and on what terms.
Because the State controls the moment of creation, the conditions attached to that moment carry most of the regulatory weight. Land and money are the two the 2019 Act chose.
Contiguous land means a single unbroken block rather than scattered plots added together. The requirement is what stops a campus being assembled out of separated parcels, and it is the reason the figure bites hardest in a city where land is dear.
An endowment fund is capital kept permanently, from which only the income may be spent. It is asked for because it tests staying power: a sponsor that can survive a bad year will not abandon a student halfway through a degree.
Lowering both figures therefore does two things at once. It opens the field to sponsors who could not previously enter, and it reduces the financial cushion behind every new institution.
Where the Bill Stands: The Governor and Article 200
Governor Rajendra Vishwanath Arlekar has sought clarifications from the State government on some provisions of the Bill, and has asked for a briefing before deciding. The Bill remains under his consideration.
This was clarified after reports that the Governor had reserved the Bill for the consideration of the President. Sources have said that has not happened; the Bill is neither assented to nor reserved, but pending.
Of the 13 Bills passed by the Assembly in the recent Budget session, the Governor has given assent to the other 12. This is the only one held back.
Under Article 200, a Bill passed by a State legislature and presented to the Governor admits of four courses: assent, withholding assent, return for reconsideration if it is not a Money Bill, and reservation for the consideration of the President. Amending the Bill is not among them.
If the House passes a returned Bill again, with or without amendment, the Governor is bound to assent. The power to return is a power to ask for a second look, not a power to refuse a law outright.
Under Article 201, a reserved Bill goes to the President, who may assent or withhold assent, and may direct that it be returned to the House. The legislature must then reconsider it within six months. No period is fixed for the President's own decision, which is why a reserved Bill can wait indefinitely.
Seeking clarifications is not one of the four courses. It is a step taken before the choice is made, and because Article 200 fixes no time limit for the Governor's decision either, the pause itself has become the point of contention in several States.
The Argument on Both Sides
Some Opposition parties have alleged that the Bill would lead to the commercialisation of education, on the reasoning that a smaller land and endowment requirement invites sponsors whose interest is the fee rather than the institution.
Minister for Higher Education P. Viswanathan has said the aim is to facilitate the establishment of world class private universities, on the reasoning that a 100 acre requirement keeps serious institutions out of the cities where students and industry actually are.
The disagreement is not really about acreage. It is about whether an entry condition is a filter for quality or a barrier to supply, and both readings fit the same numbers.
The question a student should be able to answer is narrower and more useful: which law creates a private university in Tamil Nadu, what the entry conditions are before and after the amendment, and what the Governor may and may not do with a Bill that has already passed the House.
மசோதா மாற்றுவது என்ன
2026 ஆம் ஆண்டு தமிழ்நாடு தனியார் பல்கலைக்கழகங்கள் (திருத்த) மசோதா சமீபத்திய நிதிநிலை அறிக்கைக் கூட்டத்தொடரில் சட்டப்பேரவையால் நிறைவேற்றப்பட்டது. அது தாய்ச் சட்டமான 2019 ஆம் ஆண்டு தமிழ்நாடு தனியார் பல்கலைக்கழகங்கள் சட்டத்தைத் திருத்துகிறது.
மாநிலத்தில் எங்கு தனியார் பல்கலைக்கழகம் நிறுவினாலும் குறைந்தபட்சம் 100 ஏக்கர் தொடர்ச்சியான நிலம் வேண்டும் என 2019 ஆம் ஆண்டுச் சட்டம் கோருகிறது. அந்த ஒற்றை எண்ணுக்குப் பதிலாக, வளாகம் எங்கு அமைகிறது என்பதைப் பொறுத்து மூன்று எண்களை மசோதா வைக்கிறது.
புதிய நில அளவு, பெருநகர சென்னை மாநகராட்சிப் பகுதிக்குள் 12 ஏக்கர்; பிற மாநகராட்சிகள், நகராட்சி மன்றங்களில் 18 ஏக்கர்; ஏனைய பகுதிகளில் 25 ஏக்கர்.
குறைந்தபட்சம் ரூ. 50 கோடி நிரந்தர நன்கொடை நிதியை ஆதரவு அமைப்பு நிறுவ வேண்டும் எனவும் 2019 ஆம் ஆண்டுச் சட்டம் கோருகிறது. அதை ரூ. 25 கோடியாகக் குறைக்க மசோதா முன்மொழிகிறது.
