What the Assembly Passed

  • On 25 September 2026, Jammu and Kashmir Chief Minister Omar Abdullah introduced a resolution before the autumn session of the Assembly, calling on the Government of India for the immediate and urgent restoration of full Statehood to the region.
  • The resolution was put to vote on 28 September and was carried, with 61 of the 90 members supporting it.
  • Support came from the ruling National Conference, the Congress, the Communist Party of India (Marxist), the Peoples Democratic Party, the Jammu and Kashmir People's Conference, the Aam Aadmi Party and the Awami Ittehad Party.
  • The Chief Minister argued that the resolution was made necessary by the Centre's inexplicable delay in granting Statehood, which was downgraded in 2019 after Parliament diluted the region's autonomous status under Article 370.
  • After the vote he called on the Government of India to fulfil its commitment towards the restoration of Statehood, and cautioned the Centre against linking that restoration to the complete cessation of militancy, which he said would in effect let Pakistan decide when Statehood is restored.
  • He underlined that the decision on Statehood must be taken in New Delhi and should not be made contingent on any other factor or external consideration.

Why the Wording Caused a Row

  • The Bharatiya Janata Party took exception not to the demand but to the wording. The resolution described itself as being in addition to the resolutions this House passed on 26 June 2000 and 6 November 2024, that is, the autonomy resolution and the special status resolution.
  • Its legislators raised a hue and cry, stormed into the well of the House and staged walkouts. The Leader of the Opposition, Sunil Sharma, called the references to the 2000 and 2024 resolutions unnecessary and asked the ruling party to bring a resolution confined exclusively to Statehood.
  • He said Jammu and Kashmir was a sensitive region with neighbours always looking to take advantage of internal issues and disturb the peace, and that there was no room for any Pakistan agenda in a region which is an integral part of India.
  • The party also moved a motion seeking the removal of the Speaker, Abdul Rahim Rather, for allowing the resolution to be taken up.
  • The Chief Minister clarified in the House that the resolution was confined to the restoration of Statehood, and he stalled an attempt by eight legislators of his own party to amend it so as to bring in Article 370, Article 35A and the position before 5 August 2019.
  • His reasoning was tactical: those words would have given the Opposition an excuse not to take part in the voting and would have stalled a unanimous resolution on Statehood.

The 2000 Autonomy Resolution

  • In the 1990s, at the peak of militancy, the National Conference leader and then Chief Minister Farooq Abdullah was forced to step down and leave Kashmir. He returned to power in 1996.
  • He then set up a State Autonomy Committee to examine how the region's autonomy had been steadily eroded since 1953, the year in which his father, the then Prime Minister of Jammu and Kashmir, Sheikh Mohammad Abdullah, was dismissed from office and arrested by the Central government.
  • The committee was part of the party's attempt to offer a constitutional alternative to separatist groups demanding either complete independence for Kashmir or its merger with Pakistan.
  • On 26 June 2000, Farooq Abdullah as Chief Minister tabled the resolution to restore the pre 1953 autonomy status of the region, and the State Assembly passed it unanimously.
  • It envisaged a far narrower Union jurisdiction, with defence, foreign affairs and communications among the principal subjects left with New Delhi.
  • It asked that the Governor be redesignated Sadr-e-Riyasat, or Head of State, and the Chief Minister Wazir-e-Azam, or Prime Minister.
  • It proposed replacing the word temporary in Article 370 with the word special, a change of one word that went to how lasting that Article was meant to be.
  • It further sought a bar on the use of Article 356 to impose President's Rule in the region, a separate Election Commission and a separate Comptroller and Auditor General, and the rescinding of every constitutional order issued after 1954.
  • The resolution was sent to Parliament, and the then Prime Minister Atal Bihari Vajpayee rejected it. The Union Cabinet described the recommendations as unacceptable and an attempt to set the clock back.
  • Why it has come back now is a question of politics inside the Constitution. After the region was downgraded to a Union Territory in 2019, the mainstream parties in Kashmir have again been offering an alternative within the Constitution to alienated sections, to protect land, jobs and identity, and the 2000 and 2024 resolutions are how the ruling party addresses all its political constituencies at once.

