It has been a decade since the Juvenile Justice (Care and Protection of Children) Act, 2015 came into force, altering the juvenile justice landscape by introducing the transfer system. A Private Member's Bill introduced in Parliament in December 2025 seeks to amend the Act by lowering the age threshold from 16 to 14 years for children accused of heinous offences carrying minimum punishment of seven years imprisonment or more. If enacted, this will permit 14 to 15 year olds to potentially be exposed to adult criminal trial processes and prison, further eroding principles of care, rehabilitation and reintegration while prioritising retribution. Of the 40,036 children apprehended in 2023, 79% comprising 31,610 were between ages 16 to 18 years, with those aged between 12 and 16 constituting only the remaining 21% comprising 8,426 children.

The NCRB data directly contradicts any claim that younger adolescents specifically those between 14 to 16 years are the driving force behind an increase in serious crime requiring harsher legislative response.

Many cases involving adolescents arise from structural vulnerability and inequalities, with many children in conflict with law simultaneously being children in need of care and protection.

Their contact with the justice system often reflects unmet welfare obligations rather than inherent criminality, making punitive approaches fundamentally misguided and counterproductive to societal safety goals.

3. Child Rights Implications and Alternative Approaches

Exposure to adult criminal processes carries serious consequences for children including interrupted schooling, stunted cognitive development, stigma from criminal proceedings, and lasting psychological strain from prolonged justice system engagement.

Evidence indicates children are still illegally detained in police stations and placed in adult prisons contrary to statutory safeguards, highlighting systemic failures requiring accountability rather than lowering age thresholds.

Similarly placed children face starkly different outcomes resulting from personal circumstances, assessment processes, and subjective JJB decisions rather than their actual conduct, creating discriminatory outcomes.

The answer lies not in withdrawing protection but in investing in strengthening institutions and communities meant to support children before harm occurs through early intervention mechanisms.

Strengthening family support systems, education access, mental health services, and systemic changes addressing root causes of juvenile offending would serve both child welfare and public safety more effectively.

Conclusion

The proposal to lower the age threshold for trying children as adults represents a fundamentally flawed approach that prioritises retribution over rehabilitation. Legislative attempts at blurring the distinction between adolescence and adulthood undermine foundational child rights principles including best interests and equality before law. Expanding the transfer mechanism to children as young as 14 risks institutionalising arbitrariness at an earlier and more vulnerable stage of childhood. Recasting systemic failures as justification for harsher treatment of children in conflict with law does not solve the problem but merely transfers consequences onto those least equipped to bear them. The focus must shift from fixing the child to fixing the system through preventive interventions and institutional strengthening.