இரு மாற்றங்களுமே நுழைவுச் செலவைக் குறைக்கின்றன. ஒரு தனியார் பல்கலைக்கழகம் உருவான பிறகு அது என்ன செய்ய வேண்டும் என்பதை மசோதா மாற்றவில்லை; திருத்தம் முழுக்க முழுக்க நுழைவாயிலில் மட்டுமே இயங்குகிறது.
நுழைவு நிபந்தனைகளே ஏன் ஒழுங்குமுறை
இந்தியாவில் ஒரு தனியார் பல்கலைக்கழகம் பதிவு மூலம் உருவாவதில்லை. அது ஒரு மாநிலச் சட்டத்தால், சில சமயங்களில் ஒரு மத்தியச் சட்டத்தால் உருவாக்கப்படுகிறது; அதாவது யார், எந்த நிபந்தனைகளில் ஒன்றைத் தொடங்கலாம் என்பதைச் சட்டமன்றமே ஒவ்வொன்றாக முடிவு செய்கிறது.
உருவாக்கத்தின் தருணத்தை மாநிலம் கட்டுப்படுத்துவதால், அத்தருணத்துடன் இணைக்கப்படும் நிபந்தனைகளே ஒழுங்குமுறையின் பெரும் பாரத்தைச் சுமக்கின்றன. நிலமும் நிதியுமே 2019 ஆம் ஆண்டுச் சட்டம் தேர்ந்தெடுத்த இரண்டு.
தொடர்ச்சியான நிலம் என்றால், சேர்த்துக் கணக்கிடப்பட்ட சிதறிய துண்டுகள் அல்ல, உடையாத ஒற்றைத் துண்டு. பிரிந்த நிலங்களைக் கொண்டு ஒரு வளாகத்தைக் கட்டமைப்பதை இந்நிபந்தனையே தடுக்கிறது; நிலம் விலையுயர்ந்த நகரத்தில் அந்த எண் மிகக் கடுமையாகக் கடிப்பதற்குக் காரணமும் இதுவே.
நன்கொடை நிதி என்பது நிரந்தரமாக வைக்கப்படும் முதல்; அதன் வருமானத்தை மட்டுமே செலவிட முடியும். நிலைத்து நிற்கும் திறனைச் சோதிப்பதற்காகவே அது கோரப்படுகிறது: மோசமான ஓர் ஆண்டைத் தாண்டி நிற்கும் ஆதரவு அமைப்பு, படிப்பின் நடுவில் ஒரு மாணவரைக் கைவிடாது.
எனவே இரு எண்களையும் குறைப்பது ஒரே நேரத்தில் இரண்டைச் செய்கிறது. இதுவரை நுழைய முடியாத ஆதரவு அமைப்புகளுக்குக் களத்தைத் திறக்கிறது; அதே நேரத்தில் ஒவ்வொரு புதிய நிறுவனத்தின் பின்னால் உள்ள நிதித் தாங்குதலையும் குறைக்கிறது.
மசோதா இப்போது எங்கே: ஆளுநரும் விதி 200 உம்
மசோதாவின் சில விதிகள் குறித்து மாநில அரசிடம் ஆளுநர் ராஜேந்திர விஸ்வநாத் அர்லேக்கர் விளக்கம் கோரியுள்ளார்; முடிவெடுப்பதற்கு முன் ஒரு விளக்கக் கூட்டத்தையும் கேட்டுள்ளார். மசோதா அவரது பரிசீலனையிலேயே உள்ளது.
குடியரசுத் தலைவரின் பரிசீலனைக்காக ஆளுநர் மசோதாவை ஒதுக்கிவைத்துவிட்டார் என்ற செய்திகளுக்குப் பிறகே இது தெளிவுபடுத்தப்பட்டது. அப்படி நடக்கவில்லை என வட்டாரங்கள் கூறியுள்ளன; மசோதாவுக்கு ஒப்புதலும் அளிக்கப்படவில்லை, அது ஒதுக்கியும் வைக்கப்படவில்லை, நிலுவையில் உள்ளது.
சமீபத்திய நிதிநிலை அறிக்கைக் கூட்டத்தொடரில் சட்டப்பேரவை நிறைவேற்றிய 13 மசோதாக்களில் மற்ற 12 க்கும் ஆளுநர் ஒப்புதல் அளித்துள்ளார். நிறுத்தி வைக்கப்பட்டது இது ஒன்றே.