The Rift with the Bureaucracy

  • The Chief Minister told the Assembly that a day after he moved the resolution, the Chief Secretary, Atal Dulloo, and the Law Secretary, Achal Sethi, wrote separately to the Speaker advising against allowing it.
  • The reason the letters gave was that the matter was sub judice, that is, pending before a court and therefore not fit to be discussed. The Chief Minister said he was not shown the letters.
  • He asked which State in the country would see its Law Secretary and Chief Secretary oppose a resolution moved by the Chief Minister, and answered his own question: it happens because of the Union Territory status, which is itself the argument for restoring Statehood.
  • The episode opened a debate on the powers of a legislature in a Union Territory. A Congress legislator, Nizamuddin Bhat, demanded that the letters be made part of the Assembly records, called the officers' action a challenge to the prestige, dignity and powers of the Assembly, and asked whether officers could act as a government.
  • He argued that the Assembly is governed by the same rules as a State legislature, and that neither the Constitution nor the Jammu and Kashmir Reorganisation Act provides otherwise.
  • A Peoples Democratic Party legislator, Waheed-ur-Rehman Parra, has initiated a breach of privilege motion against the two officials.

Update, October 5: The Reply from the Other Side

  • Speaking at Srinagar on 4 October, the former State president of the Bharatiya Janata Party, Ravinder Raina, said his party too is firm that Statehood should be restored, but that certain important responsibilities to be discharged in the region rest with the Union government and Statehood will be granted once they are fulfilled.
  • He was replying to the All India Congress general secretary and Assembly member G.A. Mir, who had charged that the Union government is delaying the restoration of Statehood and is not governing the people of the region as it governs people elsewhere in the country.

சொற்களமைப்பு சர்ச்சையை உருவாக்கியது ஏன்

  • கோரிக்கையை அன்றி, சொற்களமைப்பையே பாரதிய ஜனதா கட்சி ஆட்சேபித்தது. இச்சபை 2000 ஜூன் 26 அன்றும் 2024 நவம்பர் 6 அன்றும் நிறைவேற்றிய தீர்மானங்களுக்குக் கூடுதலானது என இத்தீர்மானம் தன்னை விவரித்தது; அதாவது தன்னாட்சித் தீர்மானமும் சிறப்பு அந்தஸ்துத் தீர்மானமும்.
  • அக்கட்சியின் சட்டமன்ற உறுப்பினர்கள் கூச்சலிட்டு, சபையின் நடுவாந்தரத்துக்குள் புகுந்து, வெளிநடப்புச் செய்தனர். எதிர்க்கட்சித் தலைவர் சுனில் சர்மா, 2000, 2024 தீர்மானங்கள் குறித்த குறிப்புகள் தேவையற்றவை என்றும், மாநில அந்தஸ்தோடு மட்டுமே நிற்கும் ஒரு தீர்மானத்தைக் கொண்டுவர வேண்டும் என்றும் ஆளும் கட்சியைக் கோரினார்.
  • உள்நாட்டுப் பிரச்சினைகளைச் சாதகமாக்கி அமைதியைக் குலைக்கப் பார்க்கும் அண்டை நாடுகளைக் கொண்ட நுட்பமான பகுதி ஜம்மு காஷ்மீர் என்றும், இந்தியாவின் பிரிக்க இயலாத அங்கமான அப்பகுதியில் எந்த பாகிஸ்தான் நிகழ்ச்சி நிரலுக்கும் இடமில்லை என்றும் அவர் கூறினார்.
  • தீர்மானம் எடுத்துக்கொள்ள அனுமதித்ததற்காக, சபாநாயகர் அப்துல் ரஹீம் ரத்தரை நீக்கக் கோரும் தீர்மானத்தையும் அக்கட்சி கொண்டுவந்தது.
  • தீர்மானம் மாநில அந்தஸ்தை மீட்பதோடு நின்றுவிடுகிறது என்று சபையில் முதலமைச்சர் தெளிவுபடுத்தினார்; பிரிவு 370, பிரிவு 35A, 2019 ஆகஸ்ட் 5 க்கு முந்தைய நிலை ஆகியவற்றை உள்ளே கொண்டுவரும் வகையில் அதைத் திருத்த தம் கட்சியின் எட்டு சட்டமன்ற உறுப்பினர்கள் முயன்றதை அவர் தடுத்தார்.

