The legal framework governing internet shutdowns in India

Internet suspensions are now governed by Section 20 of the Telecommunications Act, 2023, read with the Telecommunications (Temporary Suspension of Services) Rules, 2024, which replaced the earlier framework under Section 5(2) of the Indian Telegraph Act, 1885. In Anuradha Bhasin versus Union of India (2020), the Supreme Court held that internet access is linked to the freedoms guaranteed under Articles 19(1)(a) and 19(1)(g), and that any shutdown must be lawful, proportionate, and time-bound.
Under the 2024 Rules, a shutdown order cannot exceed 15 days at a stretch and can be challenged before a High Court under Article 226 or the Supreme Court under Article 32.