விதி 200 இன்படி, மாநிலச் சட்டமன்றம் நிறைவேற்றி ஆளுநரிடம் சமர்ப்பிக்கப்படும் மசோதாவுக்கு நான்கு வழிகள் உண்டு: ஒப்புதல் அளிப்பது, ஒப்புதலை நிறுத்திவைப்பது, பணமசோதா அல்லாவிட்டால் மறுபரிசீலனைக்குத் திருப்பி அனுப்புவது, குடியரசுத் தலைவரின் பரிசீலனைக்காக ஒதுக்கிவைப்பது. மசோதாவைத் திருத்துவது அவற்றுள் இல்லை.
திருப்பி அனுப்பப்பட்ட மசோதாவை, திருத்தத்துடனோ திருத்தமின்றியோ, சட்டமன்றம் மீண்டும் நிறைவேற்றினால் ஆளுநர் ஒப்புதல் அளித்தே ஆக வேண்டும். திருப்பி அனுப்பும் அதிகாரம் மறுபரிசீலனை கோரும் அதிகாரமே தவிர, ஒரு சட்டத்தையே மறுக்கும் அதிகாரம் அல்ல.
விதி 201 இன்படி, ஒதுக்கிவைக்கப்பட்ட மசோதா குடியரசுத் தலைவரிடம் செல்கிறது; அவர் ஒப்புதல் அளிக்கலாம் அல்லது நிறுத்திவைக்கலாம், சட்டமன்றத்திற்குத் திருப்பி அனுப்புமாறு அறிவுறுத்தலாம். அப்போது ஆறு மாதங்களுக்குள் சட்டமன்றம் அதை மறுபரிசீலனை செய்ய வேண்டும். குடியரசுத் தலைவரின் முடிவுக்குக் காலவரம்பு இல்லை; ஒதுக்கிவைக்கப்பட்ட மசோதா முடிவின்றிக் காத்திருக்க முடிவதற்குக் காரணம் இதுவே.
விளக்கம் கோருவது அந்த நான்கு வழிகளுள் ஒன்று அல்ல. முடிவெடுப்பதற்கு முன் எடுக்கப்படும் ஒரு நடவடிக்கை அது; ஆளுநரின் முடிவுக்கும் விதி 200 காலவரம்பு எதுவும் நிர்ணயிக்காததால், அந்த இடைநிறுத்தமே பல மாநிலங்களில் தகராறுக்குரிய புள்ளியாகிவிட்டது.
இரு தரப்பின் வாதம்
நில, நன்கொடை நிபந்தனைகளைக் குறைப்பது, நிறுவனத்தில் அல்ல கட்டணத்தில் ஆர்வம் கொண்ட ஆதரவு அமைப்புகளை அழைக்கும் என்ற காரணத்தை முன்வைத்து, இம்மசோதா கல்வியை வணிகமயமாக்கும் என்று சில எதிர்க்கட்சிகள் குற்றம்சாட்டியுள்ளன.
100 ஏக்கர் நிபந்தனை, மாணவர்களும் தொழில்துறையும் உண்மையில் இருக்கும் நகரங்களிலிருந்து தரமான நிறுவனங்களை வெளியே வைத்துவிடுகிறது என்ற காரணத்தை முன்வைத்து, உலகத் தரம் வாய்ந்த தனியார் பல்கலைக்கழகங்களை நிறுவ வழிவகுப்பதே நோக்கம் என உயர்கல்வி அமைச்சர் பொ. விஸ்வநாதன் கூறியுள்ளார்.
கருத்து வேறுபாடு உண்மையில் ஏக்கர் பற்றியது அல்ல. நுழைவு நிபந்தனை என்பது தரத்திற்கான வடிகட்டியா, அல்லது வழங்கலுக்கான தடையா என்பதே கேள்வி; அதே எண்களுக்கு இரு விளக்கங்களும் பொருந்துகின்றன.
ஒரு மாணவர் பதிலளிக்கத் தெரிந்திருக்க வேண்டியது இன்னும் குறுகியதும் பயனுள்ளதும் ஆனது: தமிழ்நாட்டில் ஒரு தனியார் பல்கலைக்கழகத்தை உருவாக்கும் சட்டம் எது, திருத்தத்திற்கு முன்னும் பின்னும் நுழைவு நிபந்தனைகள் என்ன, சட்டப்பேரவையை ஏற்கெனவே கடந்த மசோதாவை ஆளுநர் என்ன செய்யலாம், என்ன செய்ய முடியாது.