2000 ஆம் ஆண்டின் தன்னாட்சித் தீர்மானம்

அதிகாரவர்க்கத்துடனான பிளவு

  • தான் தீர்மானத்தை முன்மொழிந்த மறுநாள், தலைமைச் செயலாளர் அடல் டுல்லூவும் சட்டச் செயலாளர் அசல் சேத்தியும், அதை அனுமதிக்க வேண்டாம் என்று சபாநாயகருக்குத் தனித்தனியாக எழுதினர் என்று முதலமைச்சர் சட்டப்பேரவையில் தெரிவித்தார்.
  • விவகாரம் நீதிமன்ற விசாரணையில் உள்ளது, எனவே விவாதிக்கத் தகுதியற்றது என்பதே அக்கடிதங்கள் கூறிய காரணம். அக்கடிதங்கள் தமக்குக் காட்டப்படவில்லை என்றார் முதலமைச்சர்.
  • முதலமைச்சர் முன்மொழியும் தீர்மானத்தை அந்த மாநிலத்தின் சட்டச் செயலாளரும் தலைமைச் செயலாளரும் எதிர்ப்பதை நாட்டின் எந்த மாநிலம் காணும் என்று கேட்ட அவர், தம் கேள்விக்குத் தாமே பதிலளித்தார்: யூனியன் பிரதேச அந்தஸ்தாலேயே அது நிகழ்கிறது; மாநில அந்தஸ்தை மீட்பதற்கான வாதமும் அதுவே.
  • யூனியன் பிரதேசம் ஒன்றில் சட்டமன்றத்தின் அதிகாரங்கள் குறித்த விவாதத்தை இந்நிகழ்வு திறந்துவிட்டது. காங்கிரஸ் சட்டமன்ற உறுப்பினர் நிஜாமுதீன் பட், அக்கடிதங்கள் சட்டப்பேரவைப் பதிவுகளின் பகுதியாக ஆக்கப்பட வேண்டும் எனக் கோரி, அதிகாரிகளின் செயலை சட்டப்பேரவையின் கௌரவம், கண்ணியம், அதிகாரங்களுக்கு விடுக்கப்பட்ட சவால் என்று கூறி, அதிகாரிகள் ஓர் அரசாகச் செயல்பட முடியுமா எனக் கேட்டார்.
  • சட்டப்பேரவை ஒரு மாநிலச் சட்டமன்றத்துக்கு உரிய அதே விதிகளாலேயே ஆளப்படுகிறது என்றும், அதற்கு மாறாக அரசியலமைப்போ ஜம்மு காஷ்மீர் மறுசீரமைப்புச் சட்டமோ எதையும் கூறவில்லை என்றும் அவர் வாதிட்டார்.
  • மக்கள் ஜனநாயகக் கட்சியின் சட்டமன்ற உறுப்பினர் வாஹித்-உர்-ரெஹ்மான் பர்ரா, அவ்விரு அதிகாரிகளுக்கு எதிராக சிறப்புரிமை மீறல் தீர்மானத்தைத் தொடங்கியுள்ளார்.

புதுப்பிப்பு, அக்டோபர் 5: மறுபக்கத்தின் பதில்

  • அக்டோபர் 4 அன்று ஸ்ரீநகரில் பேசிய பாரதிய ஜனதா கட்சியின் முன்னாள் மாநிலத் தலைவர் ரவீந்தர் ரெய்னா, மாநில அந்தஸ்து மீட்கப்பட வேண்டும் என்பதில் தம் கட்சியும் உறுதியாக உள்ளது என்றும், ஆனால் அப்பகுதியில் நிறைவேற்ற வேண்டிய சில முக்கியப் பொறுப்புகள் ஒன்றிய அரசிடம் உள்ளன, அவை நிறைவேறியவுடன் மாநில அந்தஸ்து வழங்கப்படும் என்றும் கூறினார்.
  • மாநில அந்தஸ்தை மீட்பதில் ஒன்றிய அரசு தாமதம் செய்கிறது என்றும், நாட்டின் பிற பகுதி மக்களை ஆளும் விதத்தில் அப்பகுதி மக்களை அது ஆளவில்லை என்றும் குற்றம் சாட்டிய அகில இந்திய காங்கிரஸ் பொதுச் செயலரும் சட்டப்பேரவை உறுப்பினருமான ஜி.ஏ. மீருக்கு அவர் பதிலளித்தார்.
