Legal Framework

Transplantation of Human Organs and Tissues Act, 1994

  • Prohibits organ donations and transplants in exchange for money.
  • Aims to protect poor and vulnerable donors from exploitation.

Types of Organ Donations Allowed

  • a) Deceased donor organs.
  • b) Living donor organs from known persons.

Living Donation Regulations

  • Primarily from close relatives (parents, siblings, children, spouse, grandparents, grandchildren).
  • Altruistic donations from distant relatives, in-laws, or long-time friends allowed with additional scrutiny.

Documentation Requirements

  • For close relatives:
  • Identity proofs.
  • Family tree documents.
  • Proof of donor-recipient relationship.
  • Financial standing of the donor.
  • For unrelated persons:
  • Evidence of long-term association or friendship.
  • All other standard documents.

Penalties for Violations

  • Up to 10 years imprisonment.
  • Fine up to Rs 1 crore.
  • Applicable for offering/accepting payment, negotiating, advertising, or abetting illegal organ trade.

Kidney Transplants: High Demand and Vulnerabilities

Reasons for High Demand

  • Estimated 2 lakh Indians reach end-stage kidney failure annually.
  • Only 12,000 kidney transplants occur yearly.

Factors Making Kidneys Vulnerable to Illegal Trade

  • a) High demand-supply gap.
  • b) Lowest risk to donors among organ transplants.
  • c) Relatively affordable (about Rs 5 lakh per transplant).
  • d) Wide availability of transplant centers (over 500 in India).
  • e) Longer viability outside the body (24-36 hours).

Addressing the Supply Gap

Promoting Deceased Organ Donation

  • Currently, only 16% of total transplants use deceased organs.
  • Potential for significant increase through awareness.

Government Initiatives

  • Aadhaar-linked registry of donors.
  • Ensures family members are aware of donor's wishes.

Need for Reducing Transplant Requirements

  • Focus on preventive healthcare to reduce organ failure cases.

தேவையான ஆவணங்கள்

  • நெருங்கிய உறவினர்களுக்கு:
  • அடையாள ஆதாரங்கள்.
  • குடும்ப மர ஆவணங்கள்.
  • தானம் செய்பவர்-பெறுபவர் உறவு நிரூபணம்.
  • தானம் செய்பவரின் நிதி நிலை.
  • தொடர்பில்லாத நபர்களுக்கு:
  • நீண்டகால தொடர்பு அல்லது நட்பின் ஆதாரம்.
  • மற்ற அனைத்து நிலையான ஆவணங்கள்.

விதிமீறல்களுக்கான தண்டனைகள்

  • 10 ஆண்டுகள் வரை சிறை.
  • ரூ.1 கோடி வரை அபராதம்.
  • பணம் வழங்குதல்/ஏற்றுக்கொள்ளுதல், பேரம் பேசுதல், விளம்பரப்படுத்துதல் அல்லது சட்டவிரோத உறுப்பு வர்த்தகத்திற்கு உடந்தையாக இருத்தல் ஆகியவற்றிற்கு பொருந்தும்.

சிறுநீரக மாற்று அறுவை சிகிச்சை: அதிக தேவை மற்றும் பாதிப்புகள்

அதிக தேவைக்கான காரணங்கள்

  • ஆண்டுதோறும் சுமார் 2 லட்சம் இந்தியர்கள் இறுதிநிலை சிறுநீரக செயலிழப்பை அடைகின்றனர்.
  • ஆண்டுக்கு 12,000 சிறுநீரக மாற்று அறுவை சிகிச்சைகள் மட்டுமே நடைபெறுகின்றன.

சிறுநீரகங்கள் சட்டவிரோத வர்த்தகத்திற்கு ஆளாகும் காரணிகள்

  • அ) அதிக தேவை-விநியோக இடைவெளி.
  • ஆ) உறுப்பு மாற்று அறுவை சிகிச்சைகளில் தானம் செய்பவர்களுக்கு குறைந்த ஆபத்து.
  • இ) ஓரளவு மலிவான விலை (ஒரு மாற்று அறுவை சிகிச்சைக்கு சுமார் ரூ.5 லட்சம்).
  • ஈ) பரவலான மாற்று அறுவை சிகிச்சை மையங்கள் (இந்தியாவில் 500க்கும் மேல்).
  • உ) உடலுக்கு வெளியே நீண்ட நேரம் உயிர்வாழும் தன்மை (24-36 மணிநேரம்).

விநியோக இடைவெளியை நிவர்த்தி செய்தல்

இறந்தவர்களின் உறுப்பு தானத்தை ஊக்குவித்தல்

  • தற்போது மொத்த மாற்று அறுவை சிகிச்சைகளில் 16% மட்டுமே இறந்தவர்களின் உறுப்புகளைப் பயன்படுத்துகின்றன.
  • விழிப்புணர்வு மூலம் கணிசமாக அதிகரிக்க வாய்ப்பு.

அரசாங்க முயற்சிகள்

  • ஆதார் இணைக்கப்பட்ட தானம் செய்பவர்களின் பதிவேடு.
  • தானம் செய்பவரின் விருப்பத்தை குடும்ப உறுப்பினர்கள் அறிந்திருப்பதை உறுதி செய்கிறது.
