What Parliament Passed

  • The Tribunal Reforms Bill, 2026 was passed by the Lok Sabha on August 10 and by the Rajya Sabha on August 11, 2026, both by voice vote; the Opposition staged a walkout during the Rajya Sabha vote. The Bill was piloted by Law Minister Arjun Ram Meghwal.
  • Its central provision is the creation of the National Tribunals Commission (NTC), a permanent body meant to standardise how members are appointed to India's many tribunals, which currently follow different, uneven appointment procedures set by their individual founding statutes.
  • The Bill also restores a five-year term for tribunal members (an earlier Ordinance-era rule had cut this shorter), lays down uniform service conditions across tribunals, and creates a National Tribunals Data Grid to track vacancies, pending cases and disposal rates in one place.

Why Tribunals Exist: Articles 323A and 323B

  • Tribunals were introduced into the Constitution by the 42nd Constitutional Amendment Act, 1976, which inserted Article 323A (covering administrative tribunals, for service disputes of government employees) and Article 323B (covering tribunals for other specified matters, such as taxation, land reforms, and industrial and labour disputes).
  • The idea was to move certain categories of disputes out of the ordinary court hierarchy and into specialised bodies staffed with subject experts, so that fields such as income tax, administrative service matters, environmental regulation, company law and armed forces disputes could be adjudicated faster, easing the backlog on regular courts.

The Legal Battle That Forced This Bill

  • In S.P. Sampath Kumar vs Union of India (1987), the Supreme Court examined the constitutional validity of tribunals replacing High Courts for service matters, and held that any such substitute mechanism must be an equally effective alternative that preserves the essence of judicial review.
  • In L. Chandra Kumar vs Union of India (1997), a seven-judge Bench of the Supreme Court ruled that tribunals cannot function as substitutes for the High Courts and Supreme Court: the power of judicial review under Articles 226, 227 and 32 of the Constitution is part of the basic structure and cannot be excluded, so tribunal orders remain subject to High Court scrutiny.
  • In Rojer Mathew vs Union of India (2019), the Supreme Court first recommended setting up an independent National Tribunals Commission to oversee appointments, service conditions and administration of tribunals, warning that leaving these functions entirely with the executive risked compromising tribunals' independence.
  • Most recently, in Madras Bar Association vs Union of India (2025), the Supreme Court struck down several Ordinance-era rules under the Tribunals Reforms Act, 2021, and directed the government to constitute the NTC within four months, a deadline that directly forced the drafting of this year's Bill.

What Critics Say

  • Even under the new Bill, the Centre continues to appoint NTC members itself; the Chief Justice of India is consulted only for selecting the Commission's chairperson and its judicial members, not for every appointment.
  • Critics argue this falls short of the full institutional insulation from executive influence that the Supreme Court's Rojer Mathew judgment had envisioned for the Commission, meaning the debate over how independent India's tribunal system truly is may not be settled by this Bill alone.

விமர்சகர்கள் என்ன கூறுகின்றனர்
